Planning Cases are available online at: http://www.ci.arden-hills.mn.us/plannin cq ases EN HILLS MEMORANDUM DATE: November 28, 2012 PC Agenda Item 2.A TO: Planning Commission FROM: Meagan Beekman, City Planner SUBJECT: Planning Case#12-019 - This application requires a PUBLIC HEARING Applicant: 1201 County Road E LLC (TAT Properties LLC) Property Location: 1201 West County Road E Request: Master and Final Planned Unit Development Requested Action The applicant has requested a Master and Final Planned Unit Development (PUD) at 1201 County Road E to redevelop the existing building into 75 apartment units and approximately 20,000 square feet of retail., Background The property at 1201 County Road E is owned by TAT Properties, represented by Rob Davidson. In March 2008, the City approved a request from TAT Properties and Northwestern College granting an Interim Use Permit (IUP) at the former Holiday Inn property that would allow the College to operate a student housing facility in the B-2 District. The IUP expired on May 30, 2011. Prior to the expiration of the IUP, the City approved a request by TAT Properties to allow the student housing on a permanent basis provided that Northwestern College remained the sole tenant of the building, and continued to operate and manage it. Citing a drop in expected attendance and financing, Northwestern College withdrew their interest in the property shortly after that approval. Northwestern College has since vacated the building. City of Arden Hills Planning Commission Special Meeting for November 28, 2012 P:WlanningWlanning Cases12012U2-019-1201 County Road E-PUD MAster and Final PlanUI-28-12-PC Report-1201 County Road E PUD.docx Page 1 of 17 At the time of the IUP approval, the City was just beginning the process of developing the Guiding Plan for the B-2 District, which was ultimately adopted in October 2008. The City's zoning regulations were consequently amended to incorporate the goals of the Guiding Plan for the B-2 District shortly after it was adopted, including design standards for new construction. In 2011, the City reviewed and approved a subsequent proposal from Select Senior Living to convert the building into assisted senior housing and subdivide the property into two parcels. Select Senior Living has since ended their negotiations with the property owner to purchase the property for this use, and that approval expired. In April 2012, the property owner submitted plans to convert the former hotel into 120 units of multi-family housing. The request also included a proposal to subdivide the property into two parcels. The application was denied by the City Council on the grounds that there was not sufficient information provided in order to approve a Master PUD. Shortly after the denial the City passed a moratorium on new multi-family units while a zoning study was conducted. In September 2012, the City passed revised zoning regulations for multi- family housing units. The moratorium was lifted in October. 1. Overview of Request: TAT Properties is now requesting a Master and Final PUD to allow the reuse of the existing building at 1201 County Road E as 75 rental units. The applicant is not requesting a subdivision of the property at this time. The existing building has 155 hotel rooms. Once the conversion is complete, the building would consist of 21 efficiency units, 5 one-bedroom units,_18 two-bedroom units,and 3.1 three to four-bedroom units. The applicant would install full kitchens (counter top, sink, refrigerator, base cabinet drawers, and a range/oven) in each unit. The applicant would bring the property up to building code requirements. A number of amenities are proposed including a fitness center, wi-fi lounge, theater room, gaming room, indoor bicycle parking, and storage for tenants on each floor (Attachment A and E). All four floors of the building would be constructed at once. The former McGuire's restaurant and banquet facilities would be converted to approximately 20,000 square feet of retail at the same time as the apartment conversion. The applicant has a signed lease for the largest bay and plans to complete the renovations to that portion of the building by early spring. The applicant is also proposing a number of site improvements. Included in the improvements is a complete reconstruction of the existing parking lot, inclusion of stormwater ponding, curb, gutter, and parking lot islands with landscaping, as well as additional landscaping throughout the site. The applicant is proposing additional parking stalls in front of the retail bays; however the bituminous drive aisle in front of the hotel portion of the building would be removed and landscaped. The center driveway access would be removed, and the two other access points would remain in their current locations. The applicant is also proposing to remove the front portico, which will increase the visibility from County Road E and update the look of the outside of the building. The applicant believes the target market for the apartments to be students; however, as a market rate apartment building,the landlord must rent to anyone that is approved through the rental application process. The applicant has submitted a letter outlining the reasons for the request (Attachment A), and a plan set(Attachment E). 