marked by Judicial Landmarks. <br />(Torrens property, Certificate of Title No. 533995) <br />WHEREAS, the Developer submitted a completed application "Completed Application <br />which included a request that the City Council approve a rezoning of the Property from R -2 <br />(single and two family residential district) to R -4 (multiple dwelling district); <br />WHEREAS, the Completed Application was reviewed by the Planning Commission at a <br />public hearing conducted on October 6, 2010; <br />WHEREAS, the Planning Commission continued its review of the Completed <br />Application request to November 3, 2010; <br />WHEREAS, on November 3, 2010, the Planning Commission recommended findings of <br />fact and recommended approval of the Developer's rezoning request; <br />WHEREAS, on November 29, 2010, the Arden Hills City Council reviewed the <br />Completed Application; the comments and reports of the City Staff and its consultants; the <br />comments and reports of the Developer and its consultants; and public comments; and <br />WHEREAS, at the conclusion of the Council meeting on November 29, 2010, the Arden <br />Hills City Council made the following specific findings in regard to the Developer's rezoning <br />request: <br />1. The Property is currently zoned R -2. <br />2. Independent, assisted, and skilled nursing care is currently provided on site, as <br />approved by the City. <br />3. Independent senior housing, once defined as institutional housing, is now better <br />defined as a multiple family use, which is not permitted in the R -2 District. <br />4. The application is proposing to rezone the Property to R -4 Multiple Dwelling <br />District. <br />5. The proposed redevelopment, and mix of uses, is a permitted use in the R -4 <br />District with the approval of an amendment to the Conditional Use Permit and a <br />Planned Unit Development. <br />6. Rezoning the Property to R -4 would bring it into conformance with the proposed <br />zoning for the Property on the City's Comprehensive Plan. <br />7. The R -2 and R-4 Districts are substantially similar in terms of development <br />standards. <br />8. The rezoning will not negatively impact the surrounding neighborhoods or the <br />community as a whole and is in keeping with the intent of the Zoning Code, <br />because the use, previously approved by the City, has existed on the Property for <br />several decades with no negative effects. <br />9. The proposed rezoning is not in conflict with the Comprehensive Plan or the <br />future land use designation of the Property. <br />2 <br />
