Backgrouud Smiths Medical is located at 2265 Grey Fox Road. The campus consists of tvvo, single-story, buildings. The coznpany is in the process of relocating their top �eve� executive staff from England to Arden Hills. In order to accoanmodate this move, they are seeking io modify the interior of one of their existing buildings to create several executive offices. As part of their plans, the company is proposing to create more space by filling in appro�i�nately 500 square feet of what is currently ar� open-air entryway wiin glass. This area is currently under the existing roof. For this proposal, Smith Medical is requesting the City Council alter the procedure as allowed by the Zoning Code, recognizing that ihe exterior modification is minor, having no impacts on the Conditional Use Permit review criteria, and permit them to praceed with their plans through the building p�rmit and administrative plan review process. The applicant has subrnitted a iand use application, a Ietter outlining their request, proposed site plans, and elevations depicting ihe proposed modification {Attachment A). The City's Zoning Code requires all modifications of a building's exterior in this district to go through a Conditional Use Permit review process (Sectian 1320.12 Subd 1}. However, i� this unique case, the propased madification would have no irnpact on traffic, parking, the buildings footprint, landscaping, or any other criteria typically associated with ihe Conditional Use Permit review criteria. Section 1320.12 Subd 1 of the Zoning Code allows the Conditional Use Pern�it procedure to be modified by tlae City Council in order to a11ow planning flexibility and to encourage cooperative dialague between tha applicant and the City. Section 1320.12, Special Requirements for the I-Flex District, states: Subd. 1 Parocedure. The application and the administrative and review procedure established in Section 1355.04 Subd 3, Conditional Use Pernlits, and Appendix A, Procedural Manual shall be followed for aIl develapment that involves new building consta-�ction, modification of a building's exterior, or modification of the site. This provision is subject to any modifications ar additians set forth in this Section. The prescribed procedure may be modified by the City to allow pianning flexibility and to encourage cooperative dialogue between the appiicani arid the City. Section 1355.Q4, Subd 3, Paragraph F af the Zoning Code outlines tl�e requirements for Canditional Use Permits and, in part, staies: The Council shall consider the factual findings, conclusions and �ecommendations of the Planning Conzmission, as contained in its Yeport, and �ioth shall consider the effect of the proposed use upon the health, safety, convenience and general welfare of the owners and occupants of surrounding land, in particular, and the community as a whole, in gener�al, incduding but not limited to the following factors: existing and anticrpated traffic and parking conditions; noise, glare, odors, vibratian, ssnoke, dust, ai� potlution, heat, liquid or salid waste, and other nuisance characteristics; d�ainage; population density; visual and land use compatihility with uses and structures on surrounding land; adjoining land values; par�k dedications where applicable, and the o�derly development of the neighborhoad and the city within the general purpose and intent of this Zoning Code and the CompYehensive Development Pian for the City. Due to the insignificani changes on the exisiing siructure, the proposed madifications would have no impacts on t�e Conditional Use Permit cr�teria. The glass addition v�rould not be vi�ib�e frozn �he right-of �way, nor any neighboring properties. There would be no i�crease in impervious coverage, since the area being enclosed is a concrete entryway. If this z-equest is approved, al� oiher review requirements and City and Building Code requirements would apply to the project and appiication. Although #his is a rarely used provision in ihe Zoning Code, the insigni�cant nature of the proposed exterior modificanons and the lack of impact on surrounding properties is a unique circumstance #hat may warrant the request. Pu�rsuant to Minnesota S�ate �tatute, the City must act on this request by October 17, 2008 (60 days), unless the City provides the petiiioner with writien reasons far an addiiiona160 day review period. The City may with the petitioners' consent extend the review period beyond the 120 days. Howe�er, the extremefy minor nature of the changes, with na impact on personnel count or parking requirements, can be handled with a simple request for modi#ication of the existing pUD. If the City Councif agrees and approves the request at the public hearing an August 25, we can reques# a building permit shartly thereafter. As requested, I am pro�iding this brief description of the changes as a formal request for approval. Please find attached a check for $15Q to cover the city fees. Scope: As discussed, there are some changes coming at Smiths Medical. The mo�e of fhe top le�ei of management from England to Arden Hiils has prompted the need #or more executi�e office space. As a result, we wili be recanfiguring the Human Resources area adjacent to the main entry. To create enough interior space we wiii Eae infiffing #he diagonal corner of the existing building. This area is currentfy under the existing roof and creates an outdoor patio space. ihe space in ques#ion is approxima#eEy 500 square feet. This project has the highest priority within Smiths Medical and of caurse, a rushed schEdule. Qescription: 7he construction will require remo�ing the exis#ing diagonal wafl of glass from uncEer the raof. A new wall of windows will be built at the outside edge of the space on the soutf� and west sides to create a rectangular interior space. The new windows will ma#ch the existing in firame style, and finis� as well as glass. Once cornpleted, this part of the building should blend with the remainder of the campus. This new area will be configured as the new executive area. WhiEe #he work adds 500 square feet to the area of the building, there is �ery little eff�c# on the personnel count and subsequently, the required parking. The new executive area, with its large offices, actually wili have a lower personne] count than the previous Human Resources space. The Human Resources space will be reconfigured and wilf be smaller, reflecting the new personnel needs in this department. I trus# that this is the irtformation that you need.
