D�EN�Hu,LS MEMORANDUM DATE: October 24, 2011 TO: Honorable Mayor & City Councilmembers Patxick Kiaers, City Administrator FROM: Meagan Beekrr�an, City Planner SUBJECT: Accelerated Nuisance Abatement 197b Glen Paul Avenue Requested Action Motion to approve Resoiution 20I1-O51 ordering abatement at 1976 Glen Paul Avenue for the accumulation of refuse and debris not in compliance wiih City regulations. Back�round Due to complaints, staff inspected 1976 Glen Paul Avenue in August, 2011. Staff noted the accumulatian ot'garbage and debris, and deterrnined that tne property was in vioiation of violations of City Code Section 602.02 Public Nuisance Affecting H�alth: Subd 4. Privy vaults and garbage cans which are not rodent-free or fiy tight ar which are so maintairzed as to constitute a health hazard or to emit faul and disagreeable odors. At the time of the inspeciion, the property owner agreed to wark with the City to clean up the �iolation. A letter was sent giving the property owner one week ta correct ihe issue. A follow- up inspection found the violation an the property io persist. Staff issued a citation in September, 2011. Since the initial inspection, the property awner has been working with Staff and the refuse has been taken care af, in part; however, the accumulation of garbage and debris as never been wholly dealt with; as such, Staff considers that violation to be ongoing. Staff conducted an inspection on October 19, 201 l, to check on the property. Staff found that the violation continued, and that there was additional accurnulation of garbage on the exterior of the garage. Ave - Nuisance .4batement.cloc Page 1 of 2 This type of violation allows the City to use the accelerated abatexnent process in Section 602.07 of the City Code. Due to the ongoing nature of the vioIation and since the properiy owner has not resolved the violation, and missed multiple deadlines to do so, staff is reQuesting the City Council issue an order far abatement of the property and to contint�e the abatement order far a two year period. The two year period wauld expire on Octaber 24, 2013. The property owner has seven days from the Council's order to cozraplete the work before the City can haee the r7rork campleted. An abatement order ailows the City ta hire a contractor to cornplete the work on the property and chaarge the cost back to tl�e property owner. Furth�rmore, the City cha'rges an administrative fee of $125. If th� charges are not paid, the charge will be certified againsi the property for callection with the property ta.xes. � If the same violation reaccurs within two years of the Council's order, staff can order abatement without an additianal Council hearing or action. A letter would be sent to the property owner ordering the violation to be resolved within seven wo.rking days. If the violatian is not resolved, staff can order ihe abaiement and charge the expense back to the property ownez. Prior to any action, the Council must pravide a hearing for the property owner. The property owner was natified o�t�e hearing in conformance with the City Code. All persons present at said rneeting were given an opportunity to be heard and present written staternents. The Council also considered tY�e recommendation of the City Staffthat this abaternent be approved; and, NOW, THEREFORE, SE IT RESQLVED THAT THE A.RDEN HrLLS CITY C4UNCIL hereby aclopts Resolution 2011-OSI, ordering tlae abatement of the accumulation of any debris or garbage that daes not co�ply with City regulations ai 1976 Glen Paul Avenue, and to charge ihe property owner for t�e full cost of abatement, pi�s an administrative fee in the amount af $125. The City Administrator is authorized to monitor the property throug� Ociober 24, 20�3; ar�d to abate any accurnuiation af debris or gar�age tihat does not comply with City regulations, and to charge to the property owner for eac� subsequent abaternent, the iull cost of the abat�ment, plus an adm inistrative fe� in the amount of $ i 25; and BE IT FURTHER RESOLVED, In tihe event that ihe property owner does not pay any portion of the charges, that tl�e unpaid amount shall be assessed against the Property, to be collecied with ihe real estate taxes in the year in which this Resoiution is recorded, together with an Aff�da�it of Cost incurred, and that any assessments levied pursuant to this Resolution shail bear interest at ihe rate of 4.5% per annutn from the dat� of recording until Dece�ber 31 St of the year in which the special assessr�ent is paid in full.
