_._ <br />_ <br />�.� EN HILL� <br />MEMORANDUM <br />DATE: July 12, 2010 <br />TO: Honorable Mayor and City Council Members <br />FROM: Rebecca Brazys, Deputy Clerk <br />SUBJECT: Holiday Station Application for Off-Sale 3.2% Beer License <br />Back�round <br />The City has received an application from the Holiday Station, 1920 Highway 96, for an <br />off-sale 3.2% beer license. A background check has been completed and the Lake <br />Johanna Fire Department conducted a fire safety inspection and found no violations. <br />This application meets the requirements of our City Code, Chapter 5, Alcoholic <br />Beverages, for off-sale 3.2% beer. Our City Attorney has been involved in the review of <br />. <br />this applicatlon. <br />Mike Polla, Special Investigator for the Minnesota Department of Public Safety Alcohol <br />and Gambling Enforcement Division, has advised that a 3.2 beer license does not require <br />state approval. Once the application is approved by the Council, a Clerk Certificate must <br />be completed and forwarded to the state for their record�. <br />Per City Code 500.11, Granting of License, the Council "may hold a public hearing <br />relative to the issuance of any license under the provisions of this section." The question <br />before the Council at this time is whether or not they wish to schedule a public hearing on <br />this application or proceed with approval. <br />Council Action Requested <br />Council is asked to determine whether or not they wish to hold a public hearing on this <br />license application or simply proceed with approval. <br />
