SUBJECT: Triangle Parcel
Background
In December 2010, the City entered into a Development Agreement with Presbyterian Homes for
the redevelopment of the Johanna Shores senior housing facility. As part of the agreement,
Presbyterian Homes agreed to convey to the City the parcel located at 3151 Lake Johanna
Boulevard(known as the "triangle parcel"). Because the triangle parcel was previously used as a
gas station, Presbyterian Homes agreed to, "at its cost, and prior to Closing, remove any tanks
and remove or remediate any hazardous substances to a Minnesota Pollution Control Agency
standard for non-residential land use."
Presbyterian Homes has notified the City that it has received a Petroleum Tank Release Site File
Closure (Attachment A) from the Minnesota Pollution Control Agency (MPCA) and is prepared
to transfer the property to the City.
Presbyterian Homes' obligation to investigate and remediate the triangle parcel is limited to a
total cost of$50,000 over and above the proceeds of any grant request. Presbyterian Homes has
not asked the City to assist with any grant applications for the triangle parcel, and City staff is
unaware of the total cost of investigation and remediation activities.
The City's obligation to accept the transfer of the property is contingent on its satisfaction with
the environmental conditions of the triangle parcel.
Environmental Investigation and Remediation
Four underground storage tanks were removed from the triangle parcel on December 16, 2011.
Subsequent environmental testing indicated soil and groundwater contamination on and adjacent

to the triangle parcel with the highest concentrations of soil contamination near the former pump
islands at depths of 10 to 12.5 feet below ground(Attachment B).
Presbyterian Homes completed successive rounds of testing to determine the limits of the
groundwater contamination. The groundwater contamination plume has move eastward to the
parcel currently occupied by the Sutton Place Apartments (Attachment Q. Based on the testing
results, the groundwater contamination appears to have stabilized and will likely degrade over
time.
The MPCA follows a risk-based process. For the triangle parcel, because there are no nearby
groundwater wells, the groundwater contamination is not reaching surface water bodies or
aquifers, and the soil contamination is too deep to pose a risk of human contact, the MPCA is not
requiring additional remediation activities at this time. Any further remediation would be in
response to specific development plans. It is unlikely that any development scenario would
result in the removal of more soil than what was required to be removed for footings or
foundations.
Liability
Under Minnesota State law, only a property owner who owned or operated a tank can be held
responsible for investigation or remediation. Because the tanks have already been removed,the
City cannot be held liable for contamination issues related to the tanks. The City is responsible,
however, for implementing appropriate actions for any waste that it"creates" on the site, for
example, by unearthing contaminated materials for footings if the City were to develop a
structure that required footings. In that case, staff recommends that the City hire a consultant to
draft a Construction Contingency Plan for review by the VIC program. Based on the depth of
soil contamination reported, staff does not feel that a Construction Contingency Plan is necessary
if site improvements were limited to the gateway sign, related lighting, and landscaping.
Site Improvements
The triangle parcel has been designated a priority location for a gateway sign. The gateway sign
design that the City has chosen does not require footings. The City Council has discussed
additional site improvements beyond the gateway sign and related landscaping that could
include:
• Driveway closures;
• Completion of curb and gutter;
• Benches;
• A gazebo, clocktower or other structure;

• Community gardens; and/or
• Additional landscaping.
The City Council has requested, and City staff is preparing a menu of site improvement options
including costs. Given the environmental requirements described above, the site's location
nearly surrounded by roadways, and the nearby proximity of Hazelnut Park, staff requests
Council direction on whether structures should be considered as part of the menu of options for
site improvements.

Dear Ms. Belz:
The Minnesota Pollution Control Agency (MPCA) is pleased to let you know it has determined your
investigation and/or cleanup have adequately addressed the petroleum tank release at the Site listed above.
Based on the information provided,the MPCA has closed the petroleum tank release site file.
The closure of the petroleum tank release site file means the MPCA does not require any additional
investigation and/or cleanup work at this time or in the foreseeable future. Please be aware that file
closure does not necessarily mean that all petroleum contamination has been removed from this site.
However, the MPCA has concluded that any remaining contamination, if present, does not appear to pose
a threat to public health or the environment under current conditions.
The MPCA reserves the right to reopen this file and to require additional investigation and/or cleanup
work if new information, changing regulatory requirements, or changed land use makes additional work
necessary. If you or other parties discover additional contamination(either petroleum or non-petroleum)
that was not previously reported, Minnesota state law requires that the MPCA be notified immediately.
You should understand this letter does not release any party from liability for the petroleum
contamination under Minn. Stat. § 115C.021, subd. 1 (2012), or any other applicable state or federal law.
In addition,this letter does not release any party from liability for non-petroleum contamination, if
present, under Minn. Stat. § 115B (2012),the Minnesota Superfund Law.
Please note that as a result of performing the requested work you may be eligible to apply to the
Petroleum Tank Release Compensation Fund(Petrofund) for partial reimbursement of the costs you have
incurred in investigating and cleaning up this petroleum tank release. The Petrofund is administered by
the Petroleum Tank Release Compensation Board (Petro Board) and the Minnesota Department of
Commerce. To learn more about who is eligible, the types of work, and the amount of reimbursement
available, please contact the Petrofund at 651-215-1775, or 1-800-638-0418.

If future development of this property or the surrounding area is planned, it should be assumed that
petroleum contamination may still be present. If petroleum contamination is encountered during future
development work,the MPCA should be notified immediately.
For specific information regarding petroleum contamination that may remain at this leak site, please call
the Petroleum Remediation Program File Request Program at 651-757-2799, or 651-757-2309. The
MPCA fact sheet Request to Bill for Services Performed must be completed prior to arranging a time for
file review.
