HomeMy WebLinkAbout1.A Arden Village Workforce Housing Concept'IAPsPEN HILLS MEMORANDUM DATE: August 17, 2009 Item LA TO: Mayor & City Council FROM: James Lehnhoff, Community Development Director SUBJECT: Arden Village Workforce Housing Concept Proposal Sand Companies, Inc Action Request Sand Companies Inc., is requesting a letter of support from the City Council regarding a proposed application for housing tax credits through the Minnesota Housing Finance Agency to construct a 55 unit workforce housing building at 1296 County Road F. The Council cannot vote on this item at work session; however, the Council can direct staff to place this request on an upcoming regular City Council meeting. The purpose of this work session is to review the proposal, ask questions, consider options for City support, and direct staff on a course of action. Background Sand Companies, Inc (SCI) proposes to construct a 55 unit workforce rental housing building at 1296 County Road F. The 2.74 acre property is immediately west of the Land O'Lakes headquarters and includes a communications antenna. SCI has submitted a booklet outlining the proposal, details of the building, proposed rental rates, preliminary costs, a request for City support, and information about the company (Attachment A). The Council is not being asked to approve any aspect of the concept proposal at the work session; however, action would need to be taken at a regular meeting for the process to begin. If this project moves forward, there are a number of steps to the process that will require additional discussion and action. The first step relates to a federal housing tax credit program and a request for City support. Other subsequent steps include a Comprehensive Plan amendment, rezoning, and a full development review with the Planning Commission and City Council. As noted, SCI is proposing to use housing tax credits, which is part of a national program to promote affordable rental housing units. The tax credits are the key component to developing a building with affordable rental rates. The number of housing tax credits are allocated to each state and this is competitive application program. Housing tax credits have been used in Arden Hills by Cottage Villas, the senior housing building on Cleveland Avenue, to maintain affordability. Request for City Support MHFA scores each housing tax credit application based on a set of criteria (for an example self - scoring worksheet, Visit htM://www.mnhousin.iz.gov/idc/groups/multifamily/documents/webassetimhfa 007954.rtf). To help the project score higher and hence have a better chance of receiving the credits, the applicant is requesting financial support from the City. The support could include a combination of the following: waiving all or a portion of City development fees (i.e. building, SACIWAC, park dedication), flexible zoning, Tax Increment Financing (TIF), and/or an expedited review process. On page eight of the submitted booklet, SCI has noted that a common form of City participation is creating a new pay-as-you-go TIF district. If a new TIF were created, the additional taxes generated by the development would be used to pay back bonds that help fund the project. The financials would need to be evaluated by the City's financial consultant if the Council decides to move forward with a new TIF district. As stated in the booklet, the TIF district would not have to be in place prior to issuing a letter of support. Waiving or reducing City development fees could also be done. Based on the preliminary design and project value, the estimated building permit fee is $72,500. City sewer and water access charges (SAC/WAC) would be an additional $34,600. Since they intend to subdivide the existing antenna from the rest of the lot, it would be subject to the park dedication fee. Based on a 2009 market value of $715,600 (Ramsey County property records), the park dedication fee is estimated at $71,560. The base cost for the Comprehensive Plan amendment, rezoning, planned unit development, and subdivision application is $3,000. The total estimated cost for all City related development fees is $181,660. The Metropolitan Council will also charge a sewer availability charge of $110,000, The City is responsible for collecting this charge and remitting it to the Metropolitan Council. While the City could pay the fee on behalf of the development, it would be an actual charge to the City. While waiving all or a portion of the fees can be simpler than creating a new TIF district, the fees do represent a charge for service that would be absorbed by the City since the services are still provided to the project. Conversely, a new TIF district requires additional footwork but the costs are essentially supported by the project itself through property taxes. As with any TIF district, the new increment of property taxes would go to the development instead of being distributed out to the City, county, and school district. District 3 is set to decertify on December 31, 2009, with an anticipated fund balance of approximately $95,000. These funds can only be used for "low to moderate income housing." The Council could extend the district to December 31, 2019, with a plan modification. The projected increment for this district is estimated to be $45,000 annually, which would be approximately $450,000 for the extended period. The total projected balance available for use in low to moderate income housing would be $545,000. Although the district may produce $545,000, the City could limit the amount used to the requested $400,000. The remaining balance could potentially be used for other low to moderate income housing projects. Staff has requested information from the City's financial consultant about the process that would need to be used to extend the district an additional ten years. A detailed financial analysis has not been completed since this is still the concept stage. The City had considered using these funds for affordable housing on TCAAP; however, the district will decertify before there is any opportunity to use them on TCAAP. Comprehensive Plan and Rezonin The Future Land Use Map in the 2030 Comprehensive Plan designated this property as "Utility" due to the existing communications antenna. The Utility land use was defined as, "Public or private land occupied by a power substation, water tower, municipal well, pumping station, or similar use." The property is currently zoned 1-1, Limited Industrial District. The Utility land use and the I-1 zoning do not include provisions for housing. A Comprehensive Plan amendment and rezoning would be required for this proposal. The Comprehensive Plan amendment to the Future Land Use map could involve modifying the existing "High Density Residential (HDR)" used in the Plan or creating a new land use category. HDR is currently defined as, "apartment and townhome land use category providing for densities of nine to twelve units per acre." Examples of properties in the HDR land use category include Parkshore Apartments and Hunter's Park condominiums. If used on this property, the HDR definition would need to be amended to allow for about 22 units per acre to accommodate the proposal. Instead of modifying the HDR category, a new residential category could be created. Once the Comprehensive Plan is amended, the property would need to be rezoned. As noted, the existing I-1 zoning does not include housing as a possible use. If rezoned, the most applicable zoning classification would be R-4: Multiple Dwelling District. Although the R-4 zone does not completely match the proposal or density, the Planned Unit Development (PUD) process could allow for some variation. Since the proposal is still in the concept stage, it is not yet known exactly what variations would be needed from the R-4 regulations, except for the density increase. Whether through a zoning change, PUD, or TIF agreement, the City would be able to apply design standards to the proposal. Due to the location, a traffic study may also be warranted. Since the number of units is relatively small compared to the surrounding area and since housing tends to have a different traffic pattern, the impact may not be significant but a full analysis would provide more information. Given the size of the property and proposal, a Comprehensive Plan amendment is likely to receive Metropolitan Council approval and may qualify for their faster administrative review process. Additionally, the project helps the City advance the affordable housing goals described in the 2030 Comprehensive Plan.. Timeline and Letter of Support Page 9 of the booklet includes a general development timeline. While the timeline states that SCI is seeking Council support in August, the Council does have until the September 14 regular meeting to determine if a letter of support will be approved. In the meantime, the developer and staff can work to answer any open questions that need to be addressed prior to making a determination on the letter. The deadline for the Housing Tax Credit application is October 1, 2009; however, SCI would need to be working on the application well in advance of the deadline. MHFA would make its determination by January 29, 2010. A letter of support is not an approval of the project; however, the letter would be a good faith commitment from the City to provide the identified support if the housing tax credits are approved by MHFA. If T1F is used, the project would need to meet all TIF statutory requirements. The City would not begin processing a TIF request or any other part of the development review until MHFA has made their decision in January 2010. If the City is willing to use TIF or any other type of support, the City would still have the opportunity to complete a financial analysis to ensure the soundness of the project. The concept and location of the apartment community is a perfect fit for the Smart Growth principals including, creating a range of housing opportunities and choices, encourages community and stakeholder collaboration, takes advantage of compact building design, does not require extensions of water and sewer and is near many services and jobs. With support from the City of Arden Hills, the development will be a secure, well -maintained and managed community that offers life cycle housing opportunities for the residents of Arden Hills. Project Developer/Owner/Architect/Contractor/Manager Sand Companies, Inc. (SCI) has earned its reputation for professionalism, thoroughness and proven results in the construction, property management, development and architectural industries. SCI's reputation and accomplishments can be attributed to the many successful partnerships formed over the years. Not only does SCI facilitate all aspects of the real estate development, it becomes a part of it by establishing successful working relationships and communicating effectively with all parties involved. Minnesota Green Communities is a collaboration of the Greater Minnesota Housing Fund, the Family Housing Fund and Enterprise designed to foster the creation of healthier and more energy