APPROVAL OF MINUTES A. November 3, 2010—Planning Commission Regular Meeting Commissioner Holewa stated Vice-Chair Roberta Thompson called the meeting to order not Chair Clayton Larson. Chair Larson stated the date for the Approval of Agenda should be changed to November 3,2010. Commissioner Holewa moved, seconded by Commissioner Zimmerman, to approve the November 3, 2010, Planning Commission Regular Meeting as amended. The motion carried unanimously(6-0). PLANNING CASES ARDEN HILLS PLANNING COMMISSION—December 8,2010 2 A. Presbyterian Homes Tax Increment Financing Resolution Community Development Director Jill Hutmacher stated the Planning Commission is being requested to determine whether the redevelopment plan for Presbyterian Homes of Arden Hills conforms to the general plans for the development and redevelopment of the City as described in the comprehensive plan for the City. On November 3, 2010, the Planning Commission approved Planning Case 10-012 and the Findings of Fact for that approval include: 1. The application is in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan; 2. The application is not anticipated to create a negative impact on the immediate area for the community as a whole because the facility has operated in the sire since 1955; the land use of the site is not proposed to change; the quality of the development and site design are anticipated to generally enhance the aesthetics of the site and surrounding area; and the impacts on Lake Johanna and water quality will be improved by increased storm water management and setbacks to the lake. 3. The Master PUD and Final PUD advance the City's goals outlined in the Comprehensive Plan by promoting the development of a variety of housing options; preserving and increasing high-quality housing opportunities that are suitable for a mix of ages, incomes and household types; encouraging the incorporation of affordable, life-cycle, and work force housing into new development and redevelopment where feasible; and promoting the protection of lakes and the natural environment. Community Development Director Hutmacher stated that although the Planning • Commission has already approved the Presbyterian Homes of Arden Hills project, TIF statutes require that the Commission approve a separate resolution finding that the redevelopment plans conform to the City's Comprehensive Plan. She outlined the TIF request and TIF District map and provided additional background information including how TIF is evaluated. Chair Larson clarified the TIF District map does not include the TCAAP property. He also asked what the term would be for this request. Community Development Director Hutmach stated this was correct and the City could amend the map at a future date or create a new district in the future for this property. She also explained that the term for this request would be 16 years but it is expected to be completed in 14 years and the District could be decertified at that time. Chair Larson opened the floor to Commission questions. There were no additional questions from the Commission. Commissioner Reiff_moved, seconded by Commissioner Thompson to recommend approval of Resolution 2010-001• Approving the Redevelopment Plans of Presbvterian Homes of Arden Hills Conforms to the City's Comprehensive Plan as . Planning Case 10-011; Zoning Code Amendment—Public Hearing City Planner Beekman stated this planning case was to amend Sections 1305 and 1320 of the Zoning Code to reconcile the recently adopted TCAAP zoning regulations with the regulations that pertain to the rest of the City. Staff is proposing to update the City's Land Use Chart, Planned Unit Development Process, and Definitions sections of the Zoning Code to align with the TCAAP regulations. She outlined the changes proposed in Section 1305.04, Section 1305.06, Section 1320.14, Section 1320.06, and Section 1320.05. Chair Larson opened the floor to Commission questions. Commissioner Holewa asked what the difference is in the Zoning for Northwestern College and Bethel University. • City Planner Beekman explained Northwestern College is zoned RI and operates under a PUD and Bethel University operates under a CUP. Bethel University is more closely bound by the City Codes. The two locations were zoned several years ago and the exact reasons for this could not be determined. Chair Larson stated in Attachment B,page I of 65, Section 1320.02, the MR and MB Districts are not mentioned. He asked if this was an oversight. City Planner Beekman explained this had been an oversight and these two Districts should be mentioned in this section. Chair Larson opened the public hearing at 6:47 p.m. There being no public input Chair Larson closed the public hearing at 6:48 p.m. Commissioner Holewa moved, seconded by Commissioner Reiff to Approve Planning Case 10-011 Amending Sections 1305.04 and 1320 of the City's Zoning Code as Presented in the December 8, 2010, Planning Case Report. The motion carried unanimously (6-0). UNFINISHED AND NEW BUSINESS • None. ARDEN HILLS PLANNING COMMISSION—December 8, 2010 4 REPORTS A. Report from the City Council Council Member Grant updated the Commission on recent City Council activity including the approval of Planning Case 10-009 and the approval of Planning Case 10- 012. He also stated the TCAAP auction is not expected to occur until April at the earliest. In January there will be a vacancy on the City Council an applications are available on the City's website or at City Hall. He also stated there are other vacancies on City Committees. B. Planning Commission Comments and Requests Chair Larson stated the joint worksession with the City Council and the Planning Commission is scheduled for February 22, 2011. He also stated the City is looking for training opportunities for the Commission members. Commissioner Holewa stated there had been an article in the Minneapolis paper concerning a resident who wanted to put a wind generator on their property. The resident had been met by opposition from the City. He suggested the Planning Commission discuss this and the issues it brought