Back�round
Trinity Lut�ieran Church is located at 3245 New Brighton Road. The properry is a four and a
half acre parcel surrounded on two sides �y Hazelnut Park, a Caty-owned park property. The
Chu�ch property is zaned R-2. Trinity Lutheran Church and the Ciiy af Arden Hills are in the
process of negotiating a purchase agreement for the sale of a 71,474 square-foot section of land
that would be subdivided from ihe Church's existing property. This subdivided parcel would be
consolidated with Hazelnut Park and ma.intained as parkland for the public {Lot 2), The eastern
portion, cansisting of 127,6�4 square feet, would remain undex the Church's ownership (Lot 1}.
Locafed within the parcel currently owned by Trinity Lutheran Church is a congregation ha.il,
parl�ing lot, soccer field, identif catian sign for Haze�nut Park, and irail entrance to the paxk.
Hazelnut Park contains a large variety of recreational �acilities and is a heavily used park. The
City has a contract with ihe Church for the shared use of the parking lot, which acts as the only
designated parking area for Hazelnut Park, in exchange for $1,000 per year in shared snow
plowing expenses. in addition, the City restripes the parking lot after it has been seal coated as

we11 as provides sporadic repairs as has beean needed from time ta time. No other agreements
currently exist ihat formalize the City's use of any oiher aspects of the Church's property. In the
past, the City has usec� the saccer field �or programming; however, in recent years the condition
of the fiel�. has made ii undesirable for scheduled events. Because the City does not own the
f eld, it has not been invested in with regular maintenance, irriga�ion, or fertilization, as would be
done with a City-owned field.
The application consists of four components: a Preliminary Plat, Final Plat, Master pUD, and
Final PUD. The Preliminary and Fina1 Plat is necessary to subdivide the property and file the
subdivision with the County recorder. Subdividing the current parcel into the two proposed lots
would cause the Church's remaining property to become non-conforming within the R-2 District
since it would reduce the required amount of landscaped coverage an their parcel. There%re, the
applicant rnust receive a Planned Unit Development (PUD) in arder to proceed with the
subdivision and al�ow for the reduction of landscaped coverage. The Planning Com�nission
reviewed this application at their April 6 meeting and unanimously recominended approval of
the subdivision and PUD. The �inutes from this meeting are included as Attachment A.
The applicant has submitted an applicaiion and Pre�irninar�r Plat illustrating the proposed
subdivision of Iand, which was included in the packet �hat went ta #he Planning Commission and
is contained in Attachment C.
Findin�s of Fact
The Planning Commission offers the foIlowing findings of fact for the City Council's
consideration:
General Fir�dings:
1. Parks are a permitted use in the R-2 Dis�'ict
2. The proposal is not anticipated to adversely impact nearby properties through nuisance,
noise, dust, glare, or unsightliness, anc� will not otherwise adverse�y impact tb.e health,
safety, and welfare of the community. No construction activity is anticipated as a result
a� �his application, and the sale of the property to the City will increase the City's
parkland and open space area.
3. The proposal wauld r�ot increase parking and traff c on the site compared to existing
conditions. In addition, tkie City will continue io provide maintenance and snow removal
�or th� parking area subject to a successful signi�g of a purchase agreement and closing.
4. The proposal is in keeping with many of the principles listed in the 2030 Comprehensive
Plan ta develop and encourage �se of park space.
5. There are no delinquent property t�es, special assessrr�ents, interest, or City utility fees
due upan the subject parcel.
6. The utility, sewage, and pedestrian easement requirernents are znet by the proposed plan.

Planned Unit Development Review Findings:
1. The Master and Final PUD process allows flexibility with the implementation of the
City's subdivision and zoning regulations.
2. AIl Zoning requirements are m�t by the proposed plans with the �xception of landscaped
lot coverage far Lat 1.
3. The land. to be transferred to the City will remain as parkland and apen space in
perpetui�y.
4. No additional impervious surface will be canstructed as a result of this application.
Recommendatian
At their April 6 meeting, the Planning Commission voted unanimously to recommend approval
of Planning Case #11-005 for a Preliminary and Final Plat, and Master anc� Final PUD at 3245
New Brighton Road subject to the following conditions:
1. The appraval of the purchase agreement by the City Council.
2. The applicant shall f le the Final Plat with Ramsey County wiihin 180 days of City
approval, or the approval for the Final Plat shall expire, unless extended by the City
Council prior to the approval's expiration. Extension requests rz�ust be submitted in
writing to the City at least 45 days priar to the expiration date.
3. A shared parking lot agreemen� sha11 be sxgned by the property owners and the City
gxanting the Cit� perpetual use of the Church's parking lot for Hazelnut Paxk users,
and recorded with the County
4. A parking lot maintenance agreement shall be signed by the praperty owz�exs and the
City, and filed at the City.

Lutheran Chr�rch and the City of Arden Hills; 3245 New Brighton Road — Public Hearing
City Planner Meagan Beekman stated the applicant, together with ihe City of Arden
Hi11s, has requested a Preliminary and Final Plat and Master and Final Planned Unit
Development (PUD) to allow far tk�e subdivision of the property lacated at 3245 New
Brighton Road. The City is currently negoiiating with ihe applicant to purchase the
subdivided parcel and permanently consolidate it with Hazelnut Park. Sk�e provided
additional background information.
City Pla�ner Beekman stated the Planning Commission must make a finding as to
whether or not the propo�ed application meets the requirements of the Zoning Code, and
advances the surraunding neighborhood or the community as a whoie. Staff offers the
fo�lowing ten Findings for consideration:

Chair Larson asked if the parking lot would b� upgraded or �he amount of impervious
sur�ace reduced.
City Planner Beekman stated the size af the parking iot wauld not be reduced anc� the
City would maintain the current agreement regarding the parking lai which is $1000 per
year for snow renzoval a.nd the City will occasio�ally f 11 pot holes in the parking lot and
stripe the lot as needed.
Chair Larson opened the public hearing at 6:3 8 p.rn.
