grant application made to the Minnesota Department of Natural Resources for the creation of an
off street shared use pathway on the west side of Snelling Avenue N. (Old Highway 10) from
Valentine Park and Lake Valentine Road to County Road E2.
Background
Staff has been preparing an application for a Local Trail Connections Program through the
Minnesota Department of Natural Resources (MnDNR) for the creation of an off street shared
use pathway along the west side of Snelling Avenue N. (Old Highway 10) from Valentine Park
and Lake Valentine Road to County Road E2. Maps of the proposed project are included for
Council review (Attachment A). The application deadline is Friday, March 29, 2013. The City
applied for this grant last year for this same segment but the project was not chosen for award.

This pathway is listed high on the Parks Trails and Recreation Comm
proposed trails. While this is only a segment of the Snelling Avenue N./Old Highway 10
corridor, it is an important connection. In addition, the neighborhood meetings for the Valentine
Park reconstruction identified this as a priority for the residents. This proposed pathway will
provide a safe route for residents from the Valentine Park neighborhood to County Road E2. It
will create important trail connections to Valentine Hills Elementary, Perry Park and Tony
Schmidt Regional Park.
The Local Trail Connections Program is intended to accelerate local trail connections to planned
and existing state trails and other public facilities, not to create significant new recreational trails.
Its primary purpose is to complete connections between where people live (e.g. residential areas
within cities, entire communities) and significant public resources (e.g. historical areas, open
space, parks and/or other trails). Grants are awarded for the acquisition and development of
connecting trails and for removal of barriers that impede full access to these facilities. Priority
has been given to projects that seek to develop residential connections to state and regional
facilities and to link existing trail systems.
Financial Implications
lottery proceeds. This funding is divided between the Local Trail Connections Program and the
Regional Trail Program. Grant awards will be announced in July, 2013. The minimum grant
reimbursement grants. The grantee must complete the project and fully pay for it, produce
documentation that shows actual expenditures and then they will receive seventy five percent of
what was spent up to their grant award. The grant award and match cannot be used for in-house
labor services and/or to meet existing payroll. Only contract services, materials, and supplies
are reimbursable. Other state funds or grants, or Metropolitan Council grants cannot match these
grants. All projects awarded through this grant round must be completed by June 30, 2015. If
the City is awarded this grant, staff anticipates summer/fall 2014 construction. All facilities that
are funded through this program also require a commitment from the applicant that the trail will
be in place and maintained for no less than twenty years. The resolution before you tonight is a
requirement of the grant application (Attachment B).

The project construction costs are estimated at $278,525.00, with engineering (20%) at
$55,705.00 and contingency (10%) at $27,852.50. The maximum grant award is $150,000 and
therefore, the City construction match would be $128,525.00. Engineering (up to 20%) is
reimbursable through this grant. The City will be able to manage most of these costs internally
by utilizing the Assistant City Engineer.
The estimate takes into account the wetlands that exist in this area. The northern 900 feet of the
trail will be ten (10) feet wide with a ten (10) foot boulevard between the roadway and the trail.
However, the southern 475 feet of the proposed trail is adjacent to a wetland and a steep slope
off the roadway down to the wetland. Concrete curb and gutter is proposed along the entire
. A retaining wall, estimated at six (6) feet in
height, will also be constructed to minimize or avoid impacts to the wetland area. A safety railing
will be included with the construction of the retaining wall.
The City has received support letters from Ramsey County Public Works, Ramsey County Parks
and Recreation, Active Living Ramsey County and the Mounds View School District. All are
supportive of efforts to improve the pedestrian safety along the Snelling Ave. N. (Old
Highway10) corridor.
Recommendation
A motion to adopt Resolution No. 2013-015: Supporting the Local Trail Connections Program
grant application made to the Minnesota Department of Natural Resources for the creation of an
off street shared use pathway on the west side of Snelling Avenue N. (Old Highway 10) from
Valentine Park and Lake Valentine Road to County Road E2.

includesthis segment as a proposed segment; and

requirement for the Local Trail Connections Program, and has secured the matching funds;

findings of fact, submitted plans, and conditions in the March 25, 2013, report to the City