2. Planned Unit Development (PUD) Process: The PUD process is a tool that provides additional flexibility for developments that an underlying zoning district would not otherwise allow. For example, a PUD may change the setbacks, lot coverage,parking requirements, signage, building height, building materials, landscaping requirements, etc. The process is meant to create a better development than the standard regulations may otherwise allow. The PUD process allows the City to negotiate certain aspects of the development; however, any conditions imposed on the PUD must have a rational basis related to the impacts of the development. While each PUD process is unique, it is a common process used by many cities. The PUD process cannot be used to permit uses that would not otherwise be permitted in the underlying zone. This application is for the reuse of a former hotel into a multiple-family dwelling building. The application is unique because the request is regarding the use of a building and site that are already developed. The typical evaluation as to whether or not the proposed plan meets the minimum requirements of the Zoning Code is more difficult given that there are certain aspects of the site that cannot reasonably be altered, such as the setbacks of the building. That being said there are certain reasonable improvements that can be required for the property given the nature of the PUD process. The proposed redevelopment meets or exceeds both of these requirements. B. Building Setbacks—Flexibility Requested The Zoning Code requires a 20-foot front yard setback for at least 50% of the building fronting County Road E in the B-2 District. In addition,the minimum setbacks in the B2 District are 20 feet in the front and rear and 10 feet in the side yards. The existing building exceeds the side and rear setback requirements, and is set back 60 feet from the front property line. However, 50%of the building does not meet the 20-foot build-to line. C. Density—Meets Requirements: The maximum density for housing in the B-2 District is 20 units per acre. With the proposed redevelopment the density would be 9.14 units per acre. If the property were ever to be subdivided, Lot 1 would be reduced to approximately 6 acres in size, which would increase the density on that parcel to 12.5 units per acre. It should be noted that as a pre-existing hotel being converted into residential apartments, there are structural challenges that would not exist if the building were a new construction project. Furthermore,the proposal does include substantially more usable common and leisure area than the minimum zoning requirements,which may off-set the need for larger unit sizes. In addition, the target market for the units is likely to be younger people and students, who may not desire larger unit sizes. Security Plan The applicant has met with the Ramsey County Sheriff's Department to discuss their security plan. Deputy Eastham has indicated that he has met with the applicants, provided comment, and is satisfied with the direction of discussions as well as the revisions that have been made by the applicant. At this point the security plan has not been finalized; however,the Security Plan will need to be implemented by the applicant, and inspected and approved by the Sheriff's Department prior to issuance of a Certificate of Occupancy on the property. Lighting Plan—Meets Requirements A photometric plan was submitted and has been reviewed by the Ramsey County Sheriff's Department. Revisions have been made based on Deputy Eastham's comments, and the revised plan has been approved by the Sheriff's Department. The plan complies with the City's lighting requirements. Parking—Flexibility Requested The Zoning Code requires at least one stall per unit to be enclosed. The proposed plan indicates no enclosed parking stalls. The pre-existing parking lot and building make structured parking difficult to incorporate onto the site. The applicant has proposed a reconstruction of the parking lot with additional lighting to provide a safe, secure, and aesthetically pleasing parking lot area. Common Area—Meets Requirements The Zoning Code requires common area to be provided that is devoted to recreation or leisure activities, and that both indoor and outdoor common areas be included. The proposed plan has a large amount of interior common space, as well as newly created. outdoor green space. Efficiency Apartments—Flexibility Requested The Zoning Code requires that the number of efficiency apartments in a multi-family building shall not exceed 15%. The proposed plan would have 28% of the units be efficiencies. The existing hotel building lends itself structurally to efficiency units, and the applicant is requesting flexibility on this item in order to allow at least 75 residential units to make the project financially feasible. Bicycle Parking—Meets