RESOLUTION NO. 2013-009
A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY
LOCATED AT 3151 LAKE JOHANNA BOULEVARD
WHEREAS,the City of Arden Hills has entered into a Contract for Private Development
with Presbyterian Homes of Arden Hills, Inc. (the "Developer") dated as of December 20, 2010
(the"Contract"); and
WHEREAS, under the Contract, the Developer agreed to convey the property located at
3151 Lake Johanna Boulevard having a property identification number of 33-30-23-34-0013 and
legally described as:
That part of the south 305.00 feet of the Southwest Quarter of Section 33, Township 30,
Range 23, Ramsey County, Minnesota, lying northeasterly of the center line of New
Brighton Road; said center line running northwesterly at an angle of 63 degrees 37.5
minutes to the south line of said Southwest Quarter from a point 30.4 feet west of the
southeast corner of said Southwest Quarter of Section 33.
(referred to in the Contract as the "Triangle Parcel") to the City for a purchase price of
$1.00, subject to certain terms and conditions; and
WHEREAS, the City has now determined that Developer has carried out any
Environmental Response Actions (as defined in the Contract) required for the Triangle Parcel,
and that Developer has demolished the prior building on that parcel and cleared the parcel of
rubble and debris, all as required under Section 3.5(e)(ii) and(iii) of the Contract;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden
Hills, Minnesota as follows:
1. City staff and consultants are authorized and directed to take all actions necessary
to close on acquisition of the Triangle Parcel, subject to review and approval of
title conditions by staff and consultants in accordance with Section 3.5 of the
Contract; and subject to satisfaction of all other requirements of closing set forth
in the Contract.
2. The Mayor and City Administrator are authorized and directed are authorized and
directed to execute any documents required in order to close on the real estate
transaction described in this Resolution.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS
