SUBJECT: 1-694 Municipal Consent-Appeal Board Presentation
Background
Staff has been informed that the Appeal Board presentations will be on April 19, 2011.
Staff is waiting for the official letter from the Board to tell us the time and place. Staff
believes the City will be given a two hour timeframe to make their presentation. At
tonight's work session staff would like to discuss the following items:
• General outline for the City's presentation
• How many Councilmembers will be attending and how many want to make a
portion of the presentation
• What does the Council want from Mn/DOT beyond what has been offered
• Should the presentation include any citizen portions and if so, who and how many
City Council Meeting

SUBJECT: Appeal Board Presentation
Background
The attached letter regarding the Appeal Process arrived on Friday, April 8, 2011. This
letter states that the Appeal Board will be meeting on Tuesday, April 19, 2011, from 9:00
a.m. to Noon. The meeting location will be at the Mn/DOT Training and Conference
Center(Room 10) in Shoreview. The address is 1900 West County Road I.
This Appeal Process letter outlines the timetable for the three hour meeting and states that
each party will have 60 minutes for their presentation. The letter also requests the
submission of written materials by the end of the day on Friday, April 15, 2011.

In conjunction with the upcoming Appeal Process scheduled for April 19, 2011, the Appeal
Board believes it would be beneficial to receive written materials supporting your respective
positions by the end of the business day on Friday: April 15, 2011. -
Included in your written materials should be a specific delineation of the issues you believe
have been resolved and the issues you believe remain in dispute between Mn/DOT and the
City of Arden Hills.
Your written submissions should be sent and emailed to the Appeal Board members at the

Time and Location of Appeals Board meeting:
9 a.m.— 12 noon
Mn/DOT Training and Conference Center
Room 10 -
1900 West County Road I
Shoreview, MN 55126
On April 19, 2011, the hearing process will be as follows: -
1) Mn/DOT, as appellant, shall be the first to present its position.
2) The City of Arden Hills, as respondent, will proceed with its presentation following the
Mn/DOT presentation.
3) Each side will have up to 60 minutes for its presentation. Each side will have up to 15
minutes for rebuttal_
4) The Appeal Board reserves the right to make inquiries of each party during or
subsequent to their presentation. The Appeal Board, at its discretion, may enlarge the
presentation time.of a party to adjust for any time expended responding to inquiries
made by Appeal Board members during a presentation.
5) Either party may supplement its presentation with visual materials.
6) The Appeal Board will allow each party to make supplemental written submissions within
15 days following the close of the hearing.
The Appeal Board will snake its determination within 60 days following the conclusion of the
hearing.
