Each subdivision shall comply with the Response Action Plan (RAP) and <br />remediation requirements in Section 1320.135 Subd. 10, Environmental <br />Review and Remediation Component. Each subdivision shall require a <br />financial surety to ensure that the environmental remediation is completed in <br />conformance with the approved (RAP) or other environmental remediation <br />requirements as determined by the City and the Minnesota Pollution Control <br />Agency (MPCA). <br />Subd. 16. Planned Unit Development (PUD) Final Plan. <br />A. Purpose. The purpose of the PUD Final Plan is to implement and ensure <br />conformity with the PUD Master PIan. Each stage of the PUD Master Plan <br />shall require a PUD Final Plan before development. <br />B. Procedures. The applicant for a PUD Final Plan approval of a specific <br />stage of the PUD Master Plan shall complete and submit to the zoning <br />administrator an application on form provided by the administrator, including <br />all application fees and escrows.:ther applications such as preliminary plat, <br />final plat, and conditional use rrr t:::may also be required. The applicant <br />shall provide the following: <br />1. A written statement describing the proposed development in the PUD <br />Final Plan appl <br />2. The proposed starng and completion dates for the construction and <br />any requiredvronrrtal remediation. <br />3. The applicant shall submit documentation demonstratin g that the PUD <br />Final P1h is :.:inf=onformance with the PUD Master Plan and each of the <br />core onents r ection 1325.135 Subdivisions 5 through 15. <br />C. Land Use application Complete. The PUD Final Plan application shall be <br />considered complete once all required application and documentation required <br />in Subdivisions 5 through 15 are submitted and deemed complete by the City. <br />D. Development Agreement and Bonding. <br />1. A development agreement and corporate surety are required at the time <br />of PUD Final Plan approval by the City Council to assure that all <br />improvements to be constructed as part of the approved PUD Final Plan <br />and any required environmental remediation are completed in accordance <br />with the terms and conditions of such plan. or each stage thereof as <br />outlined in the construction staging component. The bond shall guarantee <br />in a penal sum equal to one hundred twenty -five (125) percent of the cost <br />of such improvements as estimated by the City.
