PLANNING CASES PlanningCase12-014ZoningCodeAmendment;CityofArdenHills;Multi- A. CityPlannerMeaganBeekmanreviewedthePlanningCommissionisrequestedto considerapprovalofPlanningCase12-014toaddSections1305.04Subd70and 1325.045,andtoamendSections1320.05and1325.06Subd1.JoftheZoningCode pertaining to Multi-family Dwelling Units in the City. CityPlannerMeaganBeekmanstatedattheirJune25,2012,regularmeetingtheCity Councilapprovedacity-widemoratoriumonmulti-familydwellingunitswhiletheCity conductsazoningstudytolookatpossibledesignstandards.Whilethemoratoriumcan lastuptooneyear,theCouncildirectedStafftomoveforwardquicklyandbringforward any proposed zoning code amendments as soon as possible. CityPlannerMeaganBeekmanstatedthatattheirJuly11,2012,worksession,the PlanningCommissionreviewedthescopeofworkforthedesignstandardsstudyand provideddirectiontoStaffonhighpriorityitems.Basedonthatdiscussion, recommendationsfromtheLeagueofMinnesotaCities,andareviewofother codes;Staffprepareddraftregulationsofdesignstandardsformulti-family dwellings.ThedraftwaspresentedtothePlanningCommissionattheirAugust8,2012, worksession.ThePlanningCommissionprovidedfurtherdirectiononanumberof items,includingspecialrequirementsforseniorhousingandtheparticipationofmulti- StaffthenrevisedthedraftregulationsandpresentedthemtotheCityCouncilattheir August20,2012,worksessionmeeting.TheCouncilprovidedadditionaldirectionand revisionsanddirectedStafftomoveforwardwithapublichearingandPlanning Commissionreview.Inaddition,Staffsentthedraftregulationstoidentified stakeholdersinthecommunity,seekingcomments.RepresentativesofTATProperties andArdenVillagesubmittedcommentsonthedraftregulations.Thesecommentswere providedtothePlanningCommission.Basedoncommentsreceivedbystakeholdersand theCityCouncil,StaffhasrevisedthedraftregulationsandisnowseekingPlanning Commission review and a recommendation on the proposed ordinance amendments. City Planner Meagan Beekman reviewed the proposed regulations include: Revisingthereviewprocessformulti-familyhousing;allowingitthrougha conditional use permit process, rather than a planned unit development process Adding a definition for enclosed parking Revising the minimum parking requirements for multi-family housing Creating additional conditional use criteria for multi-family dwellings including: Minimum unit sizes of 600 feet o Submissionofasecurityplanandlightingplanatthetimeofdevelopment o proposal o A requirement that enclosed parking be provided on a per unit basis A requirement that common areas be provided o 3 Percentageofefficiencyapartmentsallowedwithinaspecific o development Minimum bike parking requirements o Window covering requirements o CityPlannerMeaganBeekmanstatedtheCityAttorneyhasreviewedtheproposed regulations and has no issue with the proposed language of the regulations. CityPlannerMeaganBeekmanofferedthefollowingFindingsofFactforthePlanning Theproposedamendmentadvancesthelandusegoalsbecauseitcreateshigh 1. developmentstandardsformulti-familyhousingthatwillvisuallyenhance developmentandpromotecompatibilitywithnearbypropertiesandneighborhood character. Theproposedamendmentadvancestheimplementationstrategiesidentifiedin 2. theLandUseChapteroftheComprehensivePlanbydevelopingdesignstandardsfor multi-familyhousing,whichisaresidentiallanduse,thatensuretheconstructionof high quality, sustainable, and aesthetically enhanced developments. Theproposedamendmentadvancesthehousinggoalsbecauseitwillpromote 3. thedevelopmentofavarietyofhousingopportunitiesthataresuitableforamixof ages, incomes, and household types. Theproposedamendmentadