The applicant received approval from the City for P�anning Case 11-006 for a Preliminaxy
�'lat and Comprehensive Plan Amenclment on April 25, 2011. The Planning Cornmission
held the public hearing and xeview on April 6, 2011, arid unanimously recommended
approval for Planning Case 11-006.
The appiicant has since revised their preliminary plat subject to the conditions of approval
from Planning Case 11-006 and. has submitted for Final Plat approval. The p�rpose of a
Fina1 Plat application is to review the proposed development for conforrnance witlz the
approved preliminary plat, and to finalize the conditions of approval for inclusion in a

The applicants have submifted a finai plai and site plan ihat include reviszons required as part
of the conditions of approval of the preliminary plat {Attachment D).
The application also includes a request to vacate a certain utility, drainage, and uiility
easement that is Iocated within the proposed Fox Ridge development. Easement vacations
require a public hearing before the Ciiy Council. Th� easernent is for an overflow }�ipe that
discharges overflow water from the Keithson pond south to a storm wate� pond on the Fox
Ridge property. As part of the developFnent, the pipe will continue to function; however, wi�l
�e moved slightly to accommodate the new roads and lots. As a result, the easement also
needs to be adjusted. The City would vacate the existing easement contingent on the filing of
the Final Plat, which dedicates new easements to the City that encornpass the ne�r lacation of
the pipe.
Plan Eval�ation
The Final Plat {Attachment D) has been revised frozn the Preliminary Plat as follows:
1. A trail easement has been extended tliraugh Block 4, Loi 18 to accommodaie an east-
west trail cannection from Keithson Drive to the north-south trail to the east.
2. Block 1, Loi 10 has been further subdivided to create fwo outlots. The 50-foot vvide
"stovepipe" portion will no longer be included as part of Block 1, Lot 10.
3. The lot frontages oi Block 1, Lot 3, and Block 4, Lots 9 and 1 p have been widened to
a minimum oi 105 feet.
4. The right af way adjacent to Blockl, Lois 10 and I 1, has been squared off to bxing
the loi frontage on both lots to a minimum of 95 feet.
5. The drainage and utility ease�nent has been extended in the rear yarc� af Block 4, Lot
18
Findin s of Fact:
The Planning Commission offers the following sixteen findings of fact for �his proposa�:
General Findings:
1. The Fox Ridge subdivision is comprised of 20.07 net acres.
2. The Fox Ridge subdivision property is zonad R-1, Single-fa�niiy Residential.
3. The City approved a Comprehensive Plan Arnendment (CPA) on April 25, 2011, re-
designating ihe property as Very Low Density Residential on the 2430 Future Land
Use Map, subject to the approval of ihe Metrapolitan Council.
�. The applicant is proposing to re-plat the property into 39 conforming single-family
lots.

5. The subdivision will cannect to the City's existing s�reet system at three points:
Sn�lling Avenue N, Keithson Drive, and Royal Hills Drive.
6. The praposed plan meets aIl af the requixennents of the City's Zoning and Subdivision
Codes.
7. The proposed plan is in conformance with the City's Comprehensive Plan, contingent
on approval of the CPA by the Metropolitan Council.
S. The Final Plat application co�forms to the approved Preliminary Plat as amended by
the conditions of approval of the Preliminary Plat.
Recommendation
The Planning Commission reviewed Planning Case 11-009 and unanimously recommended
approval of t�.e �inal Plat and Easement Vacatian at 4500 Snelling Avenue North, based on
tlie findings af fact and the submitted plans as amended by the following conditions:
1. The project shall be completed in accordance with the submitted p�ans as
amended by the conditions of appraval. Any signif cant changes to these plar�s,
as determined by the City Planner, shall require review and approval by the
Planning Coirunission and City Council.
2. E�ecutian of the Final Plat shall be contingent upon the Metropalitan. Council's
approval of the Coinprehensive Plan Amendnaent.
3. A development agreement shall be prepared by the City Attorney and subject io
City Council approval. The de�elopment agreement sha11 be executed priar to
execution of the Final Plat.
4. The easement vacation shali be contingent an the iiling of the Final Plat with
Ramsey County.
5. The applicant shall construct an east-west boardwalk connection from Keithson
Drive to the north-south trail east of the development, subject to the approval of
the Public Works Director. The cost o�the construction of the trail shall be
deducted from a cash payment requirement of $133,248. The City shall use the
park dedication to expand the Ciiy's parks, trails, and recreation system.
6. The applicant sha11 submit a financial suret�, subject to the approval of the City
Attorney, �ar 125 percent of ihe cost of the lazldscaping improvements prior to the
issuance of any development permits.
7. The applicant shall submit a financial surety, subj ect to the approval of the City
Attorney, for 100 percent of ihe cost of site grading, xetaining walls, utiiities, and
street improvements prior to the issuance of development permits.
$. The proposed praject may require permits, including, bui not limi�ed to, MPCA-
NPDES, Rice Creek Water�hed District, Minnesota Department of Health,
MPCA- Sanitary Sewer Extension, Ramsey County and City Right of Way, and
City Erosion and Sedi�nent Control per�nits. Copies of alI issued permits shall be
provided to the City pxior to the issuance of any development per�nits.

