Motion to Accept 2008 Financial Reports as Presented <br /> H. Approve Planning Case 09-010 for a Conditional Use Permit <br /> Amendment at 1411 Paul Kirkwold Drive Based on the Findings of <br /> Fact and the Submitted Plans as Amended by the Three Conditions in <br /> the July 13, 2009, Memo to the City Council <br /> MOTION: Councilmember Grant moved and Councilmember McClung <br /> seconded a motion to approve the Consent Calendar as presented and <br /> to authorize execution of all necessary documents conta ined therein. <br /> The motion carried unanimously (5-0). <br /> 5. PULLED CONSENT ITEMS <br /> None. <br /> 6. PUBLIC HEARINGS <br /> None. <br /> 7. NEW BUSINESS <br /> A. Motion to Approve Planning Case 09-011 for a Master Planned <br /> Unit Development, Final PUD for Phase 1, Preliminary Plat, and <br /> Final Plat of the Arden Plaza Redevelopment Proposal and the <br /> Development Agreement at 3527 Lexington Avenue South Based <br /> on the Findings of Fact and the Submitted Plans, as Amended by <br /> the Conditions in the July 13, 2009, Planning Case Report <br /> City Planner Meagan Beekman stated that this was an application from Arden <br /> Plaza LLC for a Master PUD, a Final PUD for Phase I, and a Preliminary and Final <br /> Plat of the Arden Plaza. They are also seeking approval of the development <br /> agreement. She reviewed the PUD process and stated that the goal of this process <br /> was to provide the City and developer with greater flexibility, and obtain a better <br /> project than could be given the typical design standards. She also noted that <br /> deviations are not considered variances and the variance review criteria do not <br /> apply. A PUD would apply to the property so if the Arden Plaza property were sold <br /> then the PUD would still remain in effect. This review included the Zoning Code, <br /> the Sign Code, and the Design Standards for the B2 District. In addition the PUD is <br /> in compliance with the Guiding Plan for the B2 District and the Comprehensive <br /> Plan. The applicant is proposing to demolish the office pod that is currently on the <br />
