At this point it was clear to us that the fence could not be the same on both sides and the <br />City of Arden Hills allowed an unlicensed contractor to finish the fence in violation of <br />the Zoning Code. On September 18, 2009, James Lehnhoff told us that he disagreed with <br />us. The fact that the fence was not the same on both sides could have been easily <br />determined by the City of Arden Hills reviewing an accurate site plan for the fence and <br />asking a few knowledgeable questions at the time of the Zoning Permit application and <br />before issuance of the Zoning Permit. <br />Fran Holmes, a neighbor and member of the city council visited our home on Sunday, <br />September 20, 2009 and followed up later with the process for appeal. <br />If the contractor doesn't ask permission to enter on our property to build the fence, the <br />fence has to be set back from the boundary line sufficiently to build the fence and <br />maintain the fence. It seems impossible to build a fence that complies with the Zoning <br />Ordinance with the good side facing the neighbor and build the fence right on the <br />property line, which is why we have a problem here. The City of Arden Hills either gave <br />them permission to build the fence backwards or did not ask enough questions in the <br />Zoning Permit application process, missed the requirement of viewing a site plan of what <br />the fence would look like or issued the Zoning Permit without all the information. Then <br />failed to inspect the construction of the fence and finally did not follow the City's <br />responsibility to enforce the Zoning Code. The Building Inspector saw the fence for the <br />first time on December 10, 2009 after it had been constructed. <br />It appears that someone within the City of Arden Hills dropped the ball in allowing the <br />construction of this fence. The fence is now built and it is not the same on both sides as <br />represented by the Contractor. We would appreciate the City taking responsibility and <br />rectifying this matter rather than having us bear the negative decline in the economic <br />value of our home and the loss of enjoyment of our property. <br />Here are some of our concerns: <br />I. All contractors must be licensed by the state or City before working in Arden <br />Hills. This form is used for all contractors including sign installers. <br />A. We would like a copy of the state or city license for the contractor that built the fence <br />at 1777 Glenview Avenue. <br />• was the contractor that built the fence licensed by the state or the city of Arden <br />Hills and if Arden Hills, did he pay the $30 fee for the City contractor's License <br />to work in Arden Hills? <br />B. The Zoning Permit Application (See Attachment 1) states that the Homeowner will be <br />the Contractor and the Owners are listed as Nancy and Timothy Mahoney. The Zoning <br />Permit (See Attachment 2) under Contractor Information lists the Owner as the <br />contractor. The owner is then listed as Timothy Mahoney.