9. Final grading, drainage, ar�d utiliry plans shall be subject to approval by the Public
Works Director arad City Engineer prior to the issuance of any developmeni
permits.
10. The plans shall be subject to Fire Marshal approval before development permits
are issued.
11. The applicant shall camplete grading activity and install the first lift of
bituminous sur�acing prior to the issuance of any building permits, r�vith the
exc�p�fon of those ho�z�es along Arden View Drive.
i 2. Sanitary sewer and water shall be accepted by the City and ready for hookup prior
to the issuance of any building permits.
13. The applicant shail submit a Deveiopment Plan, subject to tk�e approval of City
StafF, p�ior to the issuance of any building permits. The Development Plan shall
provide as-built grading information together with the style and minimum
elevations for the hause on each lot.
14. There shall be no construction traffic oui o�the site at Royal Hills Dr/Arden View
Dr or Keithsan Dr. Ali construction traffic shall enter and exzt the site from
Snelling Ave N, with the exception of the homes to be canstructed along Arden
Vier�cr Dr. �
15. A copy of the home owners' associatian (HOA) documents shall be kept on file
with ihe City, and shall clearly state that the HOA shall be responsible for
maintenance of all retaining walls associated wiih th� approved grading plan. The
HOA documents shall aIso define the wetland buffer areas and prohibit any larnd
alteratioan activity wiihin th�m.
I6. The City shali not be responsible for the maintenance of any outlats associated
with the developmeni.
17. The applicant shall be responsible far implementing the landscapi�g plar�. AIl
landscaping materials shall be put in place as the approved grading pian is
completed with the exception af the req�ired two front yard trees and three rear
yard trees, which shall be the responsibilxty of the applicant ta install at the time
each �ouse is constructed.
18. The applicant shall install wetland monument signs, subject to the approval of the
Public Warks Director, to adequa�ely def ne the wetland buffer areas.
19. The applicant sha11 canstruct a minimum of five home designs wiihin the
develop�nent.

Ciiy Planner Meagan Seekman stated the applicant is requesting approval of a Final Plat
far the property lacated at 4500 Sneiling Avenue North to subdivide the parcel into 39
conforming single-family lots. The applicant received approval fram the City far
Planning Case 11-006 for a Preliminary Plat and Co�nprehensive Plan Amendment on
Apri125, 2011. The Piar�ning Commission held the ptxblic heaxing and review on April 6,
2011, and unanirz�ously recommended approval for Plannin.g Case 11-006. She provided
additional background information including the Final Plat has been revised from the
Preliminary Plat as follows:
1. A trail easement has been extended through Block 4. Lot 18 to accommodate an east-
west trail connection from Keithson Drive to the north-south tra.il to the east.
2. Block l, Lot 10 has been further subdivided to create lwo outlots. The 54-foot wide
"stovepipe" portion will no longer be included as part of Block 1, Lot 10.
3. Th� lot frontages of Block 1, Lot 3, and Slock 4, Lots 9 and 10 have been widened to

4. A development agreement sha11 be prepared by the Ciiy Attorney and subject to the
Ciiy Council approval. The development agraement shall be executed prior to
execution of the Fina� Plat.
5. The applicani sha11 construct an east-west boardvcralk connection from Keithson Drive
to the north-south trail east of the development, subject to the a�proval of the P�blic
Works Director. The cost of the construction of the trail shall be deducied from a

Commissioner Zimmerman asked if the final plat included the road extension to Kei�son
Drive or if an option to add one or two cul-de-sacs had been approved.
Beekman tha City Council had discussed ti�e options of ihe dual c�l-de-sac and the
thraugh street to Keithson Drive. The preliminary plat that was approved included an
extension of Keithson.
Chair Larson asked i�#he road would be in the designated location an the plat.
City Planner Beekman stated the final determinatian for the road location will be
determined b� the �'ublic Works Directar.
Commissioner Hames asked about t�e trail over ihe wet�ands and if these wouid be
constructed by the developer.
City Plannex Beekman stated the developer would be canstructing a floating boardwalk
over the wetland areas that will cor�nect the road to the trail. It will likely be constructed
o�t of a composite rrxaterial.
Commissioner Holewa moved and Commissioner Scott seconded a mo#ion to

WHEREAS, ihe Arden Hills City Co�ncil canducted a public hearing on the lst
day of �une, 2011, preceded by mailed and published notice, as required by Minnesota
Statutes 412.851 and 462.358, subd. 7; and
WHEREAS, ihe purpose of the public hearing was to consider the vacation of the
public's interest in:

DEVELOPMENT AGREEMENT

1.0 Parties. This Development Agreement is dated the 1St day of June 2011, and is entered
into by and between the City of Arden Hills, a Minnesota. statutory ciry ("City") axzd Pulte
Homes of Minnesota LLC, a Minnesota limited liability corporation {"Developer").
2.0 Recitals.
A. The Estaie of George Reiling is th� r�cord fee owner a� the fallowing property
located in the City of Arden Hills, Ramsey County, MN ("Property"):
The Nortnwest Quarter of the Northwest Q�at-�er (NW '/4 of
NW 1/a) of Section 22, Taysmship 30, Range 23, except the
following parcels:
Parcel 1: The South 10Q feet of the West 435.06 feet
thereof;
Parcel 2: The East �}50 feet of the West 715 feet of ihe
North 342 feet thereof;
Parcel 3: The North 150 feet of the South 550 feet of the
West 290 feet thereof;
Parcel 4: The East 130 feet of the West 895 feet of the
North 342 feet thereof; and
Parcel 5: That part thereof platted as Keithsan Addition,

B. Developer has signed a contingent Real Estate Purchase Agree�nent to acquire the
Property from the Estaie of George Reiling.

4.0 City Council Review and Approval. On the ls� day of Jur�e, 2011, the Arden Hills City
Council reviewed the Developm�nt Application, the reports and comments of the City
staff and consuliants; any reports and coz�rzznents provided by the Developer; the
recomznendations of the City Planning Commission; and approved ihe Final Plat of Fox
Ridge subject to the terrns and canditions contained herein.
5.0 Terms and Conditio�s. In consideration of the City's Final Plat appro�al; in
cornpliance with tbe City's Development Regulations; and in consideration of the
Developer's undertakings e�pressed herein, the parties, for themselves, their successors
and assigns, agree:
A. P_roieci Plans. The Property will be deve�oped in compliance with the following
plans and specificafions, Iast dated May 13, 20i 1{"Project Plans"}, which will be
re�a.ined iz� Arden Hills Planning File Nos. PC 11-006, for the Preliminaxy Flat
ApprovaI, anc1. PC 11-OQ9, for the Final Plat approval:
i. Fox Ridge Fina1 Plat (Sheets 1-3}.
2. Fox Ridge — Storm Watex Pollution Preveniion Plan, revised May 12,
2011 (Sheets 1-3)
Fox Ridge — Final Plat Subrnittal, dated May 13, 2011 {Sheets 1- 21).
B. Development Improvements. All of the following Development Ymprove�nents
shall be constructed pursuant to the approved Project Plans.
Type of Im�rovement and Completion Date.
a. Street. Grading activity and install o� the first lift of bituminous
surfacing sha11 be completed prior #o the issuance of building
permrts, with the exception of those homes along Arden View
Drive. Street irnpro�ements include subgxade, preparation, gravel
base, bituminous surfacing and concrete curbs and gutters shall be
completed prior to the issuance of occupancy permits �or any of
the residential dwellings.
The improved portion of Keithson Dxive as located adjacent to an.d
northerly of proposed Lots 1b and 17, Block 4, Fo� Ridge, shall be
within five (5) feet of the northline of such parcels and not iess
ihan twenty (20) feet southerly of the southline of Lot 7, Block 1,
Keithson Addition.
b. Gradin�. Grading aciivzty improvements shall inclnde comman
excavation, subgrade correction, embankment and pond

