VII. Fence Maintenance. There is not enough room on the 1774 Gramsie Road side of <br />the fence for the homeowner at 1777 Glenview Avenue to maintain the side of the fence <br />that faces 1774 Gramsie Road and the grounds beneath it. This will lead to a condition of <br />disrepair and a potential nuisance. Fences are to be kept maintained and kept in good <br />repair. <br />VIII. Appearance and Aesthetic Issues <br />A. All 15 fence footings are above ground and create a visual sloppiness that negatively <br />affects the appearance of the fence, the economic value of our property and causes the <br />loss of enjoyment of our property. <br />• See photos — Attachment <br />B. The fence is stepped in a very arbitrary fashion, with bays stepping almost willy nilly. <br />And bays that are level and the very next bay is not. <br />C. No finished caps <br />D. No finished trim along the top edge of the fence <br />IX. Conclusion <br />• We understand that it is possible for professional fence contractors to construct a <br />fence that is the same on both sides, but that is not what has happened in this case. <br />• If there is a three step process to building a fence. Install the posts, install the rails <br />and screw on the fencing. In this case all three steps were done in violation or the <br />ordinance. We can't see anything that was done right by the fence Contractor. <br />o The posts were installed so they encroach on our property and with raised <br />cement <br />o The rails were installed on our side of the fence instead of as the ordinance <br />requires that they face the homeowner building the fence <br />o The fencing was screwed on the wrong way in violation of the ordinance. <br />To prove this, Patricia Schneider had a phone conversation with Ron <br />Moors and it was followed up by an email dated September 18, 2009 <br />where we gave permission to the Maloney's fence contractor to come onto <br />our property to nail fence boards to the fence frame with the naikls going <br />in toward the Maloneys side of the fence for the remainder of the fence <br />construction so our side of the fence would begin to be the face of the <br />fence in accordance with the City of Aren Hills ordinance. This way the <br />fence facing would be applied to the fence frame with nails pounded from <br />