Requirements The Zoning Code requires a minimum of.5 bicycle parking stalls for every unit. Secure bicycle parking, internal to the building, would be provided for at least 50 bicycles, which exceeds the City's minimum requirement. Window Treatments—Meets Requirements The Zoning Code requires all visible windows to be provided window coverings that are consistent throughout the building. The applicant has not indicated the window treatments that will be used in the building; however, a condition has been added related to this requirement. B. Landscaping and Tree Preservation- Section 1325.05 Subd. 1 and 1325.055 Caliper Inches Required—Exceeds requirements A Landscaping Plan submitted by the applicant is included in Attachment E. Based on the square footage of the proposed buildings the City Code requires 391 caliper inches of trees to be located on site; however,_existing_and preserved trees on the site-are-permitted- to count towards this requirement. There are currently 1,162 caliper inches of trees on site. In addition, the applicant is proposing to plant an additional 65.5 caliper inches of trees on site. No trees are proposed to be removed at this time. Trees along Street Frontage—Flexibility Requested City Code requires that a minimum of one tree be planted along the right of way for every 40 feet of street frontage. Based on the frontage of the property 18 street trees would be required. 13 street trees have been proposed. Staff would recommend that an additional 5 trees be planted along the roadway frontage. Perennials and Shrubberies—Flexibility Requested City Code requires that at least ten percent of the total landscaped area shall be covered City of Arden Hills .Planning Commission Special Meeting for November 28, 2012 P:WlanninglPlanning CaseA2012V 2-019-1201 County Road E-PUD MAster and Final Plant/1-28-12-PC Report-1201 County Road E PUD.docx Page 7 of 17 with perennials and/or shrubbery. For this particular project,the Code requires 20,131 square feet of perennials and shrubbery. The applicant's submitted plans indicate 14,560 square feet would be provided. While this is less than the required amount,the applicant is also providing substantially more landscaped area than the Code would require,which increases the planting bed allotment. If the minimum landscaped area was provided,then only 6,870 square feet of planting beds would be required. Planting Islands-Meets requirements City Code requires that at least ten percent of the parking area be occupied by planting islands that are at least 150 square feet in size, edged in concrete curb, and have at least one tree. Based on the proposed parking lot size, City Code would require 5,637 square feet of parking lot islands. The applicant is proposing 5,741 square feet. All of the proposed islands would meet the size and tree specifications of the Code. Tree Selection Meets requirements The selection and size of trees that will be provided on site meet the requirements of the Code. B. Design Standards—Section 1325.05 Subd. 8 Because the property has already been developed,the majority of the design standards that pertain to the B-2 District are not applicable to this proposal. That being said,there are certain aspects of the design standards that do apply to this particular application because the exterior of the building on the west side will be reconstructed to accommodate retail bays. The purpose of the B-2 Design Standards is to promote a high level of architectural, landscaping, and site design in the District. The City seeks to create a unified, harmonious, and high-quality environment to foster a distinct,positive, and successful image of the City. Building Materials—Meets Requirements At least 75% of the renovated portion of the building will consist of brick or glass. EIFS will be used above the brick to add architectural interest to the exterior. Awnings will be added above all windows and doors as well. Commercial Facade Transparency—Meets Requirements At least 50% of the portion of the facade being reconstructed will have transparent glass. Additional windows and doors will be added to the exterior of the building to distinguish the individual retail bays. Site Furnishings and Seating Areas - Cannot be determined by submitted plans The applicant has not included details on the layout of the site furnishings or seating areas. The Zoning Code requires benches and decorative plantings near the primary entrances of the building, and that seating areas be included as part of the grilling area. Parking—Flexibility Requested The Zoning Code discourages the placement of parking between the building and the right of way. The proposed plan indicates 28 stalls in front of the retail portion of the building. The Code requires parking that is located adjacent to streets to be screened from view with plantings and wrought iron fencing. The proposed plan indicates landscaping and fencing that will be installed at a later date, due to the anticipated streetscape improvements on County Road E. The details of when this landscaping and fencing is installed still