efficient housing throughout Minnesota. The initiative supports the production of housing with markedly reduced energy costs, use of materials beneficial to the environment, conversation mined land use planning and attention to the creation of healthy environments and lifestyles for individuals, children, families and communities. These standards emphasize an integrated design process that involves the developer, architect, engineers, contractor, building management team and LEED Accredited Professional from the very beginning of the design process. The design of Arden Village will involve all parties of the project including Sand Companies, Inc.'s on -staff LEED Accredited Professional. The project standards will focus on location and neighborhood fabric, site improvements, water conservation, energy efficiency, beneficial materials selections, a healthy living environment and operation and management practice. Examples for Arden Village will include efficient land use, use of Energy Star appliances, water conserving plumbing fixtures, high efficiency heating systems, extensive use of florescent lighting, and carpets manufactured from recycled soda bottles. Green or sustainable building strategies are intended to increase resource efficiency and reduce environmental impacts, but they can also yield cost savings through long-term reductions in operating expenses. Increased energy performance, comfort of occupants and a healthier indoor environment are the major benefits, but increased durability of building components and simplified maintenance requirements can lead to financial efficiencies for the development. Sand Companies, Inc. believes in "building green with common sense ", rather than scoring points on abstract scales. Property Management Good property management is the key to a successful rental community. Sand Companies, Inc., who currently manages 675 rental units and seventeen select service hotels, will manage the day-to-day and ongoing operations of Arden Village. Sand Companies, Inc. started in the business of residential property management in 1998 when it became challenged with poor third party management and maintenance of its properties. Since Sand Companies, Inc. is a long-term owner of its properties, high quality management practices are the goal and the standard. With hands-on management, potential property and resident problems are headed off and the continual practice of preventive maintenance preserves the long-term quality of the developments. A visit to any of the sites managed by Sand Companies, Inc. will show how important attention to detail is to the company. Arden Village Proposed Development 5 Sand Companies, Inc. will be responsible for hiring and training the manager, marketing the property, setting up strict resident selection criteria, along with daily communications, regular site visits, accounting, human resources, renovations and purchasing on behalf of the property. As a manager and owner, Sand Companies, Inc. has a very strict and stringent resident screening process and is an active member of the Crime Free Multi -Housing Program wherever available. All potential residents sign off on receiving the specific screening criteria before filling out an application. Sand Companies, Inc. not only does local checks on applicants, but also out of state checks, as applicable. The following is a brief summary of Sand Companies, Inc.'s minimum screening criteria. Sand Companies, Inc. reserves the right to be more stringent. 1. Age: All applicants must be at least 18 years of age. Any residents 18 years of age or older must be listed on the lease and also meet the screening criteria. 2. Income: For income restricted units, total gross household income must be at least two times the amount of rent, including utilities. 3. Credit: Applicants with a consistent history of NSF checks will be denied. Applicants with outstanding collections or judgments will be denied. Any applicants with an unlawful detainer will be denied. Applicants that have filed for bankruptcy in the last three years may be denied. Extenuating circumstances may be considered in the event of medical or other catastrophe. Applicants with a consistent history of late payment of their financial obligations will be denied. Sand Companies, Inc. also establishes minimum credit "beacon" scores. 4. Unlawful/Criminal History: Applicants with a history of unlawful or criminal activity will be denied. Persons involved in drug related criminal activity will be denied. Sand Companies, Inc. also uses the Crime/Drug Free lease addendum, which is signed by all residents (18 years of age or older) of the household and is made part of the lease. Applicants with dependents in the household with criminal offenses will be denied. 5. Rental History: Applicants with a rental history must provide at least one verifiable rental landlord reference with a minimum of one-year rental history. Applicants with a history of late rental payments, verified housekeeping problems and/or a history of disturbing the peace will be denied. 