forward at a future work session. ADJOURN • Commissioner Holewa moved, seconded by Commissioner Reiff, to adiourn the December 8, 2010, Planninlz Commission Meeting at 6:58 p.m. The motion carried unanimously (6-0). • -ii DEN HILLS MEMORANDUM DATE: January 5, 2011 PC Agenda Item 3.A TO: Planning Commission FROM: Meagan Beekman, City Planner SUBJECT: Planning Case #11-001 This application requires a PUBLIC HEARING Applicant: McDonald's, USA LLC Property Location: 1313 County Road E Request: Master and Final Planned Unit Development Requested Action The applicant is requesting approval of a Master and Final Planned Unit Development (PUD) to demolish the existing McDonald's restaurant at 1313 County Road E and reconstruct a new one in its place. Background The existing McDonald's restaurant at 1313 County Road E was originally constructed in 1974 through a site plan review process. A drive -thru window addition was completed in 1983, and a second addition was completed in 1989 that included office space and a second drive -thru window. At this time, the applicants are proposing to demolish the existing building and reconstruct a new McDonald's restaurant in its place. The parking and drive -thru configuration would also be modified under the proposed plan. The property is located within the B2 General Business District. In October 2008, the City adopted the Guiding Plan for the B2 District along with design standards within the Zoning Code. The Guiding Plan outlines the vision for the B2 District and details guidelines for new development in this area. All new construction within the B2 District is now required to go through the PUD process and to conform to the City's design standards for new development. City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 1 of 9 Project Proposal and Process 1. Project Description The project would be completed in a single phase. The existing building would be razed. The proposed site plan would reorient the front entrance of the building, along with an outdoor seating area, to face County Road E. The driveway entrances would remain in their existing locations; however, the parking area would be located between the building and Connelly Avenue. The drive -thru capacity would be expanded with a double drive -thru that would wrap around the north and west sides of the building. Additional landscaping would be installed as part of the redevelopment. A detached garbage enclosure would be located in the far northwest corner of the property. Loading doors would be located on the east side of the building facing Connelly Avenue. The applicants have submitted a project narrative describing their request (Attachment A), and a plan set detailing the proposed site plan (Attachment B). 2. Planned Unit Development (PUD) Process: The PUD process is a tool that provides additional flexibility for developments that an underlying zoning district would not otherwise allow. For example, a PUD may alter the setbacks, lot coverage, density, parking requirements, building height, landscaping requirements, etc. The flexibility from the minimum requirements in the underlying district may reduce a specific requirement, or it may increase it. The intent is to provide flexibility to a project in exchange for improvements or amenities that a City could not otherwise require. With any development, the conditions imposed on the project must have a rational basis related to the impacts of the development. The PUD process is an alternative to the variance process and requires distinct findings separate from the undue hardship criteria in State Statutes. The process is meant to create a better development than the strict adherence to the standard regulations might otherwise allow. While each PUD process is unique, it is a common process used by many cities. The PUD process cannot be used to permit uses that would not otherwise be permitted in the underlying zone. 3. Zoning Regulations Section 1320 District Provisions A. Lot Size, Building Coverage, and Landscaping Meets Requirements While the amount of impervious coverage is increasing, the project would still exceed the minimum requirements for landscaped area and hard cover. B. Height Meets Requirements The maximum height for buildings in the B2 District is 50 feet. The proposed building would not exceed this height. C. Setbacks Flexibility Requested The minimum setbacks in the B2 District are 20 feet in the front and rear and 10 feet in the side yards. The proposed building would exceed these requirements. However, the design standards for the B2 District require that at least 50 percent of the primary building be built to the front setback line of 20 feet. Because the drive -thru aisle wraps around the entire building it is not possible for this requirement to be met. The existing building is setback 85 feet from the front property line. The primary building would be setback 48 feet from the County Road E property line. The proposed plan would move the building closer to County Road E, which is a stated goal of the Guiding Plan. D. Section 1325 General Regulations A. Landscaping and Tree Preservation Section 1325.05 Subd. 1 and 1325.055 Landscaping and Tree Preservation Plans were submitted by the applicants and are included in Attachment B. Caliper Inches Required Exceeds Requirements Based on the square footage of the proposed buildings the City Code requires 14 caliper inches of trees to be planted; however, existing and preserved trees on the site are permitted to count towards this requirement. 146 caliper inches of significant trees are proposed to remain on site. Because more than 14 caliper inches of trees are being preserved, this requirement has been met. Tree Size and Selection Meets Requirements The tree sizes and selection of species meets the requirements of the Code. Trees along Street Frontage Flexibility Requested City Code requires that a minimum of one tree be planted along the right of way for every 40 feet of street frontage. The property has 195 feet of frontage, which would require five trees to be planted. Two trees already exist along the County Road E frontage. Due to the grade changes in this area and the City's anticipated bridge and sidewalk construction, staff would recommend that this requirement be waived and that the trees be planted elsewhere on the site. Perennials and Shrubberies Exceeds Requirements City Code requires that at least ten percent of the total landscaped area shall be covered with perennials and /or shrubbery. Code requires 1,325 square feet of perennials and shrubbery. The applicant is proposing 3,500 square feet, an excess of 2,175 square feet. Planting Islands Flexibility Requested City Code requires that at least ten percent of the parking area be occupied by planting islands that are at least 150 square feet in size and have at least one tree. The Code requires 1,604 square feet of parking lot islands. The proposed application shows 1,437 square feet, a deficit of 167 square feet. Tree Preservation Flexibility Requested 124 caliper inches of the 270 existing caliper inches of significant trees are proposed to be removed. This requires the replacement of 49 caliper inches of trees. The proposed plan indicates that 39 caliper inches of trees will be replaced. This equates to a deficit of ten caliper inches of trees. Given the small amount of additional trees that would be needed to City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 4 of 9 meet the City's requirement, Staff is recommending that an additional ten caliper inches of trees be planted as part of a condition of approval of this application. B. Lighting Section 1325.05 Subd. 3 Meets Requirements A photometric plan has been submitted and indicates that the proposed lighting meets the requirements of the Zoning Code. The type of lighting to be used has not been submitted; however, it will be required to meet the requirements of the Code in order for building permits to be issued. C. Screening Section 1325.05 Subd. 4 Meets Requirements All parking, loading, garbage containers, and mechanical operating equipment are required to be screened from view of adjacent public rights of way. Based on a review of the site plan and landscaping plan it appears that this requirement will be met. Staff would recommend that the City reserve the right to require additional screening materials in the event that this requirement is not fulfilled by the proposed plan. D. Parking Section 1325.06 Meets Requirements The City Code requires one parking stall for every two seats. The proposed restaurant would have 85 seats, equating to 43 required parking stalls. The proposed plan indicates 44 parking stalls. 2. Design Standards Section 1325.05 Subd. 8 While the proposed application is in substantial conformance with the intent and letter of the design standards, the items that the applicant is requesting flexibility are listed below: Building Design Flexibility Requested At least fifty percent (50 of the largest building on each site is required to be constructed at the front setback line. As discussed previously, the building would be setback approximately 48 feet from the front property line, when 20 feet is required. The location of the drive -thru aisle and the steep shift in grade towards County Road E prevents the building from being located any farther to the south. Commercial Facade Transparency Flexibility Requested At least 50 percent of the front elevation that includes the front entrance or faces a public street shall be comprised of transparent glass. The proposed plan indicates that the south facade would have 48 percent transparent glass, while the east facade would have 18 percent. The Code does allow for a reduction in transparent glass when the function of the building City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 5 of 9 does not readily allow for windows. In this case, the rear of the building is used for bathrooms, kitchen, and storage areas, which are not conducive to transparent glass. Parking Flexibility Requested The Code requires that no more than 50 percent of the onsite parking be located in side yards, and that parking between the street and the building be discouraged. The proposed site plan shows nearly all of the parking located between the building and Connelly Avenue. This is due to the configuration of the site and the need for a continuous drive aisle around the perimeter of the building. Additional landscaping has been provided in an attempt to screen the visibility of the parking lot from the street. 3. Sidewalk The Code requires a six -foot concrete sidewalk to be built along both the County Road E and Connelly Avenue rights of way. The Code also allows the City to require cash in lieu of constructing the sidewalks to satisfy this obligation. The City is currently working on a plan to reconstruct the County Road E Bridge to include a pedestrian connection over Highway 51. In addition, the grade challenges in the County Road E right of way adjacent to the McDonald's property create a financial hardship for the property owner if a sidewalk was to be required by the City, due to the need for significant grading and retaining walls. Due to the impending bridge reconstruction and the significant grade challenges that exist along County Road E in this area, Staff is recommending that the City assess at a future date the cost of constructing a six -foot concrete sidewalk along Connelly Avenue and County Road E. Constructing this segment of sidewalk in tandem with the bridge reconstruction will allow the City to engineer a solution that is more efficient than building a sidewalk before it is known how the new bridge will align with the existing road. Details regarding the assessment will be worked out by Staff and the City Attorney prior to the Council's review of this application. 4. Sign Code No signage is being proposed as part of this application. It is anticipated that the freestanding sign will remain as is. All signage on site will need to meet the minimum requirements of the Sign Code. 5. Additional Review The Building Official, Fire Marshall, and City Engineer reviewed this application and submitted comments. All final plans will be subject to the review and approval of the Fire Marshall and City Engineer. Staff did not have any significant concerns regarding this application. City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 6 of 9 Findings of Fact: Staff offers the following eleven findings of fact for this proposal: 1. The applicant is requesting approval of a Master and Final PUD for the redevelopment of the McDonald's restaurant at 1313 County Road E. 2. The PUD process allows for flexibility within the City's regulations through a negotiated process with a developer. 3. The subject property is located in the B2 General Business District. 4. The proposed redevelopment is a permitted use in the B2 District. 5. The City has adopted the Guiding Plan for the B2 District that outlines future development principals for the area. 6. The City has adopted design standards for the B2 district within the Zoning Code. 7. The Master PUD and Final PUD are in substantial conformance with the requirements of the City's Zoning Code and design standards. 8. The Master PUD and Final PUD are in substantial conformance with the Guiding Plan for the B2 District. 9. The Master PUD and Final PUD are in substantial conformance with the City's Comprehensive Plan. 10. Where the plan is not in conformance with the City's Zoning Code, flexibility has been requested by the applicant and /or conditions have been placed on an approval that would mitigate the nonconformity. 11. The application is not anticipated to create a negative impact on the immediate area or the community as a whole. Recommendation After a careful review of the proposal, staff is recommending approval based on the findings of fact subject to the following twelve conditions: 1. The project shall be completed in accordance with the submitted plans as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. Final plans shall be subject to approval by the Fire Marshall prior to the issuance of any building permits. 3. Final grading, drainage, and utility plans shall be subject to approval by the Public Works Director prior to the issuance of any building permits. 4. The proposed project may require permits, including, but not limited to, MPCA- NPDES, Rice Creek Watershed District, Minnesota Department of Health, Ramsey County and City Right of Way, and City Erosion and Sediment Control permits. Copies of all issued permits shall be provided to the City prior to the issuance of any building permits. City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 7 of 9 5. A development agreement shall be prepared by the City Attorney and subject to City Council approval. The agreement shall be executed prior to the issuance of any permits or site preparation. 6. The applicant shall submit a financial surety for 125 percent of the cost of the landscaping improvements prior to the issuance of any building permits. 7. The applicant shall obtain a building permit within one year of the PUD approval or the approval shall expire unless extended by the City Council prior to the approval's expiration date. Extension requests must be submitted in writing to the City at least 45 days prior to the expiration date. 8. The applicant shall provide for an additional ten caliper inches of trees on site. 9. Parking, loading, garbage containers, and mechanical operating equipment shall be screened in accordance with the City Code, additional screening materials may be required in the event that this requirement is not met by the proposed plans. 10. The property owner shall by responsible for 100 percent of the cost of constructing six -foot concrete sidewalks, assuming a flat grade, for the length of the property along County Road E and Connelly Avenue. The property owner shall waive any future right to appeal any such assessments for this purpose. 11. All sidewalks constructed in City right of way shall be a minimum of six feet in width. 12. The project shall conform to all other City regulations. Proposed Motion Language 1. Deadline for Agency Actions The City of Arden Hills received the completed application for this request on December 3, 2010. Pursuant to Minnesota State Statute, the City must act on this request by January 31, 2011 City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 8 of 9 (60 days), unless the City provides the petitioner with written reasons for an additional 60 -day review period. With the consent of the applicant, the City may extend the review period beyond the initial 120 days. Resident Comments Notice was published in the Shoreview -Arden Hills Bulletin and mailed to properties within 500 feet of the property. APPLICATION FOR MASTER PLANNED UNIT DEVELOPMENT AND FINAL PLANNED UNIT DEVELOPMENT December 1, 2010 t LANDFORM Fro m Site to Finish Arden Hills, MN TM INTRODUCTION On behalf of McDonald's USA LLC "McDonald's Landform is pleased to submit this application for Master Planned Unit Development and Final Planned Unit Development approval to allow demolition and reconstruction of McDonald's restaurant at 1313 West County Road E. The 1.15 -acre site is owned by McDonald's USA LLC (1650 West 82 Street #900, Bloomington, MN 55431- 9888). MASTER PLANNED UNIT DEVELOPMENT Restaurants are a conditional use in the B -2 zoning according to the Land Use Chart in Section 1325, but will be processed as a PUD as outlined in 1320.085 and 1320.14 of the City Code. We have prepared a plan that complies with the purpose and intent of the ordinance standards for redevelopment of the McDonald's restaurant with drive through on this site. The new site plan will allow the drive though lane to be separated from the parking area, which will improve access within the site by minimizing conflicts. The new double drive- through will also reduce wait times in the drive through. The project complies with all drive through restaurant regulations specified in Section 1320.085, Subd. 3 and 1325.04 of the Ordinance, except that modifications from the following requirements are requested through the PUD process: 1. At least 50% of the largest building on each site shall be constructed at the front setback line. The nature of the restaurant and the parking requirements for the use require this flexibility, which will allow the building to be pushed to the rear of the site. This allows the drive though lanes to be screened from Connelly Avenue by the building and allows the drive through lanes to be separated from the parking and the main building entrance, which results in a safer, better functioning site. 2. No more than 50% of the parking on a site may be between buildings or in the side yards. As noted above, all 44 parking stalls are located in the front of the building (between the building and Connelly Avenue) in order to reduce potential conflicts with the drive through traffic. 