Recommendation <br />Staff recommends approval of this variance application. The findings of fact for this variance <br />support a recommendation for approval. The property is unique in the City. The narrowness of <br />the lot, which is more narrow than other lots in the area, make siting a conforming new home <br />extremely difficult. If all setback requirements were met the home and garage would need to be <br />constructed within a 49 foot wide by 40 foot deep area. The existing home currently encroaches <br />within both side setbacks. Additionally, the applicant is proposing to increase the west side yard <br />setback, bringing it into conformance with the existing Code. <br />If the Planning Commission recommends approval of the variance, Staff recommends the <br />following five conditions: <br />1. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission. <br />2. Building, Grading and Erosion Control, and Demolition permits shall be obtained by <br />the property owner. <br />3. The structure shall conform to all other regulations in the City Code. <br />4. The applicant shall obtain approval or a waiver from the Rice Creek Watershed <br />District prior to the issuance of any building permits. <br />5. The applicant shall submit a Shoreland Mitigation plan to the City in accordance with <br />Section 1330.03 Subd 7E subject to the approval of the City Planner. <br />Options <br />1. Recommend Approval as Submitted: Motion to recommend approval of Planning Case 09- <br />022 for a variance at 1563 Edgewater Avenue based on the findings of fact and the submitted <br />plans, as proposed in the April 7, 2010, planning case report. <br />3. Recommend Denial: Motion to recommend denial of Planning Case 09-022 for a variance at <br />1563 Edgewater Avenue based on the following findings... <br />4.
