by reducing the average setback by ten feet. Dwellings would still be required to meet <br />the minimum lake setback. <br />7. Dock setbacks — The proposed regulations include a five foot setback for dock placement <br />at the shoreline. There is also an added provision that would allow the Zoning <br />Administer to alter this regulation if topography or lot width created a significant <br />limitation on dock placement on a particular lot. <br />8. Mitigation — A mitigation plan similar to the one used by Shoreview has been added in <br />place of the permeable surface credit that was proposed previously by Staff. The new <br />language would require all properties seeking special approval from the City through a <br />variance or conditional use permit to provide a mitigation plan to the City. The <br />mitigation plan would also be required if a property wanted to increase the impervious <br />coverage by up to five percent with a pervious hard surface. <br />Performance Standards (Attachment C) <br />Section 1325.07 included regulations on lakefront lots; however, that section has been removed <br />from Section 1325 and reincorporated into Section 1330. These regulations have not otherwise <br />been altered. <br />Summary Impact of Proposed Ordinance Update <br />The proposed changes will not cause any existing conforming structures to become non- <br />conforming. The purpose of this update is to clarify the regulations, introduce a reasonable <br />amount of flexibility for unique situations, and enhance the City's ability to enforce the <br />regulations.
