Applicant: City of Arden Hills
Request: Development Moratorium Rescission
Requested Action
Motion to approve Resolution 2012-038, rescinding Ordinance 2012-005, and lifting a city-wide
moratorium on multi-family dwelling units.
Background
On June 25, 2012, the City Council voted to approve Ordinance 2012-005, adopting a city-wide
moratorium on multi-family dwelling units. The City Council directed Staff to move forward
with a zoning study to look at multi-family design standards. Based on the zoning study, on
September 24, 2012, the City Council voted to approve Ordinance 2012-007, adopting new city-
wide regulations for multi-family dwelling units.
Recommendation
Staff recommends approving Resolution 2012-038, rescinding Ordinance 2012-005, and lifting
the city-wide moratorium on multi-family dwelling units.

RESOLUTION NO. 2012-038
A RESOLUTION RESCINDING ORDINANCE 2012-005 TO LIFT A CITY WIDE
MORATORIUM ON MULIT-FAMILY DWELLING UNITS
WHEREAS, on June 25, 2012, the Arden Hills City Council voted to adopt Ordinance
2012-005, which put in a place a one year city-wide moratorium on multi-family dwelling units
while the City conducted a zoning study,
AND WHEREAS, based on the results of the zoning study, on September 24th, 2012,
The Arden Hills City Council voted to adopt Ordinance 2012-007, adopting city-wide
regulations for multi-family dwelling units, and by a 4/5 vote directed City Staff to publish a
summary of the new regulations in the Shoreview Bulletin,
AND WHEREAS, a summary of Ordinance 2012-007 was published on October 3,
2012, and the regulations went into effect on October 4, 2012, the day following publication,
AND WHEREAS, the Arden Hills City Council directed City Staff to complete the
zoning study and lift the moratorium as quickly as possible.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ARDEN
HILLS MINNESOTA:
adopts this resolution authorizing staff to rescind Ordinance 2012-005, and lift the city-wide
moratorium on multi-family dwelling units.
