No variance sha�� have t�e effect of a��ovwi�g in any di�trict uses that are pro��bited in tha� distriet, permit a�ower degree of flood protect�on than the Regu��tory F�ood Prorection ��evat�on f�r t�e pa�t�cular area, or �ermit stanc�arc�s �ower thar� those require�l by State law. The fo�lowir�g ac�ditional ��.riance cr��eria" of the Federai Emergenc}� Managerr�ent Agency r�ust be satisf ed: A. Varianc�s shali not be iss�ed �y a com�uni�� wi�hir� any desig�ated reg�Ia�ory �oodway if any increa�e in flood levels d�r�ng the base #�ood d�sc�arge would �esul�. B. Varian�es �hal� only be is�ued by a co�muni�y upon {i} a showing �� good ar�d suff cien� cause, (ii) a determination that fai�ure to gran� �he variance woulci result in exceptiona� hardship �o t�e app��cant, and �iii) a dete�inat�on tha� t�e grar�ting of a va�iance vWi I� not result in increased flood he�ghts, addit�onal threats to pubiic safety, ext�-aorc��nary public expe�se, create nu�sances, ca�se fraud on or victim�zation of the public, or conflie� witl� exis�ing Iocal laws or ordinances� C. Varia�ces shal� only be issued upon a de�termination that the variance �s the r�in�rr�um nec�ssary, considering t�e flood hazard, to afford relief. Subd. 4 Cond�t�onal LJses_ The City Counci� shall �ear and d�cide applicatior�s for �o�ditio�a� uses permissi��e under this Section. The Boa�d s�al� arrive at a decision an the appeal, variance, or co�dit�or�ai use pe�i� in a�cordance with Section 1355. In g�-anting a va�iance or cor�ditional use permi� the City ma� prescribe approp�iate conditions and safeguards, w�i�h sha11 be in confarmity with the purposes of this Sectlon. Vio�ations of �uch conditions and safegua.r�is, v�he� mac�e a par� of the terms under whic� the va�iar�ce or conditional use pern�it �s granted, shall be pun�sh�b�e as described in Section 1335.36. A copy of al� decis�ons granting variances or conditional use permi�s shal� be fo�-v�arded by �na�� to the Commission of I�latural Resaurces vvith�n ten (� fl} days �f �he ac�ion.
