As of 01/07/08 <br /> 2. Failure to collect properly notified missed collections - $250 per incident_ <br /> 3. Failure to provide monthly and annual reports - $100 per incident. <br /> 4. Failure to complete the collections within the specified tirnefrarnes without proper <br /> notice to the city- $100 per incident. <br /> 5. Failure to dean up from spills during collection operations - $250 per incident plus <br /> any costs incurred by the City. <br /> 0. Failure to report on changes in location of recyclables processing operations - <br /> $250 per incident. <br /> 7. Failure to provide written description of the means to estimate relative amount of <br /> process residuals derived from the City's recyclables - $100 per incident. <br /> 8. Exceeding any maximum process residuals rate that may be negotiated as part of <br /> a final contract agreement - $1,000 per exceedence. - <br /> 9. Failure to receive City written approval of changes to the "dual stream" collection <br /> and processing systems prior to implementing any such change - $5,000. <br /> 10.Failure to conduct annual composition analysis - $100 per incident. <br /> These amounts will be for liquidated damages for losses suffered by the City and not <br /> penalties_ <br /> 31, Damage to Property <br /> The Contractor shall take all necessary precautions to protect public and private property. <br /> Except for reasonable gear and tear, the Contractor shall repair or replace any private or <br /> public property, including, but not limited to sod, mailboxes, or recycling bins, which are <br /> damaged by the Contractor. Such property damage shall be addressed for repair or <br /> replacement, at no charge to the property owner, within forty-eight (48) hours with property of <br /> the same or equivalent value at the time of the damage. <br /> If the Contractor fails to address the repair or replacement damaged property within forty- <br /> eight(48) hours, the City may, but shall not be obligated to, repair or replace such damaged <br /> property, and the Contractor shall fully reimburse the City for any of its reasonably incurred <br /> expenses. The Contractor shall reimburse the City for any such expenses within ten (10) <br /> days of receipt of the City"s invoice. <br /> 32. Recycling Collection <br /> The Contractor shall conform to the following provisions when collecting recyclables in the <br /> City: <br /> 1. The Contractor shall structure routes so that lighter-loaded trucks travel on the <br /> streets with poorer construction. The City shall provide road condition information <br /> to the Contractor_ <br /> 14 <br />
