Cite of Arden Hills Chapter 13 Zoning Code <br /> Section 1305 -Rules, Scope,Interpretation, & Definitions <br /> 1305.01 Rules of Construction. The language set forth in the text of this Code shall be <br /> interpreted in accordance with the following rules of construction. <br /> Subd. 1 The singular number includes the plural and the plural includes the <br /> singular. <br /> Subd. 2 The present tense includes the past and future tenses and the future <br /> includes the present. - <br /> Subd. 3 The word "shall" is mandatory while the word "may" is permissive. <br /> Subd. 4 The masculine gender includes the feminine and neuter. <br /> Subd. 5 All measured distances expressed shall be to the nearest tenth of a foot and <br /> its metric equivalent. <br /> Subd. 6 The word "lot" shall include the words "plot", "piece" and "parcel" of land. <br /> Subd. 7 The words "used for" shall include the phrases "arranged for", "designed <br /> for", "intended for", "improved for", "maintained for" and "occupied for". <br /> 1305.02 Scope. From and after the effective date of this Code, the use of all land and every <br /> structure, building or portion of a building erected, altered with respect to area, added to or <br /> relocated, and every use accessory.thereto, in the City of Arden Hills, shall be in conformity with <br /> the provisions of this Code. Any existing structure and any use of land not in conformity with <br /> the regulations herein prescribed shall be regarded as nonconforming uses or structures. <br /> This Code does not abrogate any easement, covenant or any other private agreement where such <br /> is legally enforceable, provided that where the regulations of this Code are more restrictive (or <br /> impose higher standards or requirements) than such easements, covenants or other private <br /> agreements,the requirements of this Code shall govern. <br /> 1305.03 Interpretation. In interpreting and applying the provisions of this Code, they shall be <br /> held to be the minimum requirements for the promotion of the public health, safety, convenience <br /> and general welfare. Where the provisions of this Code impose greater restrictions than those of <br /> any statute, other ordinance or regulation, the provisions of this Code shall be controlling. <br /> Where the provisions of any statute, other ordinance or regulation impose greater restrictions <br /> than this Code,the provisions of such statute, other ordinance or regulation shall be controlling. <br /> Section 1 305-Rules, Scope,interpretation&Definitions <br /> Adopted:November 13,2006 <br /> Page i of 30 <br />
