10) "Rails" or cross -members were installed on both sides of the fence. See our photos <br />and response #3 above. The fence looks the same on both sides. It was designed and <br />built that way. The Schneiders' photos were taken before the fence was finished. <br />11) We have no idea what this particular complaint is about. The fence is not falling <br />down, so it was obviously "screwed on" correctly. The screw and nail heads are all <br />visible only on the Maloneys' side, though, which makes the Schneiders' side the <br />"finished" or "best" side. <br />12) & 13) With respect to the Schneiders' claim of loss of value and enjoyment of their <br />property, the fence has only reduced the incidence of trespassing on our property by the <br />Schneiders and by numerous students from Mounds View High School. Real estate <br />experts state year -in and year -out that one of the best value enhancers for homes is a good <br />fence. This fence is made of top -grade cedar, and is designed and built far more solidly <br />than the pre -fabricated fence sections found at Menards and Lowes and other home - <br />improvement stores. While examining the project at one point, one of the city's building <br />inspectors declared to us that the fence had been erected "with great care." We believe <br />so, too. It will last for many decades and look perfectly fine on both sides without any <br />need for stain or other types of maintenance. It is because of this unparalleled resistance that so many people <br />choose to use cedar for their fences and home siding as well as for furniture, especially outdoor <br />furniture and other garden items. Cedar is an exceptionally light wood that won't shrink or warp <br />like many other woods do." <br />With respect to the few inches of the Maloneys' property on the Schneiders' side of the <br />fence, the spaces between the bottom of the fence sections and the ground will allow the <br />grass there to be trimmed with a weed -whacker from the Maloneys' side of the fence. <br />Leaving space between the ground and the bottom of the fence was recommended by city <br />staff and is also recommended by knowledgeable fence builders (see quotes in # 12 <br />above). So, with the best of intentions, we proceeded to use the pre-cut six-foot fence <br />boards provided by the lumber company, all placed a few inches above the ground. <br />14) The builder, Tom, is a personal friend who has worked on many construction <br />projects. Originally he was going to help Tim Maloney to build the fence but Tim's <br />schedule became too full during the fall to permit him to take time off work to tackle the <br />project.