6. Occupancy: Even if the city does not have an ordinance limiting the number of occupants in a unit, Sand Companies, Inc. sets occupancy standards of no more than two residents per bedroom. Arden Village Proposed Development 6 The Need for Work -Force Housing According to the Family Housing Fund, a non-profit funder for affordable housing in the Twin Cities metro area, housing is "affordable" if a family pays no more than 30 percent of its income for housing costs. In the Twin Cities metro area, more than 185,000 lower income households pay more than this amount for housing. Almost half live in the suburbs such as Arden Hills. Arden Village will help the City achieve some of its housing goals in the 2030 Comprehensive Plan including the development of a variety of housing that are suitable for a mix of incomes and the new development of affordable/work-force housing. The Plan forecasts a 55% increase in the number of households between 2000 and 2030. This forecasted rate of growth surpasses all adjacent communist as well as Ramsey County. The Plan also notes that apartments with ten or more units are just 2.74% of the City's existing housing stock and there is just one traditional apartment building with 37 units and one condominium project with 72 units. Even if the City does not achieve the projected growth, there is and will continue to be a need for rental housing for the many employees that work in Arden Hills. The 2030 Comprehensive Plan identifies three primary housing issues that will need to be addressed by Arden Hills: housing diversity, housing affordability and housing quality. Diversity. Rental housing is an important component of overall housing supply as it services the needs of several segments of the population including retail service employees, seniors, young adults just entering the workplace and economically disadvantaged households. Affordability. The availability of quality affordable housing is an issue in every Twin Cities area community. Because of the disparity of housing costs and wages throughout the Twin Cities, affordable housing continues to a major initiative of the Metropolitan Council. The Met Council has allocated a need for 288 affordable housing units to Arden Hills between now and the year 2020. Quality. The quality and long-term viability of existing and new housing stock is essential for successful housing in a community. The proposed Arden Village project will help the City accomplish many of its housing goals in the 2030 Comprehensive Plan and also addresses the primary housing issues. Because much of Arden Hills is developed, apart from the TCAAP site, opportunities to meet these goals are somewhat limited. The City will also be partnering with an experienced housing developer that has a proven track record of developing and maintaining high quality projects. ahage Arden Village Proposed Development 7 Development Description Arden Village will be 55 units which will be developed as a work -force housing project and be financed with Minnesota Housing Finance Agency (MHFA). It will be marketed to working families of Arden Hills. The development will provide seven one bedroom units, thirty-six two bedroom units and sixteen three bedroom units. The proposed contract rents include one underground parking space, water/sewer, refuse removal and heat. All units will have income limits set at 60% or less of area median income (AMI) and initial rents affordable to residents making 50% of AMI. Annual & hourly income restrictions for a three bedroom unit is based on a household of five Local Participation — A Key to Being Selected The main funding source for Arden Village is proposed to be federal housing tax credits which are allocated annually by MHFA. The tax credit program is a national program that started in 1987. It is one of the most successful housing programs in the United States as it promotes private development of affordable housing versus public ownership and management. The application for the next funding round is due to MHFA in October 2009 for an allocation of 2010 credits. Because of the program's great success, getting awarded a tax credit project is extremely competitive. The MHFA application weighs heavily on local participation as this allows more State and Federal dollars to fund more projects. Without local participation, an application by a for -profit developer has an extremely low chance of being funded. As an experienced owner and developer of tax credit projects, Sand Companies, Inc. has had very good success by being awarded sixteen housing tax credit developments in the cities of Lakeville (' 95), Albany (' 96), Hutchinson (' 97), Mahtomedi (' 98), Chaska ('99), Shakopee ('00), Blaine ('01), Bloomington ('01), Shakopee ('02), St. Joseph ('04), Chanhassen (' 05), St. Cloud (' 05), Jordan (' 06), Maple Grove (' 07), St. Paul (' 07) and White Bear Lake ('08). We are confident that with local participation, the Arden Village application will be very competitive. ahage Arden Village Proposed Development Local participation from the City can come in many forms from financial to flexibility in development standards along with letters of support. Of course, the more the City is willing to participate, the higher the project will score on the tax credit application. Some examples of assistance include tax increment financing, waiver of fees or assessments, density bonuses, flexibility in zoning or development standards and fast track approvals. One of the most common forms of City participation associated with our past work -force housing developments was the utilization of pay-as-you-go tax increment financing (TIF). We have successfully used this financing tool with projects in Lakeville, Albany, Chaska, Chanhassen, Jordan, St. Paul and White Bear Lake. This tends to be a tool that many cities utilize as it has no up -front costs for the City and also does not create any financial obligations. It is anticipated that Arden Village could support approximately $400,000 in pay-as-you-go TIF based on 17 