1C Lift Station #7 Update
~ GregHoag,PublicWorksDirector RonMoorse,CityAdministrator LiftStation#7,locatedonthePresbyterianHomespropertyonLakeJohannaBoulevard,and wasoriginallybuiltin1960.Theliftstationatthattimewasconstructedwithtwo10horse power(HP)pumps.Inthespringof2004,thisliftstationwasrebuiltandtwosubmersible5HP pumpswereinstalled.Theuseofsubmersiblepumpsisnowthecommonstandardforlift stations.Inthefallof2004,shortlyaftertheprojectwascomplete,Citymaintenancestaffwas beingalertedquitefrequentlytoalarmsattheliftstation.Thenewpumpswerebecoming cloggedwithragtypedebrisbeingdischargedfromPresbyterianHomes. Inthespringof2005,aseriesofmeetingswereheldwithCitystaff,theCityEngineer,and representativesfromPresbyterianHomestodiscusspotentialsolutionsforthepumpsclogging. TheCity'spositionatthesemeetingswasthatPresbyterianHomesshouldtakecareoftheissue inaseparatestructurewhichtheywouldmaintain.PresbyterianHomesfeltitwasunreasonable tomaketheminstallaseparatesystemandpreferredthatwhateverremedywasaccepteditbe withintheCityliftstation.Thecompromisewastoinstall10HPchopperpumpsinplaceofthe existing5submersiblepumps. Thechopperpumpswereinstalledinthesummerof2005.Foraperiodofabout18months,it appearedthatthechopperpumpswereworkingandwereanacceptablesolution.Negotiations continuedwiththeCityandPresbyterianHomesastowhowasfinanciallyresponsibleforthe newpumpsandcostsrelatedtoon-goingmaintenance.Inlatesummerof2008anagreement wasfinallyreached.PresbyterianHomeswouldberesponsiblefortheinitialcostof$28,069for thechopperpumpsandanymaintenanceandrepaircostsbeyondwhatanormalliftstation incurs.(Seeattachedagreement) Since2006,citystaffandrepresentativesfromPresbyterianHomeshaveheldseveralmeetings tocontinuetodiscussissueswithragsandothermaterialstillcloggingthechopperpumps,as wellastheincreasedtimeandcostsformaintenanceandrepaircomparedtoourotherlift stations.Ourpublicworksstaffiscurrentlyrespondingtotheliftstationtwotothreetimesa monthtodealwithcloggingissues,comparedtoanaverageofonceperyeartoanyofourother thirteenliftstations.Citystaffhascontinuedtolookatandevaluateabettersolutionforthis issue. Currentlyboth10HPchopperpumpsareinneedofsubstantialrepairs.Itisestimatedthatthe costtorepaireachoneofthesepumpscouldcost$12,000each.Theestimatedcosttoreplace thesepumpswithnewchopperpumpsis$18,500each.($24,000-$37,000intotalrepairor replacementattimeofinstallation.) StaffhasspokenwithseveraldifferentvendorsaswellasanengineerwithBoltonandMenk regardingpossiblesolutionstothisongoingissue.Oneofthepotentialsolutionsistopurchase andinstalltwonew10HPnon-chopperpumps.Thecostforthesepumpsisapproximately $9,000each.($18,000forbothpumps)Thiscouldpotentiallyprovidealongtermsolution,but thepumpswouldbecloselymonitoredforproblems.Ifthe10HPpumpsdonotprovidean adequatesolution,theywouldstillberetainedifamoreextensivesolution,suchasinstallinga largein-linegrinderto"pre-treat"thedischargepriortoitreachingtheliftstationwas implemented.IndiscussionswithrepresentativesfromPresbyterianHomes,theyhaveindicated thattheyareplanninganexpansionofthefacilityinthenexttwotothreeyears.Wehaveasked themtoincorporateintotheirplanninghowtheywillpre-treattheirdischargetotheliftstation. Oneoptionforthemtoconsideristheinstallationofaninlinegrindertotreatthesewage dischargebeforeitenterstheliftstation.Thecostofthisisapproximately$27,000andwillhave repair/maintenancecostsofapproximately$6,000-$7,000everysevenyearsorso. Itisrecommendedthat,atthistime,theCitymoveforwardwiththepurchaseandinstallationof thetwo10HPnon-chopperpumpstoprovidealessexpensivealternativetotherehabilitationof thechopperpumps,andtodetermineiftheyprovideanadequatesolution.Staffwillalso continuetoevaluateandworkwithPresbyterianHomesontheneedandtheproperlocationfor sometypeofapretreatmentsystem,suchasanin-linegrinder. RECOMMENDEDCOUNCILACTION StaffisseekingCityCouncilinputanddirectionastohowtoproceedinresolvingthelongterm issueswithliftstation#7. THISAGREEMENTismadeandenteredintotobeetlectivethedayof 2008byandbetweentheCityofArdenHills,aMinnesotastatutorycity(the ~sbyterianHomesofArdenHills,Inc"aMinnesotanon-profitcorporation ('PresbyterianHomes), A.TheCityownsandoperatesacertainliftstationwhichreceivessewagefromthesouthwest portionoftheCity('LiftStation#7), B.PresbyterianHomesownsafacility(the"racility)withintheCity,thesewagelromwhichis