excavation, and the construction of retaining walls. Turf
restoration shall include seeding, mulching and erosion control.
c. Storm Sewer. Stortn sewer improv�ments include all necessary
siorm sewers, catch bases, culverts, and other apparatus and
ponding areas. Developer shall obtain all appropr�ate permits from
the Rice Creek Watershed District. The storm sewer
improvements sha11 b� corr�pleted by the 31 St day of October, 2011.
d. Sanitary Sewer and Water. Sanitary sewer and water
improvements including sanitary sewer maintenance, conneciions
and appurtenances, shall be accepted by the City and ready for
hookup prior to the issuance of any building permits.
e. Landscap�. The applicant shall be responsible for impleme�ting
the Iandscaping plan. All landscaping materials shall be put in
place as the appraved grading plan is completed with the exception
of the req�ired two (2) front yard trees and three (3) rear yard trees,
which shall be t1�e responsibiiiry of the app�icant to install at the
iime each ho�se is constructed.
f. Wetland Monuments. The applicant shall install wetland
monutnent signs, subjeci to the approvai of the Directar of Public
Works, to adequately define the wetland buffer areas.
g. Street Signs. Standard City street signs shall be installed priar to
the issuar�ce of any occupancy perxxiits.

3. Impravement Secu�rztX. Prior to the issuance of any development ar
buiiding permits, Developer shall deposit security with the City
Administrator in an atr�ount equal to one hundred tweniy-five percent
(125%) af the City Engineer's estimated cost of constructing the
Developer's secured improvemenis. The security may be in the form of a
cash escrow fund, a performance bond, ar a Ietter of credit. The farm of
security shall be approved by the City Attorney.
4. Reduction of Improvement SecuritX. Upan completio� o� the required
Developer improvemenis for the Property, and acceptance by the City, the
City sha11 reduce the amount of security for the combined improvements
provided that, in na case shall the toial remaining �ecurity be equal to less
than 125% oi the estimated cost of the incomplete Developer
impravements.
C. Inspection/En ineerin F�ees. In addition to filing and application fees, the
Developer agrees to escrow engineering overhead and inspection fees. Developer
agrees to provide a cash escrow with the City for engineering overhead and
inspection fees in an amount equal to five percent (S%) of the estimated cost for
Developer constr�cted improvements. City Engineering costs and inspection fees
inc�rred by the City shall be charged against the escrow account. Any balance
remain�ng in the escrow account plus accrued interest on such balance shall be
returned to the Developer at the completion of the project.
D. Park Dedication. The applicant shall construct an east-west boardwalk
connection from Keithsan Drive to the north-south trail, east of the development,
subject to the approval of the Director af Public Works. The cost of the
construction of the traii shall be deducted from a cash payment require�nent of
$133,248.
E. Uiili Com an Im rov�ments. The utility improvements include underground
gas, electric and telephane services as installed by the apprapriate utility company
at the direction of t�e Developer. Developer shall arrange for the installation of
underground gas, electric and telephone s�rvices prior to the issuance of building
pe�its.
F. A�ency Permits. The proposed project rnay require permits, including, but not
liinited to MPCA-NPDES, Rice Creek Watershed District, Mixu�esota Department
of Health, MPCA-Sanitary Sewer Extension, Ramsey County and City Right-of-
vvay, and City Erosion and Sediment Control Permits. Copies of all isst�ed
permits shall be provided to the City priar to the issuance of Certif cates of
Occupancy for an.y building.
G. Building Lot.Plans. The applicant shall subrriit a developrnent plan, subject to the
approval of City Staff, prior to the issuance of an� biulding permits. The
development plan shall pravide as-built grading informaiion together wiih the
style and minimum elevations for the house on each lot.