3. Building Architecture. The proposed building is a mix of brick, EFIS and glass with metal accents. This variety of materials provides an enduring, timeless and well detailed building as specified in the ordinance; however, we are requesting flexibility from the requirement that not more than 25% of the building be EFIS. The building is aesthetically pleasing, complies with the purpose and intent of the ordinance and will be compatible with other uses in the neighborhood. The new directional signs, menu boards and building signage will comply with ordinance requirements. New wall signage is proposed on the north, south and west building elevations as shown. The restaurant hours of operation would be consistent with the existing hours of operation for this restaurant. Storm water management is provided by an underground treatment system located in the northeast corner of the site. An exterior trash enclosure will be provided in the northwest corner of the site, generally in the same location as the existing enclosure. New landscaping is provided around the perimeter of site and three existing trees will remain along Connelly Avenue. A mix of coniferous trees, deciduous trees, shrubs and grasses are provided. Outside seating is planned on the patio on the north side of the building as shown on the plans. FINAL PLANNED UNIT DEVELOPMENT We are also requesting approval of a final planned unit development as outlined in Section 1320.14 of the Zoning Code. SUMMARY We respectfully request approval of the Master Planned Unit Development and Final Planned Unit Development to allow demolition of the existing McDonald's restaurant at 1313 County Road E and construction of a new McDonald's restaurant on the site. The applicant is proposing to increase the height of the freestanding pylon sign located at 3 920 Northwoods Drive from 16 feet to 35 feet. The sign face itself would remain unaffected. The property is located in the B -3 Service Business District directly south of the 694 westbound off ramp to Lexington Avenue. The property is to the west of the Super 8 Motel and Perkins properties, and to the east of the I -Flex District. 3 920 Northwoods Drive is an office building that has been vacant for a number of years. Presently the property has a freestanding pylon sign located adjacent to I -694. The existing sign is 16 feet in height with a sign face that is 102 square feet in size. The property owner has been actively marketing the property and believes that improving the visibility of the signage from I -694 would assist in getting the property leased or sold. Other signs along I- 694 in this area are 35 feet in height, and are more visible than the existing 16 -foot tall sign. In Arden Hills, all commercial properties that do not have frontage on County Road E, Lexington Avenue, or Highway 96 are located within Sign District 7. The Sign Code limits Page 1 of 5 properties within Sign District 7 to 25 square feet of freestanding signage and a maximum height of eight feet. Most businesses within the I -Flex and B -3 Districts exceed this requirement. 2. Site Plan Review Section 1260: Sign Standard Adjustments Section 1260.01 of the Sign Code permits adjustments to sign height, number, type, lighting, area, and /or location through the site plan review process if criteria number one or two is met and the required criteria number three is met. In this case criteria one and three are most applicable. The criteria are as follows: 1. There are site conditions which require a sign adjustment to allow the sign to be reasonably visible from a street immediately adjacent to the site; or, 2. The sign adjustment will allow a sign of exceptional design or a style that will enhance the area or that is more consistent with the architecture and design of the site; and, 3. The sign adjustment will not result in a sign that is inconsistent with the purpose of the zoning district in which the property is located or the current land use. The applicant submitted a letter responding to the above criteria (Attachment A). 2. To accommodate an adequate supply of businesses and services that serve the community and motorists traveling through the community with a broad range of services and goods. B. To provide locations for uses that may be incompatible with retail centers, thereby keeping the retail centers compact and convenient. C. To keep services in close proximity to arterial streets or highways in areas that are appropriately designated on the Comprehensive Plan. D. To encourage grouping of compatible and mutually supportive business uses and services. E. To promote business prosperity. F. To establish a high standard of development and design that produces a positive visual image and minimizes the effects of traffic congestion, noise, odor and glare. G. To allow a transitional reuse of existing buildings until market conditions warrant redevelopment. H. To enhance redevelopment potential by prohibiting uses that would impede redevelopment. I. To ensure acceptable traffic operations on local streets. J. To promote flexibility in land uses and site development standards to achieve the purposes of the district. The Planning Commission must make a finding as to whether or not the proposed sign standard adjustment at 3920 Northwoods Drive meets the criteria in the Sign Code to deviate from the sign regulations and if the increased height of the signage would adversely affect the surrounding neighborhood and the community as a whole. Staff offers the following nine findings for consideration: 1. The property is located in the B -3 Zoning District and Sign District 7. 