DATE: November 15, 2010 <br />FROM: Meagan Beekman, City Planner <br />'r �r <br />EN HILLS <br />MEMORANDUM <br />TO: Honorable Mayor City Councilmembers <br />Patrick Klaers, City Administrator <br />SUBJECT: Planning Case #10 -009 <br />Applicant: TAT Propterties <br />Property Address: 1201 County Road E <br />Request: Master and Final Planned Unit Development (PUD) and Zoning Code <br />Amendment <br />Requested Action <br />Approve Ordinance 2010 -012 amending the Zoning Code to allow Institutional Housing as a <br />permitted use within the B -2 District with an approved Planned Unit Development based on the <br />Findings of Fact in the November 15, 2010, memo to the City Council. <br />Approve Planning Case 10 -009, and the Development Agreement, for a Master and Final PUD to <br />allow Arden Hall to continue as a permanent use based on the Findings of Fact, the submitted <br />plans, and the conditions in the November 15, 2010, memo to the City Council. <br />Background <br />At the September 8, 2010, meeting the Planning Commission reviewed an application from TAT <br />Properties and Northwestern College for a Zoning Code amendment and Master and Final PUD <br />to convert the existing student housing facility at 1201 County Road E from an interim use to a <br />permanent use. The application also included a request for a preliminary and final plat to <br />subdivide the seven acre property into two parcels. The Planning Commission voted to table the <br />request for a Zoning Code amendment and Master and Final PUD, and recommended denial of <br />the applicants request for the preliminary and final plat.
