We have used work sessions of this type <br />effectively as part of our Roseville proj ect as a way to share information and develop a <br />consensus approach between staff and consultant. <br />• Deliverable: Memorandum outlining findings of the analysis and recommendations for <br />changes or additions to the regulations <br />2. Legal Review: Review the proposed regulations for consistency with Minnesota laws. This task <br />will be focused at two points during the schedule: an initial review of the currently proposed regulations <br />(simultaneous with Task 1) and a subsequent review of the �nal draft regulations, towards the end of <br />Task 3. Legal review will focus on several issues: <br />• The consistency of proposed and �nal draft regulations with Minnesota land use and <br />contracting statutes and case law; including municipal authority in zoning, subdivision, master <br />planning, and development agreements. As well as the consistency of proposed and draft <br />regulations with environmental remediation rules and agreements. <br />• The reasonableness of the requirements for the master plan as speci�ed in the regulations, <br />including the requirements for environmental remediation and for traf�c studies. Assuming the <br />results of these studies may affect the development opportunities presented by the site to <br />varying degrees, how can this potential uncertainty be communicated in the regulations? <br />• The relationship between the zoning regulations and any future developer agreements limiting <br />the uses on the site or requiring specific public improvements; con�rming that such <br />agreements do not conflict with the intent or language of the regulations. <br />Summary of Tasks <br />• Meetings: One separate meeting with planning staff; participation in one work session with <br />planning staff <br />• Deliverables: Memorandum outlining potential legal issues with the currently proposed <br />regulations and recommendations for revisions. Review and mark-up of �nal draft regulations. <br />3. Recommendations: Research and recommend language to enhance the proposed regulations. <br />This task encompasses much of the proj ect budget and schedule. It will include a number of different <br />components: <br />• Two work sessions with planning staff. The first session focuses on recommendations for <br />enhancements to the regulations; the second session focuses on re�ning a�nal draft. <br />• Research and drafting assistance. We will provide examples of similar ordinances or <br />approaches to master planned districts and suggest language and illustrations that will help <br />meet the City's goals. Illustrations are an optional but potentially useful part of the regulations. <br />• Review and refinement. We will work with staff to finalize the language and organization of <br />the regulations. <br />• Optional: Public presentations. This o tional task would involve assisting staff with <br />presentations at public information meetings, Planning Commission meetings and/or Council <br />meetings. We suggest that consultants could attend up to four meetings, if desired — one public <br />
