Back�-ound The City oi Arden Hills is home to many residential lakeshore properties. Curreni regulations do not allow detached garages to be Iocated between the home and the street, yet Iakeshare lots tend to be narrower and d�eper than non-riparian lots, and i# is aften nat practical to add garage and storage space in th� side yard of these praperties. Furtherrrzore, the definition of "frant yardz' often differs betvveen the homeowners, who see the lakeside as their front yards, and ihe City, which views the street-side of the home as the front yaxd. The allowance of detached garages in front yards of lakeshore Iots has come up several t�mes recer�tly, as lakeshore lot values continue to increase and demand grows to continue improving these properties. A solution to this discrepancy would be to provide a rnechanisrn within the Zoning Code to ailow lakeshore lot awners to have detached garages between their home and the street under certain circumsiances. Since then, both ihe PIanning Commission and the City Co�cil have it�dependently given Staff direction to move forward with drafting possible language that would ailow lakeshore lot owners to construct detached garages in their front yards under certain circurnstances. Staff conducted research on other comrtnunities' regulahons pertaining to frant yard accessory structures and found that most communities provide some �rovision to allow Iakeshore lot owners to cons�r►tct detached struct�u'es on the street side of their properties. Staff looked at the Codes of adjacent comrnunities, and Minneionka, BrookIyn Park, White Bear Lake, and Burnsvil�e. Based on a review of these Cades, Staff drafted regulafions that address detached garages on lakeshore lots (Attachment B). Discussion Staff drafted the following language that would allow detached garages in the front yard of lakeshare lots: A. The above language would anly allow detached garages at least 4U feet from the front property line to maintain consistency with tl�e current front yard setbacks far pz-incipaI structures in the R- 1 district. The Ianguage a�so pravides for design standards t�at would requir� the new siructure to match the existing horne on the lot. Any detached garage constructed under these regulations vsrould be required to meet all of the other height, size, and side yard setback requirexnents of the City's Zoning Code. The Planning Comrnission unanimously recom�nended approval (5-0) of the proposed changes. She reviewed the Ianguage changes being proposed that wauld allow detached garages in the front yard of lakeshore lots. Chair Larson opened the floor to Commissioner comments. Chair Larson asked if this amendment would reduce the number of variance requests in the City. City PIanner Beekrnan stated the nurnber of requests will decrease but lakeside lots are narrow and the 40-foot setback is significant for these homes. They would sti11 need to request a variance if they are not meering the setbacks. Chair Larson opened the public heaxing at 7:30 p.zx�. Chair Larson invited anyone for or against the applica�ion to come forward and make comment. Mr. David Freed, 3136 Hamline Avenue, Arden Hilis, staied he supports the amendment because �e feels having #he garages detached and not in frant of the lake improves aesthetics and safety. (Revised OI/3I/12) Subd. 1 Time of Consiruction. No accessory structure shall be constructed on any lot prior to #he time of construcfion of the principal structure to which it is accessory. Subd.2 Height. A. R-1, R-2, and R-3 Districts. Accessory structures in the R-1, R-2, and R-3 Districts shall not exceed fifteen feet in height ar the height of the principal struciure to which i# is accessary, whic�iever is lower. B. Subd. 3 Location (Revised 07/07/11). A. Accessory structures in the R-1, R-2, or R-3 Districts shall not be located nearer the front lot line than the front yard setback line for the principal structure to which it is accessary. Accessory structures as permitted and regulated in this Code may be lacated within the rear yard of the principal structure in the R-1 and R-2 Districts. B. Detached accessory garages may be located in tile front yard (between dwelling and streei) of a lakeshore property provided all of the following are mei: 1. Deiached garages shall not be located within the minimum front yard setback. 2. The amendmeni to Chapter 13, Section 1325.01, Subd. 3, of the City Code is coIlectively known as Oxdinance 20I1-006. The purpose oithe amendment is to allow detached garages in the front yard of lakeshore lots under certain circumstances. The amended regulations will go into effect on July 7, 201 i.
