The enclosures include (1) an itemized summary of and <br />response to each claim made by the Schneiders with supporting documentation and (2) a <br />timeline tracing the history of contacts between the parties and actions taken. <br />Background Information <br />When the Maloneys moved into their Arden Hills home, high school and younger <br />children, and even adults were cutting all the way through the Maloneys' yard, damaging <br />the grass and hill in front of the house. When two of them were asked twice to stop <br />cutting through, they threw a dozen eggs at the house and tossed several rolls of toilet <br />paper over their trees and bushes. The Maloneys decided to build a fence across the rear <br />of their property. <br />The fence was vehemently opposed by Mr. Schneider, who stated that he considered a <br />portion of the Maloney yard to be part of his "park like" back yard, and that a fence <br />(showing where his property actually ended) would reduce the resale value of his <br />property. <br />In light of the Schneiders' objections, the Maloneys moved with extreme caution to <br />comply with all applicable ordinances and requests of the City. The Maloneys hired a <br />surveyor and had the property line marked; Mr. Schneider tore up the surveyor's stakes. <br />Initially and absolutely forbidden from stepping onto Schneider property, the builders <br />used methods to construct the fence which were more cumbersome than would otherwise <br />have been necessary. The builders were made aware of the Schneiders' objections and <br />were careful to make the Schnei..,der side of the fence the "right" side, with nail and screw <br />heads facing the Maloney side.
