Arden Hflls Tobacca did not pass this corzxpliance check because one of their employees sold tobacco prod�cts ta a minox. Subsequent io that incident, the Ramsey Cour�ty Sheriff's De}�at�rnent received a cazx�plaint that another violation had occurred. (Copy attach�d.) Accoxding to o�r City Code, 350.12 Admini�traiive Fines, Suspension, or Revacation, priar to the irnposition of a fine for a tobacco sales violation, a hearing musti be held before the City Council unless the license holder elec�s to waive his rzgk�t to a public hearing. The owner of Arden Hills Tobacco was notx£'ied oi the f ne and hearing via certified mail on December 6, 2010 az�d asked to respond by December 9, 2010. To date, we have received no respo�se. Our City Attorney, rerry Filla, was consulted and his recommendation is attached. Arden Hills Tobacca passed the December 6, 2010, compliance re-check canducted by the Ratnsey County 5heriff. A copy of that notification is also attached. Also attached is a copy of the City's tobacco ordinance for refierence. Requested Action No action required. This is an administrative hearir�g being held iz� compliance with City Code. Per City Cade and the City Attorney's recom�nendation, tl�e fine will be imposed. The City recognizes that rnany persans under the age af eighteen {18} years of age purchase or otherwise obtain, possesses and use tobacco, tobacco products, ar�d tobacco related devices, and that such sales, possession a�d use are in violation of both state and federal laws. Studies, which are hereby accepted and adopted, have shown that most smokers begin srnaking before �hey have reached the age of eighteen (18) years of age, and that people who reach the age of eighteen (1$) years without having started smo�ing are significantly less likely to begin smoking. Smoking is believed to be associated with several serious health problems which subsequently place a financial burden on all levels af government. Consequently, this seciion is intended to regul.ate the sale, possession, and use of tobacco, tobacco products and tabacco related devices for the purpose of enforcing and furthering the existing law, to pratect minors against ihe serious effects associated with the illegal use of tobacco, tobacco products and tobacco related devices, and to further the of�czal public policy of the State of Minnesota in regard to preventing young people from starting to smoke as stated in M.�. 144.391, and as amended from tirne to time. 350.02 Definitions and Inte retations. Subd. 1. Except as may otherwise be provided ar clearly implied by context; a�l terms shall be given their co�only accepted definitions. The singular shall include the pl�ral and the plural shall include the singular. The masculine shall include the feminine and neuter and vice-versa. A. The words "Compliance Check" means a system used to investigate and ensure that those auihorized to sell tobacco, iobacco products and tobacco related devices are following and corriplying with the rec��rements of this section. B. The words "Individually Packaged" means any tobacco product wrapped individually far sal�. Individually wrapped tobacco products shall inclu�e, but not limited to, single cigare#te packs, single bags, or can af loose tobacco in any form, and the single cans or oiher packaging of snu£f or chewing tobacco. Cartans or oiher packaging containing moare than a single pack ar other container as described in this subdivision shall not be considered "Individually Packed." � __ _ __ _ C. The word "Minor" mear�s any na�ural person who has not yet reached the age of eighteen (18) years. D. The words "Moveable Place of Business" means any form of business operated out of a truck, van, automobile, or other type of vehicle or transportation shelter. E. The words "Retail Establishment" means any place of business where a tobacco product, or a tobacco related devic� is available for sale to the general public. "Retail Establishments" shall include, but not be limited to, grocery stores, convenience stores, resiauranis and on-sale or off-sale liquar establishments. F. The word "Sale" means any transfer of goods for anoney, trade, barter, or other consideration. G. The words "Self-Service Merchandising" means an open display of a tobacco praduct or a tobacco related device in a manner where a person has access to the tobacco product, or the tobacco related device, without the assistance or interventian of licensee's employee. As used herein, "Self-Service Merchandising" shall not include dispensing products by a vending machine. H. The vcrords "Tobacco Froducts" means any substance ar item containing tobacco, leaf, including but not limited to, cigarettes; cigars; pipe tobacco; snuff, granulated, plug cut ar other chewing tobacco; cheroots; stogies; perique; granulated, plug cut, crimp cut, ready-rubbed, and athe�- smoking tobacco; snuff flowers; cavendish; shorts; plug and tvcrist tobaccos; dipping tobaccos; refuse scraps, clippings, cuttings and sweepings of #abacca; and ather kinds and forms of tobacco leaf prepared in such manner as to be suitable for chewing, sniffing, ar smoking. I. "Tobacco Related Device" rneans any devise intentionally designed or intended to be used in a manner r�vhich enables the chewing, sni�fing or smoking of a tobacco product. J. The words "Vending Machine" means any mechanical, electrical or electronic, ar other typ� of device which dispenses a tobacco product or a tobacco related device upan the insertion of money, tokens, or other form of payment dir�ctly inta the machine. 