Requested Action
Approve Resolution 20ll-047 Vacating an Electxical Utility and Pedestrian Way Easement, as
described in Document No. 2114719, for the Final Plai of Davidson Addition.
Background
On June 27, 2011, the City Council approved Plam�ii�g Case 11-011, for a Preliminary and Final
Plai, Zoning Code Am�ndment, and Master az�d Final PUD to allow the reuse of the former
Holiday Inn building as an assisted senior housing facility. As part of the approval, the City
Council approved a Preiiminary and Fina1 1'lat to subdivide the property into two lots.
Conditzons #4 and #5 of ihat approval required the de�relaper to dedicaie io the City a iwelve-
foot wide c�rainage and utility easement, as well as a ten-foot wide pedestrian easement along the
County Road E frontage of the property.
Presently, an electric utility and pedesirian way easement thati is ten feet wide exists on the
property, along the County Road E frontage. Ramsey County no langer allows ihese types of
easements to be recorded wiih new Plats; therefor�, the City must vacate the existing easement in
order %r the plat to be recorded. The two ne� easements will encompass a11 of the land being
vacated by the old easement. Since the areas ta be vacated will be entixely wiihin a new drainage
and utility easement, Staff does not antic�pate any impact to the City by granting this vacation

request. The City Engineer reviewed the proposal during the preliminary and final plat review
and is supportive of the vacation.
An easement vacatian requires a public hearing befare the City Council. The public hearing was
noticed in the Shoreview-Arden Hilis Bulletin �rior to this evening's meeting.
Recommendation
Staff recommends approval of this request.

A RESOLUTION VACATING A CERTAIN ELECTRIC UTILITY EASEMENT AND
PEDESTRIAN WAY EASEMENT
WHEREAS, the Arden Hiils City Council conducted a public h�aring on the 26�'
day of September, 2011, preceded by mailed and published notice, as required by
Minnesota Statutes 412.$51 and 4b2.3S8, subd. 7; and
WHEREAS, the purpose of the public hearing was to consider the vacation of the
public's interest in:
The South i0 feet of the following described parcel af Iand, towit:
All that part of ihe South Half of the Southeast Quarter of the Southeast Quaxter, Section
27, Township 30, Range 23, lying between the Northerly right of way limits of U.S.
Highway No. 10, and the Southerly right of way limits o�the Minneapalis, St. Faul and
Sau1t Ste. Marie Railroa�, and the Westerly right of way lirnits of Lexingtan Avenue and
Easterly of the West 250 feet o� said Southeast Quarter of tl�e Southeast Quarter o�
Section 27, Township 30, Range 23.
WHEREAS, On the 27�' day of June, 20 i 1, the City approved a Preliminazy and
Fina1 Plat of the above re�erenced parcel, replatting tne properry as tl�e Davidson
Ac�dition, lots 1 and 2.
WHEREAS, all o£ the above-referenced easement is known as the "Perpet�al
Underground Electrical Utility Easement and Pedestrian Way Easement" as recorded in
Document Na. 2114719 and is hereinafter collectively xe�erred to as the "Easement"; and
WHEREAS, ihe Arden Hills City Council has determined thai it is in the pubiic's
interest to vacafe the Easernent.
NOW, THEREFORE, BE IT RESOLVED, that the Arden Hills City Council
hereby vacates the public's interest in the Easement and direcfs tkie City Administraior to
file a c�rtified copy of this Resolution with the Ramsey Caunty, Minnesoia Recorder.
