The City has been contracting with Ani�al Control Services (ACS) for animal control
services for a number of yea�s. Tl�e 2011 budgeted amount for this service is $6,000 and
the 2010 actual cost was $7,919.91. The 2011 agreement is attached for Council review
and approval. There are no fee changes included in this year's agreeme�t.
Council Action Requested
Motian to approve the 20ll agreement with Animal Control Ser�ices fox the period from
January 1, 2011 through December 31, 2011.

ANIMAL CONTROL CONTRACT
Tliis Agreement, �nade effective the iirst day of �anuary, 2011, by and between Anirnal Contral
Services, hereinafter refez�ec� to as "ACS," and the City of Arden Hills, a municipal corporation,
located in the County of Ramsey, State �f Mznnesota, herefnafter referred to as the "City".
In consideration of the co�venants a�d agreements, hereinafter set %rth, it is m.utually agreed by
and betvveen the parties, hereto, as follows:
1. Thi.s agreement will cantinue in effect until December 31, 2011, unless terminated as
provided herein.
2. ACS wiil provide Patrol services on tiae public streeis of �he City, in a vehicle suitable for
the transportation of small animals, in accordance with City Ordinances and a schedule
agreed upon. by both partias. The vehicle shall have propez identification displayed at ail
times. ACS shall n�aintain and insure such vehicles at a.11 times. In addition to patral
hours, AC� agrees to maintai� ai �east one vehicle for Ca11 Out service to attend to cases
outside regular patroi haurs at the s�ecific request of a la�v en%rcement agency as
approved by ihe City.
ACS shall provide competent personnel, trained in the handling of animals, in proper
uni�orm and ideniification including ern�loyee's f�st name a�d/or employee number.
4. The City authorizes ACS to apprehend and retain dogs, cats, and other animals, and/or
issue cita�on tags far violations of the City 4zdinances related to atumals. ACS wi�l not
take action on private properiy contrary to the expressed wishes of the owner af said
�aroperty, nor forcibly take ar� animal from any person, without the instructzon, approval,
and assistance of a duly licensed Mixu�.esota Peace O�ficer with current jurisdictian #hat
includes the private �raperty where the animal is located.
5. ACS shall impound and board animals as directed by written orde� of an authorizec� City
representative, or by ruling of the Minnesota Board of Healt.b. or other Minnesota or
United S�ates agency wi�th jurisdiction.

treahnent is z�ot immediately available at Hillcrest Anim� Hospital.
7. If an anaarz�a� is unclaimed, the City vviiI pay ACS the charges as agreed to on E�ibi# One
ta t.�is Agreement within thirty days of the Statement Daie.
Before an animal is released to its o�vvner, ACS or its agent shall callect the charges
specified on Exhibit Qne #o �lais Agreement.
9. In the event �hat ar�y dags, cats, or other impounded anixnals axe unclaimed after the
expiration af an.y applicable redezx�ption. or quaxantine period, or six {6) days, whichever
is longer, they shall become t�e property of ACS and may be disposed of or so�d at its
sole discrei:ion. All praceeds from ihe disposition of such animals shall i�e the sole
property of ACS, including any proceeds recei�ved from anq animal,s disposed of in
accordance �rith Minnesota Siatutes 35.71.
10. The City shall furnish to ACS any required forms or receipts and ACS shall keep records
of a11 at�m�.is impounded.
11. ACS shall defend, indemnify, ar�d hold the City harmless including its officers,
emp�oyees or agents from any and all claa.ms, lawsuits, losses, damages, ox expenses on
account o�bodily injuries, sickz�ess, disease, death, and property darnage, including injury
to aivrnals caused by its employees. ACS shall provide the City proof of cornmercial
general liabili�y insuraz�ce and comprehensive automobile liability in an amount af at
least $SOO,OOO,OQ per occurrence. ACS shall carry, and upon requesi of the City provide
proof of Workers Compensation Insurance coverage required by Minnesota law.
12. ACS shall comply with the Minnesota Data Prac�ices Ac� a.�d all other State and Federal
iaws relating to data privacy ar confidentialiiy, and shall hold the City and i�s employees
harmless from any claims resulting from any improper disclosure or use of data it
receives or maintains in performance of fihis Agreemeni. ACS siiall imrnedia#ely report
to the Gity any requests from third parties for information relating to its perfarmance o£
this Agzeement.
13. ACS agrees to promptly respond to inquiries fox in.formation or docuznentation from the
City relaiedl io its perfarmance of this Agzeement.
14. ACS agrees to abide by ihe requirements and regula�ions of the Americans witl�
Disabilities Act of 1990 (ADA), the Humar�s Rights Act (Minnesota Chapter 363 an.d
Title VII of' the Civil Rights Act of 1964}, an.d any laws goveming discrimination based
on race, gender, disability, religzon, sexual preference, and sexual karassment. Vialation
of axxy of the above laws can lead to termination of t.his contract.
15. Either party hereto, may termi�ate this contract after thirty (30} days written notice to the
ot�er party. Any payments due ACS shall not be a.�fecEed by termination.
l 6. Any notice required under applicable law oz this Agreement, rna�+ be sent to the otkaer
party as indicated on E�iibit One herein.
17. ACS shali be entitled to apply a fuel surcharge i.� the event the averaga price for unleaded
gasoline in the Twin Citi�s metropolitan area, as measured by AAA or similar reporting
service, is :53.15 per gallon or higher.
