Back�round
As the City Council is aware, the City experienced a large rainfall ev�nt in a very short
period of time early tk�e �ozning of Saturday July 16, 2011. This �vent happened after a
rain �vent af over 1.5" on Friday afternoon. Due to the large volume af rain�all, several
areas in tawn suffered from flaoding causxng property damage and in one ar�a a lift
staiion could not handle the clear water entering the system causing backups into s�veral
hornes. The general locations o� the problem areas are as follows:
• Arden View CtIDr Townhomes
• Lift station #8 service area (Tiller Ln., Ingerson Rd, Hamline Ave}
• Indian Oaks pond
• A�ble Rd/Nursery Hill Ct rear ya�d area
• Glenarden Neig�borhood between Forest and Skiles
Sta�f has bee� reviewing each of these areas, some to greater extent than others. At
Monday's woxk session staff wili review our findings and look for Ciry Council direction
regarding whether or not additional woz� shouid be done. Staff vaill have aerial mapping
of each of these areas to help £acxlitate th.e discussion.
The area that staff has spent the zrzosi time researching and reviewing is ihe Arden View
Ct and Dr townhome associations. Generally staff findings are as follows:
AlI starm drainage frorn both the north and �lie south areas flow il�ough the same
starzn sewer pipe and pond facilities.
It appears the City Council in the rnid 1970's accepted the sto�n sewer along with
the sanitary sewer and water main {aitached are the Cou�ncil minutes and backup
from June 16, 1975).

• StafF asked Bolton and Mer�k to review �he siie and �repare a proposal for several
iterns incl�ding: an analysis of the existing storm sewer systez�, creatir�g a
computer mode� of the system, collecting relative topographic information, model
storm water aptions, analyzzng grading overflow opiions and preparing "ballpark"
cost estimates (ihe BMI propasal is attached).

Townhouse Villages at Arden Hills drainage issues. Per your reqaest, we have prepared this proposal for
professional enginee�'ing services iv deve3op aliernatives for potentia] starn�a water improvements on the
subject property_ As a gart of this praposal, we describe our understanding of the project, detaa] ou�r
proposed scope of work, and pravide our fees for service.
Project Understandin�
The City of Arden Hills recently received heavy iainfal} amounts in ,Tuly that caused localized flooding to
oceur in the Townhouse Vi��ages North and TownhoUse Vi�}ages at Arden Hills subdivisions. The streets
in this area were under rehab�litation at the time of the storm events, which may ha�e attributed to the
severity of the problem_ 'T`�e properties are located south of CR-96W and west of Hamline Avenue_
There are four on-s�te ponds located throe�gho�t the properkies tE�at heIp control storm water ivnoff. The
site, in general, drains �n a southerly direction.
The City of Arden Hills is requesEing the services of Bolton & Menk, lnc. ta prepare preli�rinary design
concepts for storm water i�provements. Information pra�ided to us for the purposes of completing this
work include storm sewer construction drawings for the Townhoose Villages at Arden Hi13s and a storrr�
sewer schematic vf� the area.
Scone of Work
BoltQn & Menk proposes to camplete the storm wate�- system analysis in four tasks as foilows:

Based on the information received from the City and what Solton & Menk intends to col�ect from a
�elci visit, aptions will be developed of variovs alternatives to manage and improve storm water runoff.
These options will be developed from visual ohservations and from re�iewing the existing 2-ft contour
maps and as-builts. The aptrons are anticipated to inclvde ]ocalized grading and mi�or stor�n sewer
mocEifications. No computer modeling wou�d be doRe de�ring this cask to determine the volume of storrn

