SUSJECT: US 10/Hwy 96 Municipal Consent Resolution
Back�round
Ramsey County is proposing an interchange improvement to the intersection of US 10
and Hwy 96. Earlier this year the City was presented with a Mn/UOT staff approved
layout and Municipal Consent was requested. A Public Hearing was held by the City
Council on July 11, 2011. Also, this project was discussed with representatives of
Ramsey County at work sessions on Apri125, 2011, August 15, 2011, and September 19,
2011. At the September 26, 2011 Council meeting Resolution 2011-048 was adopted
disapproving the final layout of the US 10/Hwy 96 Improvement with four conditions.
Those conditions were as follows:
1. Mn/DOT is currently undertaking an improvement to I-694 at TH51. This project
will have the bridge over I-694 from Hamline Avenue to TH51 (Snelling Avenue)
closed for most of the next two years. Mn/DOT is also planning to let a contract to
widen the Lexington Avenue Bridge. Although this work will be completed under
traffic, it will have an effect on the flow of traffic across the bridge. Therefore, to
maintain some minimal mobility for local traffic to move north to south, Highway 96
shall not be closed in the same year that the Lexington Avenue Bridge widening is
completed.
2. Ramsey County and/or Mn/DOT shall re-evaluate the noise analysis work completed
for the southwest quadrant of US 10 and Highway 96 to determine if a different
length noise wall and/or a different height noise wall would meet the criteria for cost
effectiveness.

3. The Concrete Barrier Type F planned to be installed adjacent to Lakeshore Place as
part of the improvement shall be increased in height to the tallest Type F barrier that
can be slip-formed in this location.
4. Ramsey County shall make every effort short of utilizing eminent domain procedures
to realign the west end of the noise wall on the north side of Highway 96 so it is in the
appropriate location to facilitate a further extension with future highway
improvements
On October 21, 2011, staff received the attached response from Ramsey County to the
City's four conditions. Attached to Ramsey County's letter is a copy of an October 10,
2011, letter from Peter Wasko, Mn/DOT Metro District Noise and Air Quality
Supervisor, dealing with Condition #2. Also, attached is a memo from Chris Chromy
regarding his review of Condition #2 responses from Mn/DOT. Basically, Ramsey
County's responses to the City's four conditions are:
1. The US 10/Hwy 96 project will be constructed in 2013 so that Hwy 96 is not
closed in the same year that Mn/DOT widens the Lexington Avenue Bridge.
2. A re-analysis of all the available noise data indicates that there is no length and/or
height noise wall for the southwest quadrant that meets the cost effective criteria
for inclusion of such noise wall in the project.
3. The barrier for Lakeshore Place has been increased to 63 inches in height (56
inches above ground level).
4. Ramsey County agrees with Condition #4 and will pursue accomplishing it.
Based on these responses from Ramsey County, staff recommends granting Municipal
Consent to the US 10/Hwy 96 Improvement. Attached is Resolution 2011-054 which
approves the final layout for the improvement thereby granting municipal consent and
rescinds Resolution 2011-048.

CONDITIONS FOR MUNICIPAL CONSENT FOR RECONSTRUCTION OF THE RAMSEY
COUNTY STATE AID HIGHWAY (CSAH) 96 / MINNESOTA TRUNK HIGHWAY (TH) 10
INTERSECTION
Dear Mr. Klaers:
At the September 26, 2011 Arden Hills City Council meeting, the Council passed
Resolution No. 2011-048, disapproving municipal consent for the reconstruction of the
CSAH 96lTH 10 intersection. This resolution listed four conditions to be met before
municipal consent is granted. We believe that the conditions have now been met, as
summarized below:

We applied for a sunset date extension that was approved by the Metropolitan
Council Transportation Advisory Board's Funding and Programming Committee on
October 20'h. This extension will allow the project letting to be moved to 2013, thus
ensuring that Lexington Avenue and CSAH 96 will not be closed in the same year.
The Minnesota Department of Transportation (MN/DOT) has re-analyzed the noise
analyses that were done on TH 10 and concluded that no length or height wall will
meet the threshold for cost reasonableness for residences in the southwest quadrant
of CSAFi 96 and TH 10. A copy of the MN/DOT letter is enclosed.
MN/DOT designers have confirmed that the retaining wall between lakeshore Place
and Old Highway 10 (CSAH 76) can support the higher "glare screen" type of traffic
barrier. This barrier has approximately 56" of its total height of 63" above ground
after construction. In addition, since there will be a boulevard approximately 15'-16'
wide between Lakeshore Place and the barrier, there should be ample space for
landscaping to screen the barrier after construction while maintaining space to store
plowed snow.
Ramsey County will include the properties in the northeast quadrant of I-35W and
CSAH 96 in its contracts for appraisal and acquisition services for the project so that
the noise wall there can be configured to accommodate future interchange
improvements and maximize noise reduction at adjacent properties. The County�will
not condemn these properties to facilitate the acquisition, but will negotiate to
achieve a suitable settlement without the use of eminent domain powers.
If the City's staff agrees that the conditions have been met, we request that a resolution
granting municipal consent be added` to the City CounciPs agenda as soon as practical.

