CITYOFARDENHILLS COUNTYOFRAMSEY STATEOFMINNESOTA ANORDINANCETOPROVIDEFORTHEINSPECTIONOFPROPERTY TODETERMINEILLEGALCONNECTIONSTOTHESANITARYSEWERSYSTEM, TOPROVIDEFORCERTAINREIMBURSEMENTSTOPROPERTYOWNERSOF EXPENSESRELATEDTOCOMPLIANCEWITHCONNECTIONREQUIREMENTS, ANDTOPROVIDEASURCHARGEFOR NON-COMPLIANCEWITHINSPECTIONANDCONNECTIONREQUIREMENTS TheArdenHillsCityCouncilherebyordainsthatSection1010.10Subdivision8-11are herebyaddedtotheArdenHillsCityCodetoreadasfollows: Subdivision8.ProhibitedConnectionsofSurfaceWaterandGround WaterDischargeFacilitiestotheCity'sSanitarySewerSystem. A.Noperson,owner,lesseeoroccupantofanyparcelofland,building, orpremisesshalldischarge,orpermittobedischarged,directlyor indirectly,intothesanitarysewersystemanysurfacewateror groundwaterincludingwaterfromroofs,yards,lawns,streets,alleys, groundwatersumppumps,footingtile,orothernaturalprecipitation. B.Asumppumpdischargesystemshallnotbeconnecteddirectlyor indirectlytotheCity'ssanitarysewersystem.Asumppumpshallhavea permanentlyinstalleddischargeline,whichprovidesforyear-round dischargetoeithertheoutsideofabuildingorstructure,orisconnectedto theCitystormsewer. Thesystemshallconsistofadischargelinewithoutvalvingorquick connectionsorflexiblesections,whichallowstheredirectionofthesump pumpdischargeintothesanitarysewersystem.IfconnectedtoaCity stormsewer,thesystemshallincludeacheckvalveandanairgap. Everyperson,owner,lesseeoroccupantofanyparcelofland,buildingor premisesthatdischargesintotheCity'ssanitarysewersystemshallallow anemployeeofthecityoradesignatedrepresentativeoftheCityto inspectthebuildingorpremisestoconfirmthatthebuildingorpremises conformstotherequirementsofSubdivision8ofthissection. InlieuoftheCityinspection,theowner,lesseeoroccupantmayfurnisha certificatefromaCityregisteredStatelicensedplumbercertifyingthatthe buildingorpremisesareincompliancewiththerequirementsof Subdivision8.TheCitymayperiodicallyre-inspectanybuildingor premisestodeterminecontinuedcompliancewiththerequirementsof Subdivision8. Subdivision10.RemovalofProhibitedConnections;Surcharge;City Reimbursement Anyperson,owner,lesseeoroccupant,andanyplumberorbuilding contractorwhohaspresentlymadeorpermittedtobemade,orshallmake orpermittobemade,anyconnectionorinstallationinviolationof subdivision8,shallimmediatelyremovesuchconnectionorcorrectsuch aninstallation.TheCitywillreimburse50%ofthecostofremovingor correctinganillegalconnectiontobringthepropertyintocompliance,toa maximumof$300.00. Ifnotremovedorcorrectedwithinsixtycalendardaysafternoticeofthe violationhasbeendeliveredpersonallyorbycertifiedmailtosuchperson, owner,lesseeoroccupant,theCityshallimposeasurchargeintheamount directedbytheCityCouncil.Suchasurchargeshallalsobeimposedupon anypropertyowner,lessee,oroccupantwho,withinsixtydaysof receivingnoticeoftheneedforaninspection,failstomakeorkeepa scheduledappointmentfortheinspectionoftheirproperty,hasnot allowedtheirpropertytobeinspected,orfailstoprovidethecertificate fromaCityregisteredStatelicensedplumberasrequiredbySubdivision Theowner,lessee,occupantofabuildingorpremisesfoundtobenotin conformanceasrequiredinSubdivision8duringperiodicre-inspections shallbesubjectedtoasurchargeasprovidedinSubdivision10,forall monthsbetweenthetwomostrecentinspectionsoramaximumchargenot toexceedtwelve(12)monthlysurcharges. Surchargesforbuildingsorpremisesthatarenotinconformancewith Subdivision8willbedeterminedbytheCityCouncil. EffectiveDate. OrdinanceNo.2009-005shallbecomeeffectivethedayfollowingits publication,orthepublicationoftheOrdinanceSummaryintheCity'sofficialnewspaper. CITYOFARDENHILLS COUNTYOFRAMSEY STATEOFMINNESOTA th Onthe13dayofApril,2009,theArdenHillsCityCounciladoptedOrdinanceNo. 2009-005,andbyatleastfour/fifthsaffirmativevotespursuanttoMinn.Stat.§412.191,Subd.4, directedthatasummaryofOrdinance2009-004bepublished. Chapter10,Section1010.10Subdivisions8-11arecollectivelyknownasOrdinance 2009-005entitled"AnOrdinanceToProvidefortheInspectionofPropertytoDetermineIllegal ConnectionstotheSanitarySewerSystem,toProvideforCertainReimbursementstoProperty OwnersofExpensesRelatedtoCompliancewithConnectionRequirements,andtoProvidea SurchargeforNon-CompliancewithInspectionandConnectionRequirements."Theprimary purposeofthisordinanceistoremoveillegalconnectionsbetweensumppumpsandthesanitary sewersystemtoeliminateinflowintothesanitarysewersystem.