Background
The applicants submitted a substantially similar variance request in 2007, which was approved
by the City Council. The project was never built and the variance approval has since expired.
The applicants own the property at 1455 Skiles Lane, which is zoned R-1. The existing home
encroaches 9 feet into the required 40 foot front yard setback. The existing structure is a one-
story walk-out facing Skiles Lane towards the west. The topography drops towards the east and
rear of the home. Skiles lane curves to the east, wrapping around two sides of the parcel, which
also abuts Snelling Avenue to the east. The Code requires a 40-foot front yard setback on three
sides of the property, as it is wrapped on three sides by roadway.
Presently, the dwelling has a two car tuck under garage that faces the rear of the property. The
existing driveway enters the property from the south and curves to the west to access the existing
garage.

The property owner is proposing to construct a new 576 square foot, two-stall, garage adjacent to
the existing garage to the south of the property. The new garage would be oriented to the south
of the property, as opposed to the existing garage, which is oriented to the east. The addition
would remain in line with the front and rear of the existing structure. The new garage would
encroach 24 feet into the required 40-foot side yard setback. Because the property is a walk-out
that drops to the east and rear of the property, the garage addition would not be visible from the
front of the home, and would only be partially visible from the side of the property.
The applicant is also proposing to construct a 192 square foot addition and deck at-grade, on top
of the new garage. The at-grade addition would encroach nine feet at its nearest point in the
required 40-foot side yard setback, and would remain in line with the exi
The applicant is proposing to step back the at-grade addition in line with the curve of Skiles Lane
and to maintain the architectural lines and continuity of the structure.
In total, approximately 480 square feet of the proposed addition would encroach in to the front
yard setback; of this only 96 square feet would be visible from Skiles Lane.
The applicant submitted a substantially similar variance request in 2007, which was approved by
the City. The project was never built, and the variance approval expired. The current proposal is
identical to the previous proposal with the exception of the orientation of the garage which as
been rotated to face the south as opposed to the east.
The applicant has submitted a description of the proposed addition, a response to the variance
evaluation criteria, a letter describing the landscaping plan, and a site plan of the property
(Attachment B).
Findings of Fact
The Planning Commission offers the following fifteen findings of fact for review:
General Findings
1.The lot depth and width exceed the minimum R-1 requirements. The lot size of 13,939
square feet is nonconforming in the R-1 Zone.
2.The existing structure encroaches nine feet into the 40-foot front yard setback along
Skiles Lane. The structure meets all other R-1 setback requirements.
3.The proposed addition would encroach 24 feet into the front yard setback.
Approximately 480 square feet of the proposed addition would encroach into the front
yard setback, of this 96 square feet would be at-grade and visible from Skiles Lane. The
area of the addition outside of the setbacks does not require a variance. The proposed
addition would be in line with the existing home, and the portion visible from Skiles Lane
would step back with the existing structure.
4.The proposed addition does not encroach on the required setback along Snelling Avenue.
5.The existing and proposed lot coverage meets the R-1 Zone requirements.