H. Constructian Traffic. There shall be no constxuction out of the site at Royal Hzlls
Drive/Arden View Drive or Keithsan Drive. All construction traffic shall enter
and e�it the site frorn Snelling Avenue North, with the exception of the homes to
be consi�cted along Arden View Dri�e.
I. House Desi.�ptions. A minimum of five hame designs shall be constructed
within the development.
J. Execution and Recordin� of Documents.
1. Plat. The plat for Fox Ridge shall be recorded within 180 days o� the
City's approval of the plat.
2. Declarations and Covenants. Declarations and covenants shall be recorded
prior to the sale of any of fhe Property by the Developer and shall include
the follor�ving:
a. Maintenance of any outlots by HQA that are not trans�erred to
individual private property owners.
b. Maintenance of r�taining walls by HOA.
3. Homeowners Association Documents. The documents created �y the
HOA shall be recorded and �'iled prior ta the sale of any property by ihe
Developer.
6.0 Construction Mana�ement. Developer and its contractors and subcontractors shall
work to minimize impacts from constructian on su�ounding neighbarhoods by:
A. Definitian of Construction Area. Tk�e limits of the project area shall be defined
with heavy duty exosion control fencing of a design improved. by �the Directar of
Public Works. Any grading, construction ar other work outside af tl�.is area
requires approval by ihe Director of Public Warks and, if on private pxoperty, the
property owner.
B, Paz�king and Storage af Material. Adequate onsite parking for construction
vehicles and employees must be provided or provisions must be made to have
employees park off-site and be shuttled to the projeci area. No parking of
construction vehicles ar erz�ployee vehicies shail occur on that portion af Keithson
Drive e�tending southerly from Highway 95 io the project area or on Arden View
Drive. No fill, excavating rnaterial or construction materials sha.11 be stored in
public rights of way.
C. Haurs of Construction. Hours of construction, including moving of equipment,
shall be limited to the k�ours of 7:00 a.m. -'1:00 p.m. on weekdays and 8:00 a.m. —
6:00 p.m. on Saturdays, with no work permitted on Sundays or holidays.

D. Site Maintenance. The Deveioper shall ensure that contractors maintain a clean
work site. Measures shall be taken to prevent debris, refuse ar other materials
fxom leaving the site. Construction debris and other refuse generated from the
projeci shall be removed from the site in a timely fashion and/or on the request of
the City's Direcior of Public Warks. Developer shall sweep Keithson Drive and
Arden View Drive on a weekly basis ar mare frequently as directed by the
Direc�or of Public Warks until the project area is established. The Developer
must sweep roadways with a water discharge broom apparafus. Kick off brooms
sha11 not be utilized for street sweeping.
E. Cold Weather Co�stzuction. Public roads including concrete curbs and guttexs
shall nat be constructed on frozen ground. Upon evidenc� of frazen ground in the
project aggregate base/subgrade, all concrete and bituminaus woxk shall cease for
the construction year. No bituminous base paving or concrete pouring will be
a1lo�ved aftex November 1 S� of the calendar year. Work may not be performed
after November 15� without the consent of th� City's D�rector of Public Works,
and if permitted, such wark shall comply with MnDQT SPECS.
1. As Builts.
a. Developer shall provide the Ciry with as-builts for all public
infrastructure wluch will be dedicated to the City as part of the
development of Fox Ridge.
b. Prior ta the issuarice of a Certificate of Occupancy for a dwelling,
the Developer shalt provide the City with an as-built survey of the
lot identifying property lines, structure lacations and setbacks,
topographic grade/spoi elevations, sanitary ser�rer az�d water line
locations, ct�riveways, sidewalks, retaining walls, patios and a�y
other features required by the City. The as-builts musi be signed
by an engineer or land surveyor licensed by the State of Minnesota.
F. Bituminous_and Concrete Materiai Acceptance. The City will not accept concrete
curb ar�c� gutter that has structural or cosmetic defects. The City wiIl identify a1�
defective curbs for removal. The City will not accept bituminous base course
with less than a 91.5% density or tliat has an open graded appearance as
determined by the Director of Public Works. An unacceptable bituminou� base
course is cansidered to be rejected and wiIl be required to be removed at the
Deve�oper's expen�e. At no time shall the bituminous wear course be installed
after September 30�' of any calendar year or prior to weight restrictions being
lifted in the Spring.
G. Televisin�. All storm sewer and sanitary sewers shall be te�evised prior to the
instaIlation of aggregate base and concrete curbs and gutters, and bituminous.
The City will review and must app�ove the televising tapes prior to carnmencing
roadway canstruction. All tel�vised rnedia shali Y�e submitted on DVD. VHS
tapes will not be accepted.

