EN HILLS <br />MEMOI�:ANDUM <br />1)AT�: June 14, 2010 <br />TO: Mayor & City Council <br />FROM: James Lehnhoff, Community Development Director <br />Michelle Olson, Parks and Recreation Manager/Acting Public Works Director <br />SUBJECT: Lexington Avenue Sidewalk Project: Special Assessment Waiver Approval <br />Action Request <br />Motion to approve the Special Assessment Waiver with Inland Shannon Square Cub, LLC and <br />Inland Shannon Square Shoppes, LLC as proposed in the June 14, 2010, memorandum. <br />Back�round <br />The 2010-2014 Arden Hills Capitol Improvement Plan (CIP) proposed to construct an <br />approximately 960 foot long, eight foot wide trail along the west side of Lexington Avenue from <br />the Canadian Paci�c Railroad crossing to the traffic signal at Grey Fox Road (Attachment A). <br />When the proj ect was discussed in late 2009, the City Council directed staff to contact the <br />adj acent property owner to determine if they would be willing to fund half the cost of the proj ect. <br />The 2009 cost estimate was approximately $63,000. <br />The proposed trail would be adjacent to two properties: the Shannon Square Shoppes and the <br />Shannon Square Cub Foods. Both properties are owned and managed by Inland. When staff inet <br />with the property manager to discuss the concept earlier this year, the manager expressed interest <br />in the proj ect and recognized the beneiits to the property. After their internal review, Inland <br />preliminarily agreed to fund up to half the cost of the proj ect, depending on final cost, with the <br />other half funded by the City. <br />During the discussions with the property manager, they requested the option to have their portion <br />of the cost specially assessed to both properties. With that option, the City requested that Inland <br />sign a waiver of their right to appeal the special assessment, which they agreed to do.