6.The existing garage does not meet the ceiling height requirements of the Building Code,
thus the proposed garage would bring the property into greater conformance with modern
building code requirements.
7.The dwelling with the proposed addition would not exceed the 35 foot height limit.
8.Dwellings and garages are permitted structures within the R-1 Zone.
9.The existing dwelling and the proposed garage are outside of the 100-year flood plain,
wetlands, and easements.
Variance Findings:
10.The proposal is in harmony with the purpose and intent of the ordinance because it
utilizes the topography of the parcel to minimize visual impact from the addition.
11.The proposal is consistent with the comprehensive plan because it allows the reasonable
use of residential property.
12.A garage and addition are permitted and reasonable uses within the R-1 Zone.
13.The lot is comparably unique in the City. The property is situated on the curve of Skiles
Lane as it intersects with Snelling Avenue, thus creating three front yard setback
requirements to the south, east, and west sides of the lot.
14.The topographic conditions are unique in that there is a significant slope downward from
the west to the east which allows the majority of the addition to be built below grade.
15.Since the proposed above grade addition would not encroach any farther into the front
yard setback than the existing structure, the addition is unlikely to have a negative impact
on the property or the neighborhood. The continued encroachment would have a minimal
visual impact from Skiles Lane.
16.The addition would be visible from the rear of the property, which abuts Snelling
Avenue; however, the area is heavily wooded and the closest neighbor on this side is over
300 feet away.
17.The proposed plans and setback variance for the dwelling do not appear to be based on
economic considerations alone.
Recommendation
The Planning Commission reviewed this application at the March 6, 2013, meeting (Attachment
A), and unanimously recommends approval of Planning Case 13-001 for a variance at 1455
Skiles Lane, based on the findings of fact, submitted plans, as amended by the following
conditions:
1.The project shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission.
2.The applicant shall obtain approval from the Rice Creek Watershed District, and a
copy of the RCWD permit or a waiver shall be submitted to the City prior to the
issuance of any building permits.
3.The structure shall conform to all other regulations in the City Code.
4.The addition shall be the same color and use the same construction materials as the
existing structure.

requesting a variance to construct a below grade garage and above grade addition that would be
16 feet from the side property line. Because of the configuration of the lot with the side yard
facing Skiles Lane, a 40 foot setback is required.
City Planner Meagan Beekman continued the applicants own the property that is zoned R-1. The
existing home encroaches 9 feet into the required 40 foot front yard setback. The existing
structure is a one-story walk-out facing Skiles Lane towards the west. The topography drops
towards the east and rear of the home. Skiles Lane curves to the east, wrapping around two sides
of the parcel, which also abuts Snelling Avenue to the east. The Code requires a 40-foot front
yard setback on three sides of the property, as it is wrapped on three sides by roadway. Currently

current driveway location.
City Planner Meagan Beekman reviewed the property owner is proposing to construct a new 576

which is oriented to the east. The addition would remain in line with the front and rear of the

garage addition would not be visible from the front of the home, and would only be partially
visible from the side of the property.
The applicant is also proposing to construct a 192 square foot addition and deck at-grade, on top
of the new garage. The at-grade addition would encroach nine feet at its nearest point in the
required 40-foot side yard setback, and would remain in line with the existing home’s setbacks.
The applicant is proposing to step back the at-grade addition in line with the curve of Skiles Lane
and to maintain the architectural lines and continuity of the structure. Some trees may be lost but
the applicants will be required to comply with the City’s tree preservation guidelines.
City Planner Meagan Beekman showed photographs of the existing conditions. Sketches of the
new garage and addition were shown.
City Planner Meagan Beekman summarized in total approximately 480 square feet of the
proposed addition would encroach into the front yard setback; of this only 96 square feet would
be visible from Skiles Lane.

Attachment A
City Planner Meagan Beekman stated the findings of fact for this variance request support a
recommendation for approval. If the Planning Commission chooses to make a recommendation
for denial, the Findings of Fact would need to be amended to reflect the reasons for the denial.
If the Planning Commission recommends approval on this variance, Staff recommends the
following four conditions:
1. The project shall be completed in accordance with the plans submitted as amended by the
conditions of approval. Any significant changes to these plans, as determined by the City
Planner, shall require review and approval by the Planning Commission.
2. The applicant shall obtain approval from the Rice Creed Watershed District, and a copy of
the RCWD permit or a waiver shall be submitted to the City prior to the issuance of any
building permits.
3. The structure shall conform to all other regulations in the City Code.
4. The addition shall be the same color and use the same construction materials as the existing
structure.
Chair Larson asked if the aerial shown with the red lines indicates the property lines and Ms.
Beekman stated it is not exactly on the property lines. Chair Larson noted a 6’2 inch overhead
garage door is not in violation of the Code.
Commissioner Holewa asked if the spruce tree would need to be removed and Ms. Beekman
stated she believes it would need to be removed. City Planner Meagan Beekman reviewed the
City Tree Preservation Guidelines. The owner can remove up to 10% of the trees on the property
without mitigation.
Mr. Matthew Wessberg, applicant, stated when the original plan was done in 2007, the plan was
to move the spruce tree, but the tree mover stated the tree could not be situated in the best
location. Mr. Wessberg stated another larger tree has been planted. They have been in the home
since 2005. The home was built in 1954.
Commissioner Thompson asked about the oak tree and Mr. Wessberg stated it is their intent to
keep the oak tree and, if necessary, the deck will be built around it. The existing curb cut will be
used and the retaining walls will remain.
Chair Larson asked if the deck would have posts and Mr. Wessberg stated they would use posts.
Commissioner Holewa moved, seconded by Commissioner Hames, to recommend approval
of Planning Case 13-001 for a variance at 1455 Skiles Lane, based on the findings of fact,
the submitted plans and the four conditions in the March 6, 2013, planning case report.
The motion carried unanimously (5-0).
Commissioner Thompson stated she appreciates the research staff did on the setbacks on other
homes in the neighborhood.