3503.03 Lice�se. No person shall directly ar indirectly, keep for retaal sale, sell at retail, ar otherwise dispose of Tabacco Products uz�less licensed by the City of Arden Hills. License applications sha11 be subznitted to the City Administraior (or designee} together with the license fees determined from time to time by the City Council. A license shall be issued for the specific premises identified in the application. 350.04 A�plication. A. An application for a license to sell tobacco product, or a tobacco related device shall be xnade on a fortn provided by the Ci�y. The application shall contain the full nanae of the applicant, the applicant's residential and b�siness addresses and telephone numbers, the name of the business %r r�hich the license is sought, and any additional inforrnation the City deems necessary. B. Upon receipt of a completed application and any investigation required thereby, the City Adrrtinisiratar (or d�signee) shall forward the application ta the City Council for action at a regularly scheduled Council meeting. If t1�e City Administra#or {or designee} determines that an application is incompleie, the application shall be retu�ned to the applicant with notice of the information required to complete the application. Subd 2. Action. The Ciiy Council �nay either approve or deny the license application. If the City Council approves the license, the City Administrator (or designee) shall issue the license to the applicant. If the City Council denies the license, a notice of the denial shaIl be given to the applicant containing the City Council's reason for denial. Subd 3. Terms. All licensees issued under this section shall be valid until December 31 of the year the iicense is issued. Subd 4. Revocation and Suspenszon. Any license issued under this section my be revoked or suspended as pravided in the violation and penalties subsection. Subd 5. Transfers. All licenses issued under this section shall be va.lid only on the premises for which the license was issued and only for the person or �ntity to whom the license was issued. No transfer of any license to another Iocation or person or entity sha11 be valid wii�iout the prior approval of the City Councii. Subd. 6. Moveable Place of Business. Na lic�nse shall be issued which allaws a tobacco product or a tobacco product or a tobacco related device to be sold in a moveable piace of business. 5ubc� 7. Display. All licenses shall be posted and displayed in plain view of the general public on the license prernises. Subd 8. Renewals. A Iicense rnay be renewed by the City Administratar (or designee} upon verification of the accuracy of the informa�ian contained in the original application and upon receipt of the appropriate license fee provided that the license has not violated any of the provisions of this section. The request #'or a renewal shall be made at least tYtirty {30) days, but no mare ihan sixty {b0) days before the expiratian of the cw-rent license. Subd 9. Fees No license shall be issued or renewed under this seciion until the appropriate license fee is paid iui full. Tl�c annual license fee shall be established by Ordinance as adopted by the City Council. 350.05 Basis far Denial of License. The following may be grounds for denying the issuazlce or renewal of a license under this sec�ion: Subd 1. The applicat�t is under the age of eighteen (� 8) years; Subd 2. The applicant has been convicted within the past five {5) years of any violation of a federal, state, or local law relating ta a tobacco product ar a iobacco reiated device; Subd 3. Th� applicant has had a license to sell a tobacco product, or a tobacco related der�ice revoked within the pzeceding twelve {12) manths of the date of the application; Subd 4. The applicant provides false or misleading informatian in the application, ar in connection with the renewal of the license; and/ar Subd 5. The applicani is prohibited by federal, state, or ather local law from holding such a license. 350.06 Prohbited Sales. No person shail sell or offer to sell a tobacco paroduc� or tobacco related device: Subd 1. To any person under the age of eighteen (18) years; Subd 2. By means of any type of vending machine, except as may otherwise by provided in this section; Subd 3. By means oiself service merchandising; Subd 4. By mea.�s of individually packaging; __ __ . _ _ _ _ Subd 5. Containing opium, xnorphine, jimsonweed, bella cionna, strychos, cocaine, marijuana, or other deleterious, hallucinogenic, toxic ar controIled substances except nicotzne and other substance� found naturally in tobacco ar added as part of an othez-vvise lawful manufacturing process; and/or Subd 6. By any xneans or form prohibiied by federal, state, ar lacal law. 350.07 Vendin,� Machines. It shall be unlawful for any person to ailow the sale o� a tobacco product, or a tobacco rela�ed device by means of a vending machine unless minors are at aIl times prohibited farm entering the licensed establishment. 350.08 ResponsibilitY Alllicensees under this ordinance shall be responsible for the actions of their ernployees in regard to the sale of a tobacco praduct, or a tobacco related device licensed premises. 