The question of who is notified when a public hearing is to be held was raised by members of the Council and residents of Arden Hills, as well as neighboring communities. State statute requires that cities notify all property owners within a minimum of 350 feet of a subject property for all public hearings. In Arden Hills it is our practice to notify all property owners within a minimum of 350 feet of a subject property for all planning cases pertaining to private property, even when a public hearing is not required. Furthermore, depending on the nature of the planning case, the anticipated impact of the project, and the geography of a particular area, the 350-foot distance has been extended in the past to encompass a greater area. For example, for the Fox Ridge subdivision, because of the significance of that project, the notification area was extended to 1,000 feet. Discussion Different communities have varying policies when it comes to notification requirements. The following table identifies recent planning cases the City has reviewed and the number of properties that would have been notified given a specific distance from the subject property. If the notification distance is increased significantly, it may require a review of the City’s fee schedule to ensure that all application costs are covered by the fees charged. Requested Action Discuss notification requirements and provide direction to Staff on a City policy that would identify appropriate notification distances.
