On March 3 T st, 2008, the City Council approved the contract for A.J. Spanjers to make z�-�asonry
repairs to the C�ty Ha�l Buildings fa�ade, for an arraou�t of $203,090.04.
The co�ttractor requested $62,62b.85 per pay application # 1 an August 7, 2008. Wiss, Janey,
Elstner (W3E} Associates, the project engi�eers, have reviewed and accepted A.3. Spanjers pay
application #� . The Iette� fro�n WJE notes that a partial waiver of lien was not included with the
initaal pay request; however, a partial wavier was subsequent�y sub�nztted for the tull amount of
this payment.
This will leave a balance due of $140,463.15.
Attached to this memarandum is pay application #I, WJE's approval letter, and a partial waiver
of lien.
Recomtr�endation
Staff recomrnends approval of #l�e August 7, 2008, pay app�icatian #1 frorn A.J. Spanjers for the
amaunt of $62,626.55.

(d�ted JuIy 29, 2008). It was receaved by W7E an 3uly 30, 2008_ Our commenis are as foIloivs:

for Pay�nent No. AH-00001, it is our opi�ion tl-;at the w�ork has progressed to the point indiestect

2. To the besf of our knowledge, the wark is in accordance with the [:ontract Documents.
3. A lien waiver did not accompany tt�e payrr�ent application per Subpara�raph 9.3.4 of Article 9 in
Section 04800 of the Project Manuat which states the frst payment application shall be
acco2npaivsd hy the Contractor's partial waiver of lien only, for the full arno�nk of the payrrient. It
fur�her states that each subsequent m.onthly payment apptication shal] be acco�panied by the
Contractor's gartial waiver a�d by the partial waivers of Su�cantractors and Suppliers who �vere
ine�uc�ed in t3�e imrr�ecEiately preeeding payment applieation, to tlie extent of that payment.