2. In Sign District 7, freestanding signs are permitted up to 25 square feet and eight feet in height 3. The property is a conforming use in the B -3 Zoning District. 4. The existing freestanding sign is 16 feet in height and 102 square feet in size, and exceeds the maximum size standards in Sign District 7. 5. The existing freestanding sign is adjacent to highway 694. 6. The proposed sign would be 35 feet in height and 102 square feet in size. 7. Adjacent businesses have freestanding signs that are 35 feet in height along highway 694. 8. The sign would not be visible from residential properties. 9. Section 1260 of the Sign Code permits deviations from the Sign Code through the site plan review process. 10. The location of the office building and the placement of the existing sign limit the visibility of the sign from I -694 eastbound. The sign would not have a negative impact on adjacent properties or the City as a whole. Resident Comments Staff has not received any letters, e- mails, or telephone calls from property owners or occupants concerning this planning case; however, site plan reviews do not require a public hearing or public notice. Staff Recommendation The existing sign currently exceeds the size requirements for signage in this sign district. However, given that the vast majority of businesses in this area have signage that exceeds the requirements of the Code, it may be appropriate for the City to review these requirements. Additionally, the adjacent roadway from which the sign would be visible is a freeway corridor, which tends to demand larger commercial signage given the higher speed of traffic and greater distance between the vehicles and the businesses. Furthermore, several businesses along this highway corridor have freestanding signage that is at a height of 35 feet. Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case 11 -002 for a Site Plan Review for a sign standard adjustment based on the findings of fact, the submitted application, and the January 5, 2011, planning case report. The current sign height allows for little visibility from Northwoods Drive or from 1-694. The property is located directly adjacent the East bound exit ramp of I-694; as a consequence of the location of the exit ramp the current pylon sign height has limited visibility. Additionally the current sign height is too low to be visible from the West bound traffic. Section 1260 Sign Standard Adjustments Subd. 2 allows for a sign adjustment to enhance the area and design of the site. The current sign is 20 years old; a modern new sign of increased height would be consistent with Super 8 and Perkins signs as well as provide a modern design and thereby enhance the area as a whole. Background Mounds View High School currently operates under a Conditional Use Permit (CUP) that was approved in 1978. Any modification to the original CUP requires a CUP amendment. The original CUP has been amended from time to time as the school and campus have expanded over the years. At present, the School District is requesting an amendment to the existing CUP to allow for the construction of a 1,787 square foot accessory structure, which would be used for ticket sales during sporting events at the football field, and for storage of athletic equipment. The structure would be located near the existing football field. Mounds View High School is located in the R -1 zoning district, which permits schools as a conditional use; however, any additions to the campus, or amendments to the original CUP, must still meet the requirements of the underlying zoning. The existing Zoning Code limits accessory structures within residentially zoned districts to 728 square feet with administrative review, or up to 1,458 square feet through a site plan review. Proposed Zoning Code Amendment The applicant is proposing amendments to Section 1325.01 of the Zoning Code, which deals with accessory structures. Currently, in R -1, R -2, and R -3 Districts accessory structures are limited to 728 square feet in size with administrative approval. There are no size limits to accessory structures in any other zoning districts. Through a site plan review, the City can approve deviations from the Code for accessory structures in exceptional and unusual circumstances. However, regardless of the circumstances accessory structures in residential districts are limited to 1,458 square feet in size (twice the size of a 728 square foot structure) without an approved variance. The proposed amendments would allow non residential uses in the R -1, R -2, or R -3 Districts to have accessory structures up to 2,184 square feet in size (three times the size of a 728 square foot structure). Because all non residential uses within these Districts are conditional uses, any proposed accessory structure would require Planning Commission and City Council approval regardless of its size. The proposed amendment goes further to require an accessory structure exceeding 2,184 square feet to receive a variance in order to be constructed. When reviewing a Zoning Code amendment or addition, it is important to consider how the change would affect the entire zone instead of one specific property. If approved as City of Arden Hills Planning Commission Meeting for January 5, 2011 Page 3 of 7 proposed, all non residential uses within the R -1, R -2, or R -3 Districts would be allowed to have accessory structures up to 2,184 square feet. This would include school uses and houses of worship. These uses are on larger parcels of property with larger primary buildings than what is typically found on single- family residential lots. Allowing larger accessory structures may make sense on these types of properties. 