SUBJECT: Adopting Special Assessment for the Abatement of the Public Health Nuisance at
1415 Glenhill Road
Background
The County declared the property at 1415 Glenhill Road to be a public health nuisance and
ordered the clean-up of the property that included the removal of animals per the City's Animal
Control Regulations. The City is allowed to recover the fees related to this abatement. The
property owner has been billed for these costs and the City has been informed of the property
owner's refusal to pay this bill.
The City will be following the 429 Special Assessment process for this abatement. The 429
Special Assessment process has been used by the City for street improvement projects.
A public hearing has been scheduled as required.
Staff Recommendation
Staff recommends that the interest rate for this special assessment to be set at 4%. This interest
rate is derived from adding 2% to the first quarter investment portfolio return rate of 2%. Staff
also recommends setting the payment period to 15 years which would keep the annual
installment amounts reasonable. Overall, staff recommends a motion to adopt Resolution 2012-
019, authorizing the special assessment for the collection of the abatement costs and the
transmitting of this special assessment to Ramsey County to be collected with property taxes.

RESOLUTION ADOPTING SPECIAL ASSESSMENT FOR THE ABATEMENT OF
THE PUBLIC HEALTH NUISANCE AT 1415 GLENHILL ROAD

WHEItEAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for the abatement
of the public health nuisance at 1415 Glenhill Road.
NOW, THERFORE, BE IT R�SOLVED by the Mayor and the City Council that:
1. Such proposed assessment is hereby accepted and shall constitute the special assessment
against the land named above.
2. Such assessment amount of $9,394.62 shall be payable in equal annual installments
extending over a period of 15 years, unless prepaid, the first of the installments to be
payable with general taxes levied in 2012, collectible with such taxes during the year
2013. The assessment shall bear interest at the rate of 4 percent per annum from the date
of the adoption of this assessment resolution. To the first installment shall be added
interest on the entire assessment from the date of this resolution until December 31, 2012.
To each subsequent installment when due shall be added interest for one year on all
unpaid installments.
3. The owner of this property may, at any time prior to certification of the assessment to the
County Auditor, pay the whole of the assessment, with interest accrued to the date of
payment, to the City Administrator, except that no interest shall be charged if the entire
assessment is paid by July 11, 2012. The owner may at any time thereafter, pay to the
County Auditor the entire amount of the assessment remaining unpaid, with interest
accrued to December 31 of the year in which such payment is made. Such payment must
be made before November 15 or interest will be charged through December 31 of the
succeeding year.
4. The City Administrator shall forthwith prepare and transmit a certifed duplicate of this
assessment to the County Auditor to be extended on the property tax lists of the County.
Such assessments sha11 be collected and paid over the same manner as other municipal
taxes.