Background
The City has received an invoice from the Lake Johanna Fire Department (LJFD) for capital
expenditures in 2013 (Attachment A). These invoices relate to capital expenditures which were
included and approved in the 2013 budget.
Invoice #423 is for remodeling costs for Station 2 which was budgeted at $109,000.00 of which
Arden Hills share is $28,558.00 and an addition to Station 4 which was budgeted at $399,000.00
of which Arden Hills share is $104,538.00.
The total budgeted cost for these items was $508,000.00; the contract amount of these items is
$435,500.00 (which is less than the budget). This invoice is for one-half of the contract amount
due at this time which is $217,750.00 of which Arden Hills' portion is $57,050.50.

Requested Action
Motion to approve Resolution 2013-016, certifying the attached list of delinquent utility accounts
to Ramsey County.
Background:
Delinquent utility amounts are certified to Ramsey County quarterly.
A list of utility accounts with a delinquent balance was compiled and notices dated February 12,
2013, were mailed. These customers were informed of their delinquent status and were asked to
make payment of the delinquent balance by March 15, 2013. Utility accounts with an unpaid
delinquent balance after March 15, 2013, would be certified to Ramsey County to be added to
property taxes payable in 2014. The certification amount is equal to the unpaid delinquent
balance and an eight percent penalty.
A list of remaining delinquent utility accounts, as of March 15, 2013, is attached. The City will
request that Ramsey County levy the delinquent balances against the respective properties.

, the amount to be specially assessed for DELINQUENT UTILITIES has
been duly calculated in accordance with the provisions of the Municipal Code and Minnesota
Statues; and
WHEREAS
, notices have been duly mailed as required by law; and
WHEREAS
, said proposed assessments have at all times since their filling been open
for public inspection, and an opportunity has been given to all interest parties to present
objections if any, to the proposed assessments; and
WHEREAS
, there were no oral or written objections received.
1.The amounts so calculated and set forth in said notices are hereby levied against
the respective parcels of land described therein, and
2.The proposed assessments are hereby adopted and confirmed as special
assessments for each of said parcels of land and the assessments together with an
additional penalty of eight percent (8%) of the original unpaid amount, inclusive
of any previous delinquency penalty, shall be a lien concurrent with general taxes
upon such parcel.
NOW THEREFORE, BE IT RESOLVED
by the City Council of the City of Arden
Hills, Minnesota, that the City Administrator be authorized and directed to transmit to the
County Auditor a certified duplicate of the assessment roll to be extended upon the property
tax lists of the County, and the County Auditor shall collect said special assessments with
taxes levied in 2013, payable in 2014:

Requested Action
Motion to approve authorization to go out for -evaluate position
classifications, do a current market study, and evaluate our pay equity compliance.
Background
The City last did a market study and upgraded job position descriptions with an outside
consultant in 2007 which resulted in a new compensation system, upgraded classifications and
looked at our Pay Equity compliance.
The Personnel Committee met on March 11 and decided that a new study would be appropriate
given the changes in staff and duties since that time. We also are scheduled to report on Pay
Equity for year-ended December 31, 2013 next spring. To ensure that we are in compliance, the
committee recommends that we go out for RFPs (Request for Proposals) for consulting firms
who specialize in this work.