Event of Defauit. The occurrence of any of the following shall be cansidered an "Event
of Default" and the terms and conditions coniained in this Agreement.
Failure of Developer to comply wiih any of the ierms and conditions contained in
this Agreemeni; and
�
Failure of Develaper to comply with any applicable ardinance or statute with
rsspect to the development of Fox Ridge.
:
Remedies. Upon the occutxence of an Event of Default, ihe City, in addition to any ofher
remedy which may be available to it, shall be permiited to do any of the follawing:
A. City may make advances or take other steps to cure the defauit, and, where
necessary, enter the Property far that purpose. Developer shall pay all sums so
advanced, or expenses incurred by the City, upon demand, with interest fronn the
dates of such adva�ces or expenses at the rate of 10% per annum ar the m�imum
amount permitted by law if less than 10%. If no action is taken by the City
plzrsuant fo this section it shall be deemed to relieve D�veloper from curing any
such defaults to the extent that it is not cured by the City or from any atlner default
hereunder. The City shall not be obligated, by virtu� of the existence or exercise
of this right, to perform any such act or cure any such deiault. Developer shalI
save, inderr�nify, and hold harmless, including reasonabl� attorney's fees, the City
from liability ox other damages which may be incurred as a res�li of the exercise
of the City's rights pursuant to this section.

occurrence of an Event of Defau�f, Developer shall pay the City all fees and
expenses, including reasonable attorneys fees, engineering and consultant fees
incurred by the City as a result of an event of clefault, whether or not a lawsuit or
action is forznally undertaking.
9.0 Lirnitation of LiabiIitv. Nofwithstanding in this Agreement to the contrary, the liability
o� the Developer shall be Iimited to its ownership and the deveiapment of Fox Ridge.
Upon sale or conveyance of an.y portion of Fox Ridge, the trans�eree shall be liable for all
obligations of Fox Ridge which relate to the Praperty and the transferor shall be released
from further obligation, liability, right or responsibility in respect to such transfer,
provid�d that the City consents to the transfer, which conseni shall not be unreasonably

withheld, and further provided that all financial sureties rernain in full force and effect.
Moreover, nothing herein shall be construed to create a cause of action on behalf of the
City against the Developer with respect to its business operations beyond ihe obligations
set fortli herein relating to the development of the Property.
10.0 Governin� Laws. The City and Developer agree that the laws of the State of Minnesota
shall govern all questions and inierpretations concerning th� validity and canstruction o�
this Agreement and the legal relations betvveen the undersig�ed parties and perfarmance
under it without regard to principies of conflicts of law. The language of this Agreement
is and shall be deerned a result of negatiations a.mong fhe parties and the respective legal
counsel and shall nat be strictly extrude for or againsfi any party. Each party agrees that
any action arising out of ox in connection with this Agreement shall be brougl�t solely in
the courts of the State af Minnesota, Fourth Judicial District, or the United States District
Court for �e District of Minnesota.
1 i.0 Bindin� Effec#. The terms and provisions of this Agreement shall be binding upon and
inure to the benefit to the heirs, representatives, successors and assigns a� the parties
hexeto and shall be binding upon all future owt�ers of all or ariy part af the Properry. This
Agreement, at the option of the City Cauncil, shall be placed of record so as to give
notice thereto to any subsequent purc�asers and encumbrances of all or any part of the
Property, and all recording fees, if ar�y, shall be paid by the Developer.
12.0 Metropo�itan Council AnnrovaL This Agreement anticipated that the City's
atnendrnent of its 2030 Comprehensive Plan as part of this project would be approved by
the Metropolitan Council. Without such Metropolitan Council approval, this Agreement
and the appraval af the final plat for Fox Ridge shall be null and void.
