Apprave Planning Case 11-020 for a Conditiona� Use Permit Arnendment and Variance at 1900
Lake Valentine Road based on the findings of fact and the sub�xaitted plans as a�nended by the
four canditions in the September 26, 2011, planning case xeport.
Back�raund
Mounds View High School received a Conditional Use Perrnit {CUP) Amendment to const�zct a
baseba�l field in the southwest corr�er of the school property in 2008. In 2009, Mounds Vie�w
High School added bleachers, and a foul ball netting system to the baseball field.
At this time Mou.nds View High School is proposing to construct a 192 square �oot digital score
board.. The scoreboard would be 24 feet in w�idth, eight feet in height, and mounted on ten foot
high poles, making it eighteen feet in height. The scoreboard would be located £acing the field
on ihe north side of the existing ball field. The scoreboard would be located approximately 460
feet from the near�st properiy line, and approximaiely 540 feet from the nearest home.
The applicant has subrr�itted a proposal describing their request, and a site plan indicating the
location of the scoreboard (Attachment C}.

Findings of Fact
The Plaiuiing Commission offers the following seventeen findings af fact for the City Counci�'s
consideration
Generul Findings:
L The applicant is proposing to construct a 192 square foot digital scoreboard.
2. Mound.s View High School operates under a Conditional Use Permit in the R-1 Zoning
District.
3. Athletic fields and accessory equipment are permitted under the original CUP for
Mounds View High School.
4. The scoreboard vvould be lacated approximately 460 �eet fram the rear property line.
5. The proposed applicatiorz will not exceed the lot coverage limiis for the property.
6. The proposed applicaiion �neets all setback requirements.
7. The applicant is not proposing to remove any vegetation frorn the site.
4n the Conditional Use Permit Amendment:
S. The proposed project is not expecied to have any significant impact on traffic or parking
conditions since no change in the school population is e�pected.
9. The proposed project will not produce any permanent noise, glare, odors, vibration,
smoke, dust, air �ollution, heat, liquid, or solid �craste.
10. The proposed project will not impact storm water runofi since impervious suz�ace is not
significarrtly in.creased and no grading is taking place.

On the Tjariance Request:
15. The proposed project is in harmony with the puipose and intent of �e Zoning Ordinance
because scoreboards are permitted accessoary uses with athletic fields.
16. The proposed project is consistent with Comprehensive Plan because �he property in
question is guided for its cu�xent and proposed use as a high schoal.
17. The proposed praject is reasonable because scoreboards are addressed in the Code as
reasonable uses with educational athleiic facilities.

Requested Action
Approve Planning Case 11-020 for a Condiiional U�e Permit Amenc�ment a�rzd Variance at 1900
Lake Valentine Road based on ihe findings of fact and the submitted plans as amended by the
four conditions in the September 26, 2Q11, planning case report.
Recommendation
The Planning Commission reviewed Planning Case 11-020 and unanimously recommends
appro�val (�4-0} of the Condiiional Use Permit Arnendment and Variance based on the findings of
fact and the subrnitted plans as arnended by ihe following four conditions:
1. The applicant shail continue to abide by the conditions of a11 previous permits and
reviews.
2. The projeci shall be completed in accordance with the plans submitted as aznended by
the conditions of approval. Any significant changes to these plans, as determined by
the Ciry Planner, shall require review and approval by the City Council.
3. The applicant shall obtain all necessary perrnits fram the City.
4. The applicant shall obtain all necessary permits from the Rice Creek Watershed
District, MPCA, and oiher governmental entities and provide the City vv�th copies of
such pernuis prior to the City issuing any building permits.

Pursuant to Minnesota State Statutes, the City has until October 17, 2011, (60 days) to provide
the applicant with a final decision, untess the City extends the review deadline in writing.

