HomeMy WebLinkAbout2011-047 , t EN HILLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2011-047 A RESOLUTION VACATING A CERTAIN ELECTRIC UTILITY EASEMENT AND PEDESTRIAN WAY EASEMENT WHEREAS, the Arden Hills City Council conducted a public hearing on the 26th day of September, 2011, preceded by mailed and published notice, as required by Minnesota Statutes 412.851 and 462.358, subd. 7; and WHEREAS, the purpose of the public hearing was to consider the vacation of the public's interest in: The South 10 feet of the following described parcel of land, towit: All that part of the South Half of the Southeast Quarter of the Southeast Quarter, Section 27, Township 30, Range 23, lying between the Northerly right of way limits of U.S. Highway No. 10, and the Southerly right of way limits of the Minneapolis, St. Paul and Sault Ste. Marie Railroad, and the Westerly right of way limits of Lexington Avenue and Easterly of the West 250 feet of said Southeast Quarter of the Southeast Quarter of Section 27, Township 30, Range 23. WHEREAS, On the 27th day of June, 2011, the City approved a Preliminary and Final Plat of the above referenced parcel, replatting the property as the Davidson Addition, lots 1 and 2. WHEREAS, all of the above-referenced easement is known as the "Perpetual Underground Electrical Utiliet Easement and Pedestrian Way Easement" as recorded in Document No. 2114719 and is hereinafter collectively referred to as the "Easement"; and WHEREAS, the Arden Hills City Council has determined that it is in the public's interest to vacate the Easement. NOW, THEREFORE, BE IT RESOLVED, that the Arden Hills City Council hereby vacates the public's interest in the Easement and directs the City Administrator to file a certified copy of this Resolution with the Ramsey County, Minnesota Recorder.