directedtoLiftStation #7, C.In2005,itwasdeterminedthatsewagedischargedbytheFacilitywascloggingorotherwise causingdamagetothepumpswhichwerethenlocatedinI"iftStation(the''5HPPumps). D.TheCityhasanordinancethatprohibitsthedischargeofobjectionablematerialsintothe municipalsanitarysewersystem. E.PresbyterianHomesagreedtoreplacethe5HPPumpswithtwosubmersiblechopperpumps (the"ChopperPumps)whichwereinstalledatLiftStation#7intheSummerof2005, F.TheCity'sexperiencewiththechopperpumps.intheshorttimesincetheirinstallation,has beef!thatthematerialsdischargedbyPresbyterianHomesintothesanitarysewersystem continuetocausesubstantiallymoremaintenanceoftheliftstation.andhaverequiredthe needforexpensiverepairstothechopperpump~ G.AnagreementbetweentheCityandPresbyterianHomesisnecessarywithrespecttothe clarificationofcertainmattersregardingtheinstallation,maintenance,repair,and replacementoftheChopperPumps.Thepartiesnowwishtomemorializetheir understandinginwriting. Therefore,forgoodandvaluableconsideration,thereceiptofwhichisherebyacknowledged, theparticsheretoagreeasfollows: 1.CitvsResponsibilities.TheCityshallberesponsiblelbrthecostsandexpensesrelatedto themaintenanceandrepairoftheChopperPumpsatthenormallevelassociatedwiththe Citvsregularliftstationpumps. TheCityshallalsocooperatewithPresbyterianHomesregardingthemonitoringofthe chopperpumpoperations,andindetermininganoptimal.longtermsolution. 2.PresbyterianHomesResponsibilities.PresbyterianHomesshallberesponsibleforthecosts andexpensesrelatedtothemaintenanceandrepairgftheChopperPumpsthatisbeyondthe normallevelassociatedwithregularliftstationpumps.Thisshallinclude.butnotbelimited to.purchasingany'}jparepartskits'relativetotheChopperPumps. PresbyterianHomesshaHberesponsibleJ()rthereplacementoftheChopperPumps.The detemlinationofwhentheChopperPumpsshallbereplacedshallbemadebytheCityinits reasonablediscretionapplyingthefoUowingcriteria:ifaChopperPumpneedsarepair,the costofwhichisinexcessof50%ofthereplacementcostoftheChopperPump,theCity shallapplyitsusualandcustomarycriteriatodeterminewhetherornottheChopperPump shouldbereplacedorrepaired.IftheCitymakesdeterminationthattheChopperPump shouldbereplaced,PresbyterianliomesshallpaytotheCitythecostofthereplacement ChopperPumpwithin)OdaysofbeingnotifiedthereofbytheCity. PresbyterianHomesagrees.toimplementaprogramthatwilleducateitsemployeesand residentsabouttheadverseeffectsofdischargingobjectionablematerials,induding,butnot limitedto,cloth,rags,orsimilarmaterialsintothemunicipalsanitarysewersystem. PresbyterianHomesshaHalsocooperatewiththeCityregardingthemonitoringofthe dischargeofobjectionablematerialsintothemunicipalsanitarysewersystem.themonitoring ofthechopperpumpoperations,andthedeterminationofanoptimal,longtermsolution. 3.NoWaiver.Nothinghereinshallbeinterpretedasa\vaivcrbytheCityoftheobligationof PresbyterianHomestocomplywithalloftheeitysregulationswithrespecttotheuseofor dischargeintotheCityssanitarysewersystem. 4.BillofSale.ContemporaneouswiththeexecutionofthisAgreement,PresbyterianHomes shallexecuteanddelivertotheCitytheBillofSaleinsubstantiallythesameformasthe attachedExhibitA. 5.BindingEffect.ThisAgreementshallbindandinuretothebenefitofthepartiesheretoand theirrespectivesuccessorsandpermittedassigns. 6.EntireAgreement.'rhisAgreementrepresentstheentireagreementandunderstanding betweenthepartiesconcerningthesubjectmatterhereofandsupersedesallprioragreements, whetherwrittenororal,relatingthereto. 7.ModificationandWaiver.Nopurportedamendment.modificationorwaiverofany provisionhereofshallbebindingunlesssetforthina\\-Tittendocumentsignedbyallparties (inthecaseofamendmentsormodifications)orbythepartytobechargedthereby(inthe caseofwaivers).Anywaivershanbelimitedtothecircumstanceoreventspecifically referencedinthewrittenwaiverdocumentandshallnotbedeemedawaiverofanyother termhereoforofthesamecircumstanceoreventuponanyrecurrencethereof. 8.NoThird-PartvBenefit.NothinginthisAgreement,expressorimplied,isintendedtoconfer onanypersonotherthanthepartiestothisAgreementortheirpermittedsuccessorsor assigns,anyrights.remedies,obligations,orliabilitiesunderorbyreasonofthisAgreement. thepartieshaveexecutedthisAgreementasofthedayand INWITNESSWHEREOF. yearfirstabovewritten.