the various options. One meet�ng with the Ciry staff has been included for discussion of the options.
Task 2— Collect Topo�raphie Data of Critrcal Informatiolz
Bolton & Menk will cc�Ilect pond and road secEion overf7ow e]evations and critical ground e3evations to
enhance the existzng base rr3ap information. Catch basin rim and invert elevations along with storm
sewer pipe size ir�formation wi]I also be collected. The objective af this task is to complete a more
acc�arate and comprehensive digitaI map of the townhome developments which can be used in support
af Ta€sks 3 and 4, betow.
Task 3— A�7al},ze Existi�7,2 Storrn Water Corxveyance .Svste�n
Bolton & Menk wiEl ereate a camputer modei of the existing drainage system asing the information
gathered in Task 2. The model created will be used to identify a�y apparent defciencies in the existing
storm sewer pipe system based upon a 10-year storm evenE and analyze potential flaoding iss�aes ta
townhomes based upon a 140-year, 24-hour storrn event_ The existing system witl also be mode�ed
with the low point street catch basins blocked along Arden View Drive, sim�lating the canditions that
oecurred during the recent construction, to see whaE the resvlting ffood conditions would be for a 4.5" —
24-hour starm event. One meeting with City staff has been inc�vded �or ciiscussion of these results.
7�ask 4— Model Stor�aa Water If�zproyemenf DesiQr� Obtians
This task wiIl involve utilizing the computer model deveIoped in Task 3 and evaivating the
effectiveness of the Task l options. Additional alter�atives will be looked at to deiermine if other
irnprovernents could be made ta the storm sewer sysEem based ugon a 10-year design starrr�.
Emergency o�erflow optio�s wilI be analyzed based upor� a la0-year, 24--hour storm event. Bolcon &
Menk wil] prepare prelirrzinary cost estimates associated with the �arious options. One meeting wit�
City staff has been incl�ded for discussion of these results.

BUlton & Menk proposes to complete the scope c�f work as described above for the following fees.

Solton & Menk, inc.
The accampanying Proposal (herei�tafter referred to as "Proposal") is subject to the foIlowing Eerms and
conditions. These Terms of Proposal (hereinafter referred to as "Terrns") are an i�tegral part of the Proposa! as
i#'stated directly therein. No ehange or deviation from these Terms will he binding without the written
approval of Bo�ton & Me�k, Inc. Snch changes may require an adjustment in t�e proposed fee, schedule or scope
of the Proposal.
A. Services: Bolton & Menk inc. proposes to perform the sefvices outlined in the Proposal for the stated fee
a�rangement. Changes required by the C9ient or other controlling entities (regulatory agencies, contractors, courts, etc.)
from the scope or schedule of services described �n the Proposal shal] be eonsidered "Ac�ditional Services" and will be
in�roiced on a� haurly basis in addition to the stated fee an�angernen[.
B. Ir�formation irom Client: Unless otherwise stated, Client agrees to provide BoIton & Menk lnc. witE1 aIl site
information necessary to complete the proposed services. 7'his information should incIude cvrrent site property
descriptions (frotn abstE�act, titIe opinion or title cammitment); oEher legal docuFnents affecting the site; copies of
�revious surveys, maps, engineeri�g studies and plans; existing or required soils and geo[echnica! reports;
go�ernmental, regulatory and utility reviews and deEerrr►inations; and ali other pertinent inforrnation. Client sha!}
promptly infonn Bolton & Menk lnc. of any alleged defects ir� services provided or the project.
C. Access to Sife: Unless otherwise stated, Client agrees to provide Bolton & Menk J�►c. with access to the site,
includinQ acfjoining properties, for activities necessary for t�e performance of services. lt is understood that in che
narrnal course of work, property damage may occur due to excavatians, tree and br�sh crimming, marking lines, etc_
The cost to correct resulting damages has nat been included in the fee. Bol€on & Menk Inc. wiI] take precautions to
minimize damage d��e to these activities and the Client agrees to reimburse $olton & Menk Inc. for any costs associated
with required restoration work.
U. Standard of Care: Professional services provided Under this Agreement will be conducted in a manner consistent
with that Ieve3 of caee and skill ordinarily exercised by members of Bolton & Men�C Inc's pro�ession currently
practicing under similar canditions. Bolton & Menk Ine. tnakes no expressed or implied warranty with respect to
i€s undertakir�gs described herein.
E. Certitications: Any certi�eation pro�ided by Bolton & Menk Inc. is a professiona] opinion based upon knawledge,
information and beliefs a�ailable to Bolton & Menk Inc. at tl�e time of certifcation_ Such certi�cations are not
intended as and shall not be construed as a guairantee or warranty. Bo]Eon & Menk Inc. sha}I not be required to certify
the existence of conditions whose existence Bo}ton & Menk Irrc_ cannat reasonably ascertain.
�' Praject Approvals: Due to site ]imitations, code interpretations, regulatory reviews, political considerations and
C1ie»t directed design and improvements, Boiton & Menk Inc. ma3ces no representations as to acceptability or
appro�ability of the pz-oject; ar, zoning requests, pennit applicaEions, site and de�elopment plans, plats and similar
documents. Payment of fees tn BolEon & Menk Inc. is not eontingent upon project approvai.
G. Opinions or Esiimates of Project Costs: Where incl�det� as part of project scope or otherwise, opinions or
estimates of pro�ect cost will generally be based apon p�blic construction cost information. Since Bo�ton & Menk Inc.
has no control over the cost of labc�r, �naterials, corr►petiti�e bidding process, weather conditions and other factors
affecting the cost of construcEion, a11 cosE estirnaEes are opinians for general information of the Client and Bolton &
Menk lnc. does not wa�rant or guarantee the accuracy of canstruction cost aginions or estimates. Project financing
should l�e based upon actua3, contracted construction costs with appropriate conEingencies