2. General Zoning Regulations A. Lot Coverage Meets Requirements The proposed ticket sales and storage building would be located on existing impervious surface and would not increase the amount of hard cover on the site from what exists today. B. Setbacks Meets Requirements The minimum setback for accessory structures in the R -1 District is ten feet from any side or rear lot line. The proposed structure would be setback approximately 270 feet from the nearest lot line exceeding all setback requirements. C. Height Meets Requirements The maximum height for accessory structures in the R -1 District is fifteen feet. The proposed structure would be fourteen feet, four inches in height. D. Landscaping Meets Requirements The applicant is not proposing to remove any vegetation on the site. E. Size Meets Requirements with Approval of Zoning Code Amendment The proposed Zoning Code amendment would allow accessory structures up to 2,184 square feet in size on non residential uses within the R -1 District. The proposed structure would be 1,787 square feet in size. If the amendment to the Zoning Code is approved the proposed structure meets the requirements of the Code. If the amendment is not approved the proposed structure exceeds the requirements of the Code. 3. Conditional Use Permit Amendment Criteria Section 1355.04 Subd 3 Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a Conditional Use Permit Amendments. When evaluating conditional use permits, the Planning Commission and City Council should consider the effect of the proposed use upon the health, safety, convenience, and general welfare of the owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: 1. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics; 3. Drainage; 4. Population density; 5. Visual and land use compatibility with uses and structures on surrounding land; adjoining land values; 6. Park dedications where applicable; and the 7. Orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City. 4. Additional Review The City Attorney has reviewed the submitted Zoning Code amendment language and does not have any concern over the proposed modifications. Staff offers the following sixteen findings of fact for the Planning Commission's consideration: General Findings: 1. The applicant is proposing to construct a 1,787 square foot accessory ticket sales and storage building. 2. Mounds View High School operates under a Conditional Use Permit in the R -1 Zoning District. 3. A Zoning Code amendment is required to allow an accessory structure in excess of 1,458 square feet in the R -1 District. 4. A CUP amendment is required to allow the proposed structure on the subject property. 5. Accessory structures are permitted under the original Conditional Use Permit agreement. 6. The proposed application will not exceed the lot coverage limits for the property. 7. The proposed application meets all setback requirements. 8. The applicant is not proposing to remove any vegetation from the site. 9. The proposed structure would meet the size requirements of the Code if the applicant's request for an amendment to the Zoning Code were approved. 10. The proposed structure meets all other requirements of the Zoning Code. On the Conditional Use Permit Amendment: 11. The proposed project is not expected to have any impact on traffic or parking conditions since no change in the school population or the schedule of games is expected as a result of this application. 12. The proposed project will not produce any permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid, or solid waste. The proposed project is not expected to have any impacts on school population or density. 15. A park dedication fee is not applicable to this application. 16. The proposed project does not conflict with the City's Comprehensive Plan or the intent of the Zoning Code. Recommendation Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case 11 -003 for a Zoning Code amendment and Conditional Use Permit amendment to construct a ticket sales and storage building adjacent to the football field at Mounds View High School. The recommendation for approval is subject to the following four conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and reviews 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 3. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the planned start of construction. 4. The applicant shall obtain all necessary permits from the Rice Creek Watershed District, MPCA, and other governmental entities and provide the City with copies of such permits prior to the City issuing any building permits. Chapter 13, Section 1325.01, Subdivision 7 of the Arden Hills Zoning Code states the following: Subd. 7 Accessory Structures in Exceptional and Unusual Circumstances in all Zoning Districts. Deviations from these requirements may be permitted after Planning Commission review and City Council approval of a site plan in accordance with Section 1355.04 Subd 5 and with documentation showing the unusual circumstances justifying the proposed deviation and plans for the proposed accessory structure. Under no circumstances shall the total floor area of an accessory structure in the R -1, R -2, and R -3 district exceed one thousand four hundred and fifty- eight (1,458) square feet without an approved variance that meets the requirements of Section 1355.04 Subd 4. Currently Mounds View High School, a 'School, General Education' use, is located within the R -1 Single Family Residential Zoning District through the issuance of a Conditional Use Permit (approved Planning Case 84 -001). It appears that the intent of Chapter 13, Section 1325.01, Subdivision 7 is to limit the size of an accessory structure on residential Tots that are used for residential uses. The Independent School District 621 is proposing to construct a Storage Ticket Sales Building on the Mounds View High School site located at 1900 Lake Valentine Road. The proposed building is approximately 1,787 square feet. A portion of the building will be used for ticket sales to sporting events, while the remainder of the building will be used for storage of maintenance and athletic equipment. While this site is located in a residential zoning district, it is not used in the same manner