MEMORANDUM
DATE: June 27, 2011
TO: Honorable Mayor and City Councilmembers
Patrick Klaers, City Administrator
FROM: Meagan Beelnan, City Pianner
SUBJECT: Planning Case #ll-010
Applicant: City of Arden Hills
Subject: Zoning Code Amendnent - Detached Garages
Reauest
Consider approval oi Ordinance 2011-006 in PIanning Case 11-d10 to arnend Section 1325.01
Subd 3 of the Zoning Code to permit the construction of detached garages in tle front yards of
lakeshore lots under certain circumstances as presened in the 3une 27, 2Q11, report to the City
Council.
Back-ound
The City oi Arden Hills is home to many residential lakeshore properties. Curreni regulations do
not allow detached garages to be Iocated between the home and the street, yet Iakeshare lots tend
to be narrower and deper than non-riparian lots, and i# is aften nat practical to add garage and
storage space in th side yard of these praperties. Furtherrrzore, the definition of "frant yardz'
often differs betvveen the homeowners, who see the lakeside as their front yards, and ihe City,
which views the street-side of the home as the front yaxd.
The allowance of detached garages in front yards of lakeshore Iots has come up several tmes
recertly, as lakeshore lot values continue to increase and demand grows to continue improving
these properties. A solution to this discrepancy would be to provide a rnechanisrn within the
Zoning Code to ailow lakeshore lot awners to have detached garages between their home and the
street under certain circumsiances.

Among the possible amendments discussed at the February 22, 2011 roint Planning Commission
and City Council work session was a change to the Zoning Coce to allow detached garages in the
front yards of lakeshore lots. Since then, both ihe PIanning Commission and the City Cocil
have itdependently given Staff direction to move forward with drafting possible language that
would ailow lakeshore lot owners to construct detached garages in their front yards under certain
circurnstances.
Staff conducted research on other comrtnunities' regulahons pertaining to frant yard accessory
structures and found that most communities provide some rovision to allow Iakeshore lot
owners to consr►tct detached structu'es on the street side of their properties. Staff looked at the
Codes of adjacent comrnunities, and Minneionka, BrookIyn Park, White Bear Lake, and
Burnsvile. Based on a review of these Cades, Staff drafted regulafions that address detached
garages on lakeshore lots (Attachment B).
Discussion
Staff drafted the following language that would allow detached garages in the front yard of
lakeshare lots:
A. Detached accessor,y gara eg s ma,y be located in the front,_vard
(beiwee dwellin and street) of a lakeshore praperiy provided aIl
of ihe followin are net:
1. Detaced araes shall not be Iocated wiin the minizauzn
froni yard„setback.
2. Color and roof material of detached araes shall match or
complement the existin_rima-y residential siructure, and shall
conform to all oher re uireanents for the zonin district.
The above language would anly allow detached garages at least 4U feet from the front property
line to maintain consistency with tle current front yard setbacks far pz-incipaI structures in the R-
1 district. The Ianguage aso pravides for design standards tat would requir the new siructure
to match the existing horne on the lot. Any detached garage constructed under these regulations
vsrould be required to meet all of the other height, size, and side yard setback requirexnents of the
City's Zoning Code.
This itern was discussed by the City Council at their May 16, 20 f 1, work session.

Planning Case 11-010; Zoning Code Amendment regarding Detached Garages; City of
Arden Flills — Public Hearing
City Planner Beekman stated current reguIafians do not allow detached garages to be
located between the home and the sireet, yet lakeshore lots tend to be narrower and
deeper than non-ripazaan lots, and it is often not pracfcal to add garage and siorage space
in the side yard af these properties. Furthermore, the definitian of "frant yard" often
differs between the homeowners, who see the lakeside as their front yards, and the City,
which views the sireet-side of the home as the front yard. She reviewed the Ianguage
changes being proposed that wauld allow detached garages in the front yard of lakeshore
lots.
Chair Larson opened the floor to Commissioner comments.
Chair Larson asked if this amendment would reduce the number of variance requests in
the City.
City PIanner Beekrnan stated the nurnber of requests will decrease but lakeside lots are
narrow and the 40-foot setback is significant for these homes. They would sti11 need to
request a variance if they are not meering the setbacks.
Chair Larson opened the public heaxing at 7:30 p.zx.
Chair Larson invited anyone for or against the applicaion to come forward and make
comment.
Mr. David Freed, 3136 Hamline Avenue, Arden Hilis, staied he supports the amendment
because e feels having #he garages detached and not in frant of the lake improves
aesthetics and safety.
Chair Larson closed the public hearing at 7:33 p.m.
Commissioner Hames moved and Commissioner Zimmerman seconded a motion to
recommeud approval of PIanning Case 11-010 to amend Sectiou 1325.a1 Subd 3 to
ep rmit the construction of detached garages in the frant vards o lakefront lots
under certain circumstances as resented in the June $ 201] Planuin Case Re ort.
The motion_carried unanimously (5-0).