need to be worked out with the applicant. The vast majority of the parking is currently located to the rear of the building, which complies with the design standards for the B-2 District. The Code also requires concrete curb and gutter around the periphery of all parking lots, access roads, and parking lot islands. This requirement-is met by_the-proposed plans._Parking_lot islands are included that meet the requirements of the Code as well. Lighting—Meets Requirements A photometric plan was submitted and has been reviewed by the Ramsey County Sheriff's Department. Revisions have been made based on Deputy Eastham's comments, and the revised plan has been approved by the Sheriff's Department. The plan complies with the City's lighting requirements. Pedestrian and Bicycle Circulation—Meets requirements The applicant is proposing six-foot concrete sidewalks with a six-foot boulevard adjacent to Lexington Avenue, as is required by Code. An 8-foot sidewalk easement has also been provided to the City along County Road E. The actual sidewalk construction would not City of Arden Hills Planning Commission Special Meeting for November 28, 2012 P:IPlanninglPlanning Cases12012112-019-1201 County Road E-PUD MAster and Final Planlll-28-12-PC Report-1201 County Road E PUD.docx Page 9 of 17 occur at this time, but would coincide with any streetscape improvements on County Road E and/or the implementation of a dual left turn lane from eastbound County Road E to northbound Lexington Avenue. Bike racks would be located on the interior of the building; however, additional permanently affixed bicycle parking would also be provided outside of the main entrance of the building for visitors to the site. C. Parking—Section 1325.06—Flexibility Requested The applicant is proposing 284 parking stalls. The Zoning Code requires 1.1 parking stalls for every efficiency and 1-bedroom unit, and two stalls for every 2 or more bedroom unit on site, which would require 127 parking stalls for the apartment building. An additional 115 stalls would be required for the retail portion of the project. The total number of parking stalls required by Code is 242. The Zoning Code requires a minimum setback of 20 feet between parking stalls and right of way lines. The proposed development shows 28 parking stalls in the front of the building that encroach 6 feet into the required setback. In part, in exchange for this flexibility, the City is requesting to work with the property owner on a shared western access between the former Holiday Inn site and the former Carroll's furniture site. The shared access may eliminate parking stalls on the north end of the site, and would require up to 20 feet of shared easement between the properties (Attachment Q. 2. Guiding Plan for the B-2 District The Guiding Plan for the B-2 District was accepted by the Council in October 2008. It represents the guiding principles for redevelopment in the District. One of the main challenges to the redevelopment of the B-2 District identified by the Guiding Plan is the current configuration of traffic management on County Road E. In many instances, the existing access driveways do not align with one another which, coupled with a 21-foot wide shared center turn lane; create sporadic left turns along the corridor. In order to address this issue, the Guiding Plan called for the realignment of driveways where possible, and the creation of a new stop light in front of the former Holiday Inn property. The Guiding Plan re-envisioned the former Holiday Inn property as a tear-down redevelopment that would allow for the implementation of long-range traffic management improvements. The current proposal is to reuse the existing building, which does not lend itself to the full City of Arden Hills Planning Commission Special Meeting for November 28, 2012 P:IPlannin&lanning Cases12012112-019-1201 County Road E-PUD MAster and Final Planlll-28-12-PC Report-1201 County Road E PUD.docx Page 10 of 17 implementation of the Guiding Plan, since the building itself impedes the installation of the new stop light. Furthermore, the existing driveways are not ideally located to address the broader traffic issues identified by the Guiding Plan. The existing building is presently situated in a way that allows the building to front on County Road E, with the majority of parking behind, which is in keeping with the goals of the Guiding Plan; however,the primary entrance will be located in the rear of the building, which is contrary to the desire to bring front entrances to County Road E. Multiple-family housing has been identified as an appropriate use in the B-2 District, through a CUP or PUD process, and the incorporation of 20,000 square feet of retail space is in alignment with the Guiding Plan's goal of mixed use. It is likely that the residents of the redevelopment will be able to frequent nearby businesses without the use of motorized vehicles. 