Lake Valenfine Rd — Public Hearing
City Planner Meagan Beekman stated the applicant has requested a Conditional Use
Permit Amendment and Variance to construct a scoreboard on the north side of their
baseball f e1d.
City Planner Meagan Beekman stated Mounds View High Schaol received a Condiiional
Use Pe�nit {CUP} Amendment to cor�struct a baseball field in the southwest corner of the
school property in 2008. In 2009, Mounds View High School added bleachers, and a foul
ball netting system to the baseball field. At #his time Mounds View High School is
proposing to construct a 192 square foot digital scoreboard. The scor�board would be 24
feet in width, eight feet in height and mowxted on ten fooi high poles, making it eighteen
feet in height. The scoreboard would be located facing the field on the north side oi the
existing ball f eld. The score would be located approximatcly 460 �eet frarn the nearest
property line, and approxizx�ately 540 feet from the nearest home.
City Planner Meagan Beekman reviewed the Plan Evaluation.
1. Zoning Code Regulations
A. Lot Coverage — Meets Requirements — This project would not result in an
increase of impervious coverage.
B. Setbacks — Meets Requirements — The proposed scoreboard would be located
approximately 460 feet frorn the rear property line.
C. Height — Variance Required — Accessary structures are permitted up to fifteen feet
in height. The proposed scoreboard would be eighteen feet in height, which is a
standard height for scoreboa�ds; however, a variance would be required to allor�r
the additianal three feet of height. The posts wauld need to be custom made to
accommodate a height of fifteen feet, and given the location af the scor�board in
relation to the field and bleachers it wo�ld not be as visible at a reduced height.
The applicani is rec�uesting a vaxiance to construct the �coreboard at eighteen feet
rafher than fifteen feei.
D. Landscaping — M�ets Requirerx�ents — The applicant is not propasing to remove
any vegetation on rhe site.
2. Sign Code Regulations — The Sign Code allows permanent signage to be located on
scoreboards, provided that it daes not exceed 30 percent of the total scoreboard area if
it is vi�ible from adjacent property. The scoreboard is proposed ta have
approxi�ately 48 square feet of permanent signage on it, approximately 25 percent of
the scoreboard face.
3. Conditional Use Permii Amendme�t Criteria -- S�ction 1355.04 Subd 3 of the Axden
Hills Zoning Code lists the cr�teria for evaluating a Condition Use Permit
Amendment.
When evaluating canditional use permits, the Planning Commission and City Council
should consider the effect of the proposed use upon �kze heal�., sa%ty, convenience,
and general welfare of the owners and occupants of the surrounding land, in
particular, and ihe communiiy as a whole, in general, including but not limited to the
following factors:
1. E�isting and anticipated tra£fic and parking conditions.
2. Noise, glare, odors, vibration, sznake, dust, aix pollution, heat, Iiquid, or solid
waste, and other nuisance charac#eristics;
3. Drainage;
4. Populaiion densiiy;
5. Visual and land use compatibility with uses a�d structures on surrounding
land; adjoining land values;
6. 1'ark dedication where applicable; and the
7. Orderly development of the neighborhood and the Ciiy �thin the gene�al
p�rpose and intent of this ordinance and the Cornprehensive Development
Plan for the City.
City Planner Meagan Beekman reviewed the Variance Evaluation Criteria. City Planner
Meagan Beekman offered seventeen findings of fact for the Plannilig Commission's
consideration:
General Findings:

City Planner Meagan Beekman stated based on the submitted plans and findings of fact; Staff
recommends approval of Planning Case #11-020 for a Conditional Use Permit Amendmen�
to construct a scoreboard on the north side of the existi�g ba�eball field at Mounds View
High Schoal. The recommendation for approval is subject to the fol�owing four conditions:
1. The appiicant shall continue to ab�de by the conditions of all previous permits and
reviews.
2. The project shall b� completed in accordance with the plans submitte�. as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval b� the Plan�ing Comtnission.
3. The applicant shall obtain all necessary pernuts from the City.
4. The applicant sha11 abtain all necessary permits from the Rice Creek Watershed
District, MPCA, and other governmental entities and provide the City wi.th copies of
such permits prior to the City Fssuing any building pern�.its.
Chair Larson opened the floor to Commissioner cornment,s.
Commissioner Hoiewa asked to see the location picture and asked where north was in the
picture. City Planner Meagarz Beekman indicated the Iocation on the picture.
Commissioner Holewa asked if the scoreboard would be lighted towards the nearest
home. City Planz�er Meagan Beekman stated Maunds View High School only has
daytime garnes.
Commissioner Zimmez�z�an asked if the lights were LED. City Planner Meagan
Beekman stated they are.
Mr. Robert Madison, Activities Director at Mounds View Higl� School appeared before
the Commission. He siated with the grade of the houses nearby it would be difficult for
the scareboard to be seen by the residents. That was the reason they selected that
location.
Commissianer Holewa asked if Mr. Madison spoke with the neighbors. Mr. Madison
siated he did not receive any concerns fram the neighbors. Mr. Mac�isan stated sorne
trees will be planted along the perimeter. They will be planting � foot spruce trees which
when mature should cut down on sound from the field.
Chair Larson opened the public heaz-�ng at 6:59 p.m.
Mr. Charles Fisher, 1750 Gramsie Road, stated they live in the neighborhood of the
school. If it were a choice between athletics and academics he would choose academics.
He daes noi have a concern witYa the scoreboard. He supports the school.
Chair Larson closed the public hearing at 7:01 p.m.

1.4 Recitals.
A. Independent School Disfricf No. 621, a governmenfal su�diuision of the
State of Minnesota ("Permittee"), and having one of its schoo[ campuses
]ocated on the following real property in the City of Arden Hills, Ramsey
Cour�ty, Minnesota ("Arden Hi[]s"):
The East �/Z of the Southeast �/ of Section 27,
Township 30, Range 23 and the East'/4 corner of said
Section 27, the�ce rUn Southerly on the East line of
said Section 27 for �297.1 feet; thence run Westerly
at right angles to said iine for 90 feet; thence

B. On the '[8�" day of August, 2011, Permittee submitted a comple�ed
ap�lication to Arden Hills requesting that its existing condifionaf use permit
be amended, and �ariar�ce be granted to allow the co�struction of an
electronic scoreboard adjacent to its �aseball �ie[d {"Scoreboard
Application") on the S�abjec# Property.
C. On the 7`n day of September, 2011, the Scoreboard Application was
reviewed at a public hearing by fihe Arden Hii1s Planning Commission.
The Arden Hills Planning Commission consider�d the recommendations of
the Arden Hills staff, the commen�s ofi th� public and recommended
approval of the Ball Field Applicafion subject to certain conditions.
2.0 Approval of Scoreboard Application. On the 26th day of Sepfiember, 2011, the
Arden Hills City Council considered the Scoreboard Appiication, the
recommendatio�s of the Arden Hills Staff and Plan�ir�g Commission, the effects
of the proposed amended cor�difiional use on the health, safety, conr�enience and
general welfare of the owners and occupants of surrounding fand and the
community as a whole, the �ariance criteria, and determined that the �acts and
circumstances of this particular case warranted the granting of the amended
conditional use permit and �ariance suf�ject �o the fol[owing conditions:
A. The Permittee shali continue to abide by the conditions of al[ pre�iaus permits
and re�iews.
B. The pro�ect shall be completed in accordance with the plans submitted as
amended by �he conditions of approval. Any significant changes to these
plans, as determined by the City Planr�er, shall require re�iew and approval
by fhe City Co�ancil.
C. The applicant shall ob�ain all necessary permits from the City.
D. The Permittee shall obtain all necessary permits from the Rice Creek
Watershed Dis#rict, MPCA, and other governmental entities and pro�ide the
City with copies of such permits prior to the City issuing any building permits.
