• The frame studs are toe -nailed poorly into the fence posts with nails with large <br />heads that are mashed in <br />• This is the unfinished side of the fence that shows the 2 x 4 structural frame for <br />the fence <br />o 2 x 4 at the top of the fence <br />o 2 x 4 about 15-24 inches from the top of the fence <br />o 2 x 4 at the bottom of the fence <br />• The framing 2 x 4 studs are indented 1 1/2 inches from the post on the 1774 <br />Gramsie Road side of the fence compared to indentation of 1/2 inches on the 1777 <br />Glenview Avenue side of the fence, further enforcing the argument that the back <br />of the fence faces 1774 Gramsie Road <br />F. Conclusion. <br />In this case, "facing as applied to fence posts" faces the home at 1777 Glenview <br />Avenue, not our home at 1774 Gramsie Road. This is a violation of the Zoning Code. <br />III. The fence is NOT the same on both sides as the contractor used a mixture of S4S <br />cedar, with rough sawn cedar, and 1X boards with a mixture of 2X boards. The <br />1777 Glenview Avenue side of the fence has different and significantly better <br />material on their side of the fence compared to the 1774 Gamsie Road side of the <br />fence. <br />A. Most fence ordinances require: <br />• If the material used in fence construction is not finished on both sides, the <br />finished side of the material shall be on the outside, facing adjoining properties <br />and all structure supporting the fence shall be on the inside or owners side of the <br />fence. <br />B. Materials. The materials the contractor used to build the fence are not the same on <br />both sides. <br />• The 1777 Glenview Avenue side of the fence has <br />o the finished side of rough sawn cedar as fence face boards <br />o decorative 1 x 4 trim made of finished rough sawn cedar <br />• The 1774 Gramsie Road side of the fence has: <br />o The back side of fence face boards made of rough sawn cedar <br />o 2 x 4 framing studs made of inferior, questionable quality smooth -(not rough <br />sawn cedar), cedar, pine or fir with numerous large knots obvious knots. <br />