3. Signage The applicant has not submitted a signage plan for the property. All signage on the site will be required to meet the standards of the City Code. 4. Traffic Traffic Study The City contracted with SRF Consulting to conduct a traffic study. At the time of this writing, the traffic study had not yet been completed; however, a draft traffic study has been provided to staff. The draft study assumed a 10% multi-use trip reduction to account for residents utilizing nearby businesses; however no trip reduction was assumed for pass-by or multi-modal trips, though it can be assumed that some will exist. The study also assumed approximately 200 residents living in the building. The draft study found that the previous hotel use generated 1,266 trips per day; and that the proposed apartment use, with retail, would generate 1,364 trips per day. The change in use would account for 98 additional trips generated to and from the site over a 24-hour period. The traffic engineer concluded that this was a nominal amount that would not have a negative impact on the mobility along County Road E or Lexington Avenue. Additional analysis is being done to look at the internal circulation of the site, to account for a possible shared access to the west, and possible traffic impacts of a future development if City of Arden Hills Planning Commission Special Meeting for November 28, 2012 P:Wlanning0anning Cases120M2-019-1201 County Road E-PUD MAster and Final PlanU I-28-12-PC Report-1201 County Road E PUD.docx Page 11 of 17 the property were to be subdivided. Staff is hopeful that the analysis will be complete in time for the November 28th Planning Commission meeting. Carroll's Furniture Access Staff has discussed options for providing a more adequate access to serve the three properties lying west of the Holiday Inn site. Since this proposal is moving forward before that issue can be thoroughly analyzed, Staff is suggesting that the applicant agree to work in good faith towards a negotiated shared access with the adjacent property owners. Staff has provided a concept layout of how the shared access might operate (Attachment C). The layout indicates that up to 20 feet may be required from the former Holiday Inn site to accommodate the new drive aisle, and that this would eliminate up to 22 parking stalls from the west and north side of the proposed site plan. However, the applicant is requesting 28 stalls in the front of the building which encroach 6 feet in the front setback, and staff has been able to identify 7 additional stalls which would be possible with the concept layout, creating a net increase of 13 parking stalls on the site. The applicant is not being asked to pay for any of these improvements, and reconstruction of the west portion of the Holiday Inn site could be suspended until a final solution is agreed upon by all parties. The City's intention would be to minimize any impacts to the Holiday Inn site as much as possible. 5. Additional Review The Building Official and Fire Marshall reviewed the plans and have submitted their comments (Attachment B). The Public Works Department reviewed the plans and has expressed concerns regarding the storm water calculations and drainage plan. The issues are technical in nature, and the City Engineer has requested clarification prior to the City council's review of this item. This condition has been added to the conditions of approval. Ramsey County has reviewed the plans and has requested additional easement along County Road E and at the corner of County Road E and Lexington Avenue (Attachment D). The easement would accommodate a future dual left turn lane on County Road E. The applicant has incorporated this request into the submitted plans. In addition, the City has requested an 8-foot sidewalk easement immediately to the north of the County's easement request, as well as a 360 square foot easement on the corner of County Road E and Lexington Avenue for a gateway sign and associated landscaping. The applicant has requested language to further City of Arden Hills Planning Commission Special Meeting for November 28, 2012 P:IPlanningW Tanning Casesl2012V 2-019-1201 County Road E-PUD MAster and Final PlanUI-28-12-PC Report-1201 County Road E PUD.docx Page 12 of 17 define the size and scale of the gateway sign and associated landscaping. This language will be included in the easement agreement. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed application meets the requirements of the Zoning Code, advances the goals, and principles within the Guiding Plan for the B-2 District, and would adversely affect the surrounding neighborhood or the community as a whole. Staff offers the following findings for consideration: General Findings: 1. The applicant is proposing to redevelop the existing building at 1201 County Road E into a 75-unit multiple-family building, with approximately 20,000 square feet of attached retail. 2. The proposed redevelopment is located in the B2-General Business District. 3. The proposed use is allowed through a Planned Unit Development process in the B-2 District. 4. The PUD process allows for flexibility within the City's regulations through a negotiated process with a developer. 