AR—DEN HILLS CITY COUNCIL—March 29, 2010 9 <br /> 7.B. Approve Ordinance 2010-005 to Amend Section 630 of the City Code Regarding <br /> Construction Activity as Presented in the March 8, 2010, Report to the City Council, and <br /> Approve Publication of a Summary of Ordinance 2010-005 and Approve Ordinance <br /> 2010-006 to Amend the 2010 Fee Schedule to Add a Construction Activity Waiver <br /> Application Fee as Presented in the March 8, 2010, Report to the City Council, and <br /> Approve Publication of a Summary of Ordinance 2010-006 <br /> Councilmember Holmes asked if the City had people requesting to do construction outside of the <br /> hours allowed. <br /> Public Works Director Hoag stated the City gets one or two requests per year and other cities <br /> allow for this. Land O'Lakes and Boston Scientific have asked for nighttime waivers in order to <br /> do parking lot maintenance. <br /> Councilmember Holmes stated if the requests were for parking lot maintenance then the <br /> ordinance could be more restrictive. <br /> Community Development Director Lehnhoff stated this could be looked into. <br /> Mayor Harpstead stated it would be possible to limit these construction activities in industrial <br /> zones. <br /> Councilmember Holden stated it could be but the City has several businesses that are not in <br /> industrial zones such as churches, North Heights, and Trinity Lutheran. These places have large <br /> g <br /> parking lots that will require maintenance. <br /> Community Development Director Lehnhoff stated Boston Scientific is adjacent to a residential <br /> area as well. He stated the ordinance could specify non-residential uses and this would exclude <br /> homes. <br /> Mayor Harpstead stated he was concerned about keeping the overnight construction activities <br /> out of neighborhoods and by having it restricted to industrial zones the neighborhood line would <br /> still be observed. <br /> Councilmember Holden asked if there have been any requests that have not been maintenance. <br /> Public Works Director Hoag stated that he does not recall any. <br /> Mayor Harpstead stated the City does not have differences in its codes for construction versus <br /> maintenance. <br /> Community Development Director Lehnhoff requested there be direction to Staff for this. Staff <br /> could bring this back to the Council at a later time if preferred. <br />