Based on a meeting you had with Arden Hills Public Works Director Terry Maurer and North Area
Engineer Mark Lindeberg, I was asked to review and comment on the noise analyses done for TH
10 that affected the Lakeshore Place neighborhood and to provide information on whether different
heights or lengths of wall might meet the "reasonableness" threshold.
In 2007, Arden Hills asked MN/DOT to extend a noise analysis completed as part of the I-694
Environmental Assessment (EA). In March, 2008, SEH, Inc. completed the TH 10 Barrier Study.
That study showed that a noise wall in the southwest quadrant of TH 10 and CSAH 96 was not
cost effective. A 20' high wall was analyzed and the�results showed that the wall woulcJ cost
$5,839 per decibel reduced per residence. A 10' high wall was also modeled and the results
showed that the lower wall would cost $10,875 per decibel reduced per resident.
A separate noise analysis was performed for the EA done by Bonestroo for the TH 10/CSAH 96
interchange project, with similar, though not identical, results. The small differences in the
analyses are largely attributable to daily differences in noise levels when measurements were
taken as well as more detailed geometrics than used for the I-694 EA . This study showed that the
cost per decibel reduced per residence would be $7,627.
While the results of the finro analyses differ slightly due to studying different locations, there is a
significant overlap in the areas studied and the results of varying wall height and length would likely
yield similar results: the benefits of the wall decrease as the wall height is reduced, thus the
cost/benefit ratio becomes worse with a lower wall. Varying the length of #he wall will perpetuate

the relationship between the number of residences benefitted and the cost. There is simply not
enough density of residences to meet the cost effectiveness threshold.
We would also like to clarify that even i� this project could use the new FHWA/MN/DOT noise
policy,(which it cannot) it would not allow vacant lots to be included in noise analyses unless a
building permit has been issued. Including the three vacant lots on Lakeshore Place in the noise
analyses would not alter the conclusion that there is not a cost effective noise wall design for this
neighborhood.

Per the request of the City of Arden Hills, Bolton & Menk has reviewed two formal noise studies that
were completed in the area of TH 10 and`CSAH 96. These included the TH 10 Barrier Study, dated
March 18, 2008 and the Environmental Assessment CSAH 96 and US 10 Grade Separation Project,
�proved bYMn/DOT Office of State Aid on October 25, 2010. In addition, we have reviewed the
October 11, 2011 review letter from Peter Wasko at Mn/DOT to James Tolaas at Ramsey County. Below
is a summary of our review relative'to residences along Lakeshore Place/Old Hwy lO located southwest
of the TH 10/CSAH 96 intersection:
• The combination of the two referenced studies provides sufficient analysis of noise conditions
and potential mitigation strategies for this azea. The two studies overlap the area in question.
Additional study would result in the same conclusion and therefore not necessary.
• Recognizing the studies were conducted independent from one another and for sepazate proposed
highway projects; their results in overlapping areas vary a bit. This is due to slightly different
assumpUons and modeling inputs. While a bit different, both sets of results appear valid and
generally consistent.
• Both studies provide the same general� conclusions for the area in question. Both found current
noise levels exceed state and federal thresholds and warrant consideration of noise mitigation.
Both found noise mitigation could be feasible in reducing highway noise levels by 5 dBa or more
for adjacent residences. Both found the cost effectiveness of noise mitigation would NOT be
reasonable relative to established thresholds.
� I have contacted Anne Claflin at the Minnesota Pollution Control Agency (MPCA) to confirm
that platted residential lots without homes are not to be included in cost effectiveness analysis.
Even with the addition of three platted lots into the calculation, the noise mitigation costs would
remain above the established reasonableness threshold of $3250 per decibel reduced per
residence.
• The conclusion in the October 11, 2011 memo that "There is simply not enough density of
residences to meet the cost effectiveness threshold" is valid and summarizes the conclusion of
both studies accurately.
Neither Mn/DOT nor Ramsey County is offering to include noise mitigaUon up to the cost effectiveness
threshold with remainder of cost being bome by the city. On the contrary, any noise mitigation as part of
this project would need to be shouldered by the city or other local source in its entirety.

A RESOLUTION APPROVING THE FINAL LAYOUT (3A) FOR THE
US 10/HWY 96 IMPROVEMENT
WHEREAS, Ramsey County is proposing to undertake an improvement to US 10/Hwy
96 and is requesting Municipal Consent approving the final layout (3A); and
WHEREAS, the City of Arden �Hills is concerned about the effects the improvement will
have on the City and provided four conditions to Ramsey County expressing those concerns; and
WHEREAS, Ramsey County submitted a letter dated October 21, 2011, adequately
addressing each of the four conditions; and
THEREFORE, BE IT RESOLVED by the Mayor and the City Council that:
1. The City approves final layout 3A of the US 10/Hwy 96 improvement.
2. Resolution 2011-048, adopted September 26, 2011, is hereby rescinded.