5. The City has adopted the Guiding Plan for the B2 District that outlines future development principals for the area. 6. The Master PUD and Final PUD are in substantial conformance with the requirements of the City's Zoning Code and design standards. 7. The Master PUD and Final PUD are in substantial conformance with the Guiding Plan for_the_B2 District. - 8. The Master PUD and Final PUD are in substantial conformance with the City's Comprehensive Plan. 9. Where the plan is not in conformance with the City's Zoning Code, flexibility has been requested by the applicant and/or conditions have been placed on an approval that would mitigate the nonconformity. 10. The application is not anticipated to create a negative impact on the immediate area or the community as a whole. 11. Two other development applications have been reviewed by the City and approved in the past two years on this property, both of which did not come to fruition. Further, the City denied a development application earlier in 2012, which requested 120-units of residential with unknown uses for the remainder of the building or a newly created Lot 2. The applicant has made significant changes to their previous proposal, including reducing the number of units, eliminating the subdivision request, and completing the entire building as part of a single phase of construction. Staff understands the frustration of both the City and developer to find a mutually beneficial and productive reuse of this property. In that vein, if the Planning Commission chooses to approve this application, Staff recommends the following conditions of approval: 1. The applicant shall address all engineering comments, listed in the November 16, 2012, staff comments memo to the applicant, to the satisfaction of the public works department before proceeding to the City Council. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. Development agreements, drafted by the City Attorney, shall be signed by the property owners prior to the issuance of development permits. 4. The applicant shall provide a roadway and utility easement, as reflected on the development plans, in favor of Ramsey County, prior to the issuance of development permits 5._- The- applicant shall--provide an- 8-foot sidewalk-easement, as -reflected -on-the - - - - development plans, in favor of the City,prior to the issuance of development permits. 6. The City shall retain the financial surety for at least two years after full implementation of the landscaping plan. The financial surety shall only be released upon successful inspection of the landscaping by the City Planner, which shall only occur during the growing season, 12. The applicant shall submit a financial surety in a form acceptable to the City Attorney for 125 percent of the cost of materials and installation of the sidewalk along County Road E prior to the City issuing any development permits. 13. The applicant shall obtain a certificate of occupancy for the multi-family units within one year of the approval date of the development agreement, or the Master and Final PUD approval shall expire, unless extended by the City Council prior to the approval's expiration date. Extension requests must be submitted in writing to the City at least 45 days prior to the expiration date. 14. All improvements illustrated on the approved plans, as amended by these conditions of approval, shall be completed prior to the issuance of a Certificate of Occupancy. 15. The security plan shall be implemented by the applicant, and'inspected and approved by the Ramsey'County Sheriff's Department prior to the issuance of a Certificate of Occupancy. 16. Since the building is a preexisting structure it does not lend itself to the creation of underground parking and construction of garages is not financially feasible. Reconstruction of the front driveway to add parking in front of the retail space; along with removal of the driveway East of the current canopy to simplify traffic flow at the easterly entrance/exit on County Road E. As additional consideration the developer is willing to permanently eliminate the"middle" ingress/egress driveway access to County Road E. The former restaurant/banquet space will be converted into specialty retail. The City Council voted unanimously to approve Planning Case 12-015 for a Zoning Code Amendment and CUP Application at 1260 Red Fox Road to allow a microbrewery with taproom. The Planning Commission voted unanimously to recommend approval for this item at their October 3, 2012, meeting. November 13, 2012 Work Session The City Council discussed a proposal from Sand Companies, Inc to amend their development agreement for the development of the Arden Village apartment building at 1245 County Road F. Sand Companies is requesting to convert their proposed development from affordable workforce housing units to market rate units. Four units would remain affordable. As part of the proposal, Sand Companies is also proposing to increase the number of units in the building from 55 to 60. The building footprint would remain the same, as several 3-bedroom units would be converted to 1 and 2-bedroom units.
