SUBJECT: Campaign Signs
Background/Discussion
I have requested staff to provide some background information on the state laws and local
regulations related to campaign signs. A discussion on campaign signage needs to take place so
that everyone understands what can and cannot be enforced regarding the location of campaign
signs.
In recent conversations with Ramsey County Elections Manager Joe Mansky, the City has
learned more about the County policy on campaign signs. Staff will need City Council direction
on what to do with signs in the County right-of-ways. Staff actions related to removal of signs
will have to be consistent. Additionally, I hope that the amount of staff time dedicated to address
campaign signs in the right-of-ways will be manageable.
Attached is some background material from the City Planner, Deputy Clerk, and Ramsey County

SUBJECT: Campaign Signs
Background/Discussion
With elections upon us, it is a good time to review the rules of election sign placement.
Section 1230.01 Subd. 2 and Section 1250.03 Subd. 2, 3 and 4 of the City's Sign Code pertain to
campaign signs (Attachment A). According to City Code, non commercial signs in an election
year (campaign signs) may be placed in City rights-of-way (ROW). The City Code further
stipulates that the campaign sign be placed with the permission of the property owner that shares
a property line with the adjoining ROW where the sign is located.
While specific setbacks are not outlined in the City Code, all signs must meet the clear vision
regulation, which requires that nothing can materially impede sightlines at street intersections
within a triangle with legs that are measured along the pavement of the road and extended 30 feet
in each direction of the intersection. Nor can signs be placed in a manner that generally impedes
the flow of traffic, or creates a hazard. In the last election year, Staff followed up on complaints
about signs that were blocking sightlines or creating a hazard and asked property owners, or in
some cases the campaigns themselves,to move the signs as necessary.
The City Code also states that signs placed in Ramsey County or State ROW are subject to the
regulations of those jurisdictions. The State and County do not allow signs to be placed in State
and County ROW. MnDOT and the County usually enforce this,though the City can as well.
Joseph Mansky, Ramsey County Elections Manager, provided a memo dated July 12, 2012 that
outlines campaign signs in highway ROW (Attachment B). Minnesota Statute § 160.2715
(a)(10) provides that it is unlawful to paint, print, place or affix any campaign sign or
advertisement within the limits of any highway. Mr. Mansky indicates that State and County

Public Works Staff can and will remove campaign signs that are obviously located in a ROW.
City Staff may also remove campaign signs within County and State ROW. In fairness to all
candidates, enforcement of this State law should occur uniformly throughout the County. He
_ also suggests__contacting the candidate_or political committee prior__to_the removal of the
campaign sign, which is already a practice followed by City Staff.
State Statute § 21113.045 states that in any municipality, whether or not the municipality has an
ordinance that regulates the size or number of noncommercial signs, all noncommercial signs of
any size may be posted in any number from 46 days before the state primary in a state general
election year until ten days following the state general election (Attachment Q. The City cannot
have regulations that are more restrictive than this.

Section 1230—Exempt and Prohibited Signs
1230.01 Exemptions. All signs shall require an approved sign permit prior to placement
except for the signs specifically noted in this section. Exempted signs shall not reduce the
permitted signage for a property. These exemptions shall not relieve the owner of the sign
from the responsibility of its maintenance and its compliance with the provisions of this
Chapter or any other law or ordinance regulating the same.
Subd. 2 Non-commercial Signs in an Election Year. Signs of any size containing
non-commercial speech may be posted from August 1 in any general or City election
year until ten (10) days following the general election and thirteen (13)weeks prior
to any special election until ten (10) days following the special election provided that
the signs are in compliance with Minnesota Statutes. These non-commercial signs
shall be placed in accordance with Section 1250.03 Subd 2,3, and 4.
1250.03 Temporary Off-premise Signs.
Subd. 2 Permission. The sign owner shall obtain permission from the property
owner on which the sign is placed. Failure to obtain permission may result in
removal of the sign. If the sign is placed in City right-of-way,the sign owner shall
obtain permission from the property owner that shares a property line with the
adjoining right-of-way where the sign is located. Failure to obtain permission may
result in removal of the sign.
Subd. 3 Disclaimer. The City of Arden Hills shall not be responsible for damage to
any signs placed in the right-of-way.
Subd. 4 Right-of-way Regulatory Authority. Off-premise signs placed in Ramsey
County or State of Minnesota right-of-way shall be subject to Ramsey County and
State of Minnesota regulations. Failure to obtain permission from the appropriate
agency may result in removal of the sign.

SUBJECT: CAMPAIGN SIGNS IN HIGHWAY RIGHTS OF WAY
This memo is a reminder that the placement of campaign signs in the state and county highway
rights of way is prohibited by state law.
Minn. Stat. § 160.2715 (a)(10) provides that it is unlawful to paint, print, place or affix any
campaign sign or advertisement within the limits of any highway.
State and county public works staff will remove campaign signs that are obviously within the
right of way of a highway. City officials are also authorized to remove campaign signs from
highway rights of way when necessary to comply with the state law.
To be fair to all candidates and political committees, enforcement of this provision of state law
should occur uniformly throughout the county.
Before removing a campaign sign, you may wish to first contact the candidate or political
committee responsible for placement of the sign and give them the opportunity to remove or
relocate the sign to a more appropriate location.
Please let your candidates know about this matter.
