Maloney Reply to Schneider complaint to Arden Hills Planning Commission of Dec. <br />1192009 <br />Summary of specific complaints by Schneiders: <br />1) Fence does not face Schneiders' property <br />2) it is not a fence with two finished sides; good side faces Maloneys' property; <br />Maloneys' side has no "structural supports" showing <br />3) same materials not used on both sides of fence; "inferior" wood (including pine) <br />used on Schneiders' side; 2x4s have knots on Schneiders' side; "better material" <br />on Maloneys' side <br />4) 7 of the 15 fence footings still encroach on the Schneiders' property <br />5) fence footings are all above ground and create "visual sloppiness" <br />6) it is too high; it exceeds 6 feet <br />7) damage to their property has not been repaired <br />8) the fence is stepped in an "arbitrary," "willy-nilly" fashion <br />9) no post caps; no finished trim along the top of the fence <br />10) the rails were installed on the Schneiders' side <br />11) the fence was screwed on the "wrong way" <br />12) it has reduced the value of their home <br />13) it cannot be maintained on the Schneiders' side <br />14) contractor was unlicensed <br />Responses by the Maloneys to the specific complaints above. Numbering below <br />corresponds to the numbering above. <br />1 & 2) The fence was designed and built to look the same on both sides. Therefore, by <br />definition, there is no "good" or "bad" side, no back or front, no "finished" and <br />"unfinished" sides. Both sides are equal and look identical. See our photos taken 28 <br />December 2009: photo #1 [Exh. A] shows the Schneiders' side of the fence descending <br />from east to west; photo #2 [Exh. B] shows the Maloneys' side rising from west to east. <br />Except for the fact that the Schneiders' side is in shadow and our side is in sunshine, they <br />are identical. However, all the nail and screw heads are visible only on the Maloneys' <br />side; there are none visible on the Schneiders' side. See photo #3 [Exh. A] for a clearer <br />view of this detail from our side of the fence. This was our good -faith attempt to ensure <br />that the Schneiders had the more "finished" or better -looking side, even though otherwise <br />both sides look the same. <br />3) Exactly the same materials were used for both sides of the fence, which is made <br />completely of cedar. See enclosed invoice from the lumber company, [Exh. B] and the e- <br />mail from the builder [Exh. C] . There is no pine or any other so-called "inferior" wood <br />anywhere in the fence. There is some variation of grain and coloring in the lumber, as <br />there is with all lumber. We just installed hardwood flooring in our house, and there was <br />lots of variation in that. even though it was all the same product. There are also knots <br />