H. Constr�ction Phase Services: If eonstruction phase engineering or staking se�-vices are included in this Proposal or
subsequently authorized, Client is notif ed that Bolton & Menk Inc. is not be responszble for mea�s, meihods;
techniques or procedures of construction selected by any contractor employed on the project nor for the safety
precautions or progra�ns incideni to tkte work of any contractor.
1. Ownership and Alteration of Docurnents: All documenEs, including reports, specifications, drawings, �eld data,
notes and documents or e]ectronic media prepared or furnished by Bolton & Menk Inc. uncfer this agreement shall
reinain Ehe property of Bolton & Menk Inc. The Client may make and retain copies for its use in connection with this
project. However, such documents are not inten�ed for rease hy the Client on any other praject or alteratio�i of the
project by others without the written consent of Bolton & Menk Tnc. Electronic media may be �urnisF�ed for
corivenience of Client; however, only signed and certified hard copies of submittals rnay be relied e�pon as
doc�rnentation af professiona� se�vices provided.
,�. �illings and Payments: lnvoiees for Bolton & Menk Inc`s services sha11 be stabmitted, at Bolton & Menk Inc's
option, either monthly or upon corr�pletion of services. lnvoices are due and payabie wittiin 30 days after the invoice
daEe. If the invvice is not paid within 30 days, Bolton & Menk Inc. may, witho�t waiving any claim or righE agai�st Ehe
Client, ancf withoat liability whatsoever to the Client, ternunate the performance of its services.
K. Late Paymenis: Accounts unpaid 30 cfays afEer the im�oice date will be subjeet to a monthly service charge of
]_5%o on the unpaid balance. Tf any portion or a31 of an accouflt remains unpaid 90 days after biliing, the Ciient shal}
�ay alI costs of collection, incl�c�ing reasonable attorney's fees.
L. Termination of Services: This agreement may be terminated, u�on written notice, by the Client oF Boltan & Men�C
Inc. should the other fail to per�'orm its abligations hereunder. In Fhe event of termination, the C)ient sha21 pay Bolton
& Menk Inc. for services rendered to the date of termination, all reimbursable expenses, an� reimbursable terrr►ination
expenses.
M. I,irraitation of Liability: In recognition of the relative risks, rewards and benefits of the project !a both the
Client and Bolton & Menl� lnc., the risks have been allocated such that the Client agrees that, to the fullest
extent permitted by law, Solian & Menk Inc's total liability to the Clie�t for any and all injuries, claitns, losses,
expenses, daxnages or claimed expenses arising out of the performance af this agreement from any eause or
causes, shal� not exceed $1G,900. Such claimis include, but are noi �imited to, �o�ton & Menk Inc's negligence,
errors, omrssions, strict Iiability, breach of con#ract, or breach of warranty, if any.
N. Dispute Resolafion: Any claims or dispEiEes made during or after the performance of services 6etween Botton &
Menk Inc. and t�e Clienl, with Ehe exception o� claiens by Bolton & Menk �nc, for non-payment of services rendered,
shall be subrnitted to mediation and/or arbitration. This Proposal anticipates that Bolton & Menk I�c. and the Ciient
will include a similar requirement in a�l agreements with contracto�•s, suh-contractors, suppliers, consu]tants and
fabricators concerned with this project.
O. With�rawad of Proposal : Tl�is Proposal eonstitUtes a non-binding offer to perform services and Bolton & Menk
lnc_ reserves the righc to withdraw or modify this Proposal, without liability to the CiienE, at any time pi�ior to receipt of
written acceptance from Ehe Client and exec�►tion c�f a signed agreement in accordance with Paragraph P.
P. Agree►nent: If the Proposal is accepted, �he Client and BoIton & Menk lr�c. may enter inEo ancf execute an
Agreemer�t incorporating the Proposal, these Terms and sue6 additional terms ancE conditions as may be mutually
acceptable to Bolton & Menk Inc. and Clzent. Upan request by the Client, Bolton & Menk Ine. may, at its soIe
discretion and For the benefit of the Client, proceed w�th any proposed services prior to exeeution of a written