years of increment (90%) returned to the development. Other cities such as Maple Grove, St. Michael, St. Joseph, Bloomington and Chaska have financially supported our tax credit applications by waiving fees such as local SAC/WAC, building permit and park dedication fees. Waiving a portion of these fees is a good option for participation and can be easier to administer versus TIF. This local leverage will also open the project up to more significant Federal and State funding. If the City agrees to take part in the project at the requested level, the Arden Village development will bring to the City approximately twenty-eight dollars of Federal, State and local monies for every one dollar of City participation. We feel this would be a good, long term investment for the City as Arden Village is committed to be affordable for 30 years. It is important to note that the TIF does not need to be in place for the tax credit application due in October. If the project is selected and moves forward, the project would only then go through the public hearings and establishment of the TIF district. The only thing needed for the application is a letter from the City supporting the uses of TIF or the waiver of fees. One of the attachments is a draft of a proposed letter we would be requesting for the application. Also attached for reference are letters from other cities that were part of previous selected tax credit applications. Arden Village Proposed Development 9 Development Timeline We have compiled and reviewed a substantial amount of information as it relates to Arden Village in Arden Hills. We have targeted June 1, 2011 as the projected opening date. To meet this target date, the following critical path of events is necessary: 1. Secure Land Contract for Land Purchase 2. A concept plan was reviewed and accepted by the City Council on June 10, 2008 with flexibility in zoning standards including density, set -back reductions, building height and parking. The Legislature also has designated the following cities and counties as suballocators: Dakota County, Duluth, Minneapolis, Rochester, St. Goud, St. Paul, and Washington County. Some examples of non -buildable areas include land that is not economically feasible to be developed, such as easements, utility fall zones, unsuitable soil, steep grades, water features, wetlands, nature preserves, etc. Density calculations do not include land that is set aside for future building phases or development. Staff has done an analysis on both districts to determine what options the City Council may choose in regards to the available increment. DISCUSSION Cottage VillaHousin — District #3 This district has been set to decertify on 12/31/09 according to the plan documents. The current projected balance in the fund and the end of 12/31/09 would be approximately $95,000. These funds may only be used for "low to moderate income housing" and could be used in the TCAAP project. The Council may extend this district to 12/31/19 by approving a plan modification. The projected increment for this district is estimated to be $45,000 annually which would be approximately $450,000 for the extended period and the projected balance available would be $545,000 for use in low to moderate income housing. (The balance in this fund at 12/31/07 was $87,227). The additional tax base that this district has added to the City is $47,483, which is the additional increment as a result of this project. htip://ardenhilts.metro-iztet.us/citycoancil/TIF Information/T[F Analysis.doc TIF District Analysis 8/11/2009 Page 2 Round Lake Office Park This district will decertify on 12/31/15. This district may not be extended. Since this is an older district, the City is able to use these funds to a number of different uses, but not for recreational purposes_ It may be used sidewalks, infrastructure, and other improvements. The projected balance available in this fund through the end of 12/3I/15 is $3,806,914. This could increase if development were to occur on the Traverse Business Center property. Currently, staff is monitoring the bonds associated with this district and it is possible that we may be able to have another $70,000 available by paying some of the bonds off early, thus resulting in an interest savings. We cannot begin calling the bonds until 2011 for the 2012 bonds; staff will continue to monitor this. (The balance in this fund at 12/31/07 was $543,028). If the Council wishes to use these funds, it would have to have a plan in place within the next three to four years. The street improvement budget in the current plan does appear to have sufficient monies left to utilize the current projected amount available. The additional tax base that this district has added to the City is $477,145, which is the additional increment as a result of this project. CONCLUSION Staff is providing this information for planning purposes. It is useful information for both the Community Development of the Round Lake area and also for the TCAAP negotiating team as some of this money may be used to finance items in TCAAP. Since the City will likely be using some type of Tax Increment Financing on the TCAAP development, it would be wise to have Steve Bubul look any TIF plans if the Council so desires to extend or modify either of these plans to be use that we are inline with TIF law. Bob Deike was the attorney that was involved with the original TIF districts and our financial advisors feel that he should make any modification to the old TIF districts if the City proceeds to modify either of these.