as a residential use and seems that it should not be held to the same size limitations as a single family residential use. Therefore, the School District is requesting an amendment to Chapter 13, Section 1325.01 to allow accessory structure for non- residential uses within residential zoning district to exceed the current dimensional limitation (1,458 SF) without the issuance of a variance. The underlined text shows the proposed additions. Please modify as you see fit. 1325.01 Accessory Structures Subd. 1 Time of Construction. No accessory structure shall be constructed on any lot prior to the time of construction of the principal structure to which it is accessory. Subd. 2 Height A. R -1, R -2, and R -3 Districts. Accessory structures in the R -1, R -2, and R -3 Districts shall not exceed fifteen feet in height or the height of the principal structure to which it is accessory, whichever is lower. B. All Other Districts, Accessory structures in all other Zoning Districts shall not exceed the height of the principal structure to which it is accessory. Subd. 3 Location. Accessory structures in the R -1, R -2, or R -3 District shall not be located nearer the front lot line than the front yard setback line for the principal structure to which it is accessory. Accessory structures as permitted and regulated in this Code may be located within the rear yard of the principal structure in the R -1 and R -2 Districts. Subd. 4 Size A. R -1, R -2, and R -3 Districts. 1. Accessory structures associated with residential uses shall not exceed seven hundred and twenty -eight (728) square feet in floor area. Accessory structures associated with non residential uses shall not exceed two thousand one hundred eighty -four (2,184) square feet in floor area; and, 2. The total floor area of accessory structures located in the rear of a principal structure, the total floor area of all such accessory structures shall not exceed twenty -five (25) percent of the minimum required rear yard area for the principal structure; and 3. No more than two (2) accessory structures shall be permitted on a lot. B. All Districts. Accessory structures in all zoning districts shall not cause the property to exceed any of the regulations of the underlying Zoning District in Section 1320. Subd. 5 Permanent Accessory Structures. A. Site Plan Review. Permanent accessory structures in any district except residential uses in the R -1, R -2, and R -3 Zoning Districts, and on through lots in the R -1, R -2, and R -3 Zoning Districts, shall be subject to Site Plan Review and Council approval. B. Exterior Finish. The exterior finish of accessory structures shall be compatible in appearance and material used with the principal structure served by the accessory structure except as provided for in Chapter 1325.01 Subd 5.0 of this code. The temporary structures shall not be permanently attached to the ground; 2. The temporary structure shall not be attached to other permanent structures; 3. The proposed Storage Ticket Sales Building was not included on the Master Plan approved in Planning Case 84 -001, and therefore a CUP amendment is required to include the proposed Storage Ticket Sales Building. WHISTLEBL©WER JAMES ELI SNIFFER On the shore of Lake Minnetonka, Jay Nygard wants to harness the wind to power his hot tub an d crank up his alternative energy business. Yet Nygard's plan to put a small wind turbine in his back yard ran into trouble before the blades began to spun. The city of Orono has ordered Nygard to stop work on his wind turbine, saying the city's zoning doesn't allow wind generators, and threatened him with criminal prosecution if he ignores the order. Nygard admits he poured a concrete pad for the turbine after the city rejected his applica tion fora building permit. But he and his attor- ney claim the city is overstepping its authority and discouraging a homeowner and entrepre- neur from helping the environment. "Here I'm trying to go green and they're try- ing to throw me in jail," Nygard. said. Nygard's clash with Orono is the latest ex- ample of wind energy entrepreneurs "per ding local governments to decide what place, if any, wind turbines have within their borders. Cities and towns typically don't confront the question until something like this happens, said Brian Ross of CR Planning, a consultant who helps local governments write wind ener- gy ordinances. Orono Mayor James White said Nygard should put his energy into petitioning the city for a wind energy policy, not getting into a standoff with inspectors. He got the permit application back on Oct. 15, with "Denied" stamped in red ink. The explanation: City ordinances lay out al- low-able "accessory uses" in his Lakeshore dis- trict zoning, and a wind generator isn't one of them. That seemed arbitrary to Nygard and his at- torney, Milton Nordmeyer. `You can't just dis- allow everything," Nordmeyer said. In fact, city zoning ordinances typically pro hibit everything that is not explicitly allowed, said Ross, the planning consultant. Ross said he's aware of some Minnesota municipalities allowing home turbines on an individual basis, but he said local governments are hampered by the lack of a turbine track record While of- ficials may want to encourage energy self-suffi- ciency, they have to weigh that against how the units look, what they sound like and whether they actually work, Ross said. The potential of opening the floodgates to all sorts of structures is what concerns white, the Orono mayor. "It doesn't take the brains God gave a goat to find out these things come in all shapes and sizes," he said. white said he recently suggested to the City Council that it should plan for wind turbines. Nygard could petition the council to amend the ordinance, al- though it's not cheap $700 to file a petition., plus reimbursing city staffers for the cost of re- searching the subject. Nygard took another tack. Having served on the City Council from 2000 to 2003, and then quitting mid-term after a dispute over his rocky interactions with city staff, Nygard isn't afraid to tussle with the city.