350.09 Co__mpliance Checks and Janspections. All premises shall be open io inspections by the City's law enforcement agency, authorized representatives, or other City Officials during regular business hours. Compliance checks will be completed at least one time per calendar year at each location where to�iacco is licensed to be sold and in accordance witla Minnesota Statute� Section �b1.12, Subd. 5. Compliance checks shaIl utilize minors over the age of � 5, but under the age of 18, who, with priar written consent of a parent ar guardian, atternpt to purchase tobacco under the direct supervision of a law enfarcement officer or an employee of the licensing authority. Minvr� u,sed for a compliance check shall not be guilty of the unlawful purchase or attempi to purchase, nor the unlawful possessian of a iobacco product, or iobacco-related device when such iiems are obtained as part o� a compliance check. No minor used in a campliance check shall attempt to use a false identification or misrepresenting the minor's age, and a11 minors lawFully engaged in a compliance check shall answer all questions abaut the minor's age asked by the licensee or licensee's employee, and shall produce any identificatian, if any exists, for which he or she is asked. Nothing in this section shall prohibit a compliance check authorized by state or federal Iaws for educational, research, or training purposes, ar required far the enforcement of a particular state or federal law. 350.10 Other Illegal Acts. It shall be unlawful for any person to sell or otherwise provide a tobacco produci, or a tobacco related device to a minor. _ Subd. 1 Illegal Sales. 7t shall b� unlawful for any person to sell ar otherwise provide a tobacco product, or a iobacca related device to a minar. Subd. 2 Illegal Possession. Ii shall be unlawfizl for a minor to have in his ar her possession a tobacco product, ar a tobacco related device. This subdivision shall nat apply to minors lawfully involved in a complxance check. Subd. 3 Illegal Usage. It shall be unlawfi�l for a mi�or to smoke, chevv, sniff or otherwise use a tobacco product or tobacco related device. Subd. 4 Illegal Procurernent. Except as it relates to mino'rs lawfully engaged in a compliarace check, it shall be unlawful: A. �ar a minar or atternpt to purchase or otherwise obtain, a tobacco product or a tabacco related devices; B. For a person to purchase or oiherwise obtain a tobacco product or a tobacco related device on behalf af a rninor; or C. Far a person to coerce or attempt to coerce a minor ta legally purchase ar otherwise obtain or use a tobacco produci or a iobacco related device. Subd. 5 Use of False Identification. Tt shall be a violatian of this section for any minor to atternpt to disguise his or her true age by the use of a false form of identifications whether the identification is that of ano#her person or one on which the age of the person has been moclifed or tampered with to represent an age older that the actual age of the person. 350.11 Adrninistrative Fines,.Suspension, or Revocat�ion. Any violation of the City's regulations relating to the issuance of Tobacco Products License or af any conditians/restrictions attached ta the issuance of such license sha11 be cause far the impositian of an admir�istrative fine, the suspension of the lic�nse, or the revocation of the Iicense. A licensee whose license has been revoked shall not be eligible far another Tobacco Praduct License for one year from the daie of license revocation. If #he violation relaies to the sale of tohacco product� to minors by licensee or license's employees, the following administrative fines, suspensions, or revocations shall be imposed by the City: Subd. 1. The frst such violation within 12 months shall subject the licensee to ihe payment of an administrative fine of $100.00; Subd. 2. The second violation within 12 monihs shall subject licensee to the payment of an administrative fine of $500; Subd. 3. The third violation �thin 12 months sha�i subject licensee, at licensee's option, ta #he payment of an administrative fine of $1,000 and a seven (7) business day suspension or a thirty day suspension of the license; Subd. 4. The fourth violaiion within 12 months shall subject licensee to a revocatian of �lie license for a one-year period. 350.12 Hearin�. The imposition of an administrative fine and suspension af a license or to a license revocation pursuant to this section shall be preceded by a hearing before the City Council, unless the license holder elects to waive its right to a public hearing. Licensees, whose licenses have been revoked, shall nat be eligible for another Tobacco Product License for one year from the date of license revocation. 350.13 Exce tions and Defenses. Nothing in this section shall preveni the providing of tobacco, tobacco related devices to a minor as part of a lawfiilly recognized religious, spiritual or cultural ceremony. It shall be an affirmative defense to the violation of ihis section o�a person to have reasonably relied on proof of age as described by state iaw. 350.14. Fees. No license shall be issued or renewed under this sectian �ntil the appropriate license %e is paid in full. The annual license fee shall be established by Ordinance as adopted by the Cit Council. 350.15. Licensee Requirements. A Iice�se sha11 comply with all applicable regulatians of the State of Minnesota relating to the sale ar dispensing o�'tobacco products. If there is a conflict between the regulations of the State and regulations of the Ciiy, the rnore restrictive regulations shall control.
