Background
On March 31, 2008, the City Council approved an amount not to exceed $244,790.00 for the
exterior repairs on the City Hall building. Of the approved amount, $23,000.00 was for Wiss,
Janey, Elstner (WJE), the project engineer. The remaining $221,790 was to A.J.Spanjers (AJS)
the masonry contractor. The approved amount included a $41,700 contingency for additional
repairs that could be used as needed during the project.
In the course of their work, the contractor and engineer haveencounteredadditionalissues
related to the current project and additional concernsthat were not anticipated but need to be
addressed. Due to the additional unforeseen issues,thetotalcost of the repairs will exceed the
approved contingency.
The City’s hired engineer has submitted the estimated costs for the additional repairs.The
estimates are divided into threeparts (see attachment for more detail):

Items 1 and 4 are additional costs related to the repairs already started and are needed to
complete the current repairproject.Cost: $32,482.50

Items 2 and 3 are unanticipated issues that were discovered during the course of this
repair project but are recommended by the City’s hired engineer.Cost: $65,000

Including engineering and inspections, the total cost of the additional repairs is $105,482.50,
which is $63,782.50 more than the approved contingency. Items 1 and 4 can be completed
without additional Council action because they can be covered by the existing contingency.
However,items 2 and 3 will cause the project to exceed the approved cost and contingency. If
the repairs for items 3 are delayed to 2009, AJS states that the cost would increase by $2,500.
TheCity’s buildingofficial, Dave Scherbel, and the project engineer from WJE, Brian Pashina,
will be in attendance to discuss the reason, cost, timing, pros, and cons of the additional repairs.
Mr. Scherbel is reviewing the project to determine if other options are available that may help
lower the cost.
Finally,this project is sensitive to the weather, and the contractor has expressed concern
regarding the application of a cleaning agent on the masonry once the area has been completed.
In order for the product to work correctly, the surface temperature needs to be above 50 degrees.
If the repairs described in items 2 and 3 are to move forward in 2008, approval is needed as soon
as possible to ensure that work can be completed before the weather changes.
FinancialImplications
Funding for this project is availablefromtheEquipment Building and Replacement Fund.This
fund was established during the 2008 budgeting process and City Hall repairs were budgeted in
the 2008-2012 CapitalImprovement plan from this fund.The City will be utilizing funds
received from the mediation settlement.
Requested Action
If the repairs described items 2 and 3 are approved, the motion would be as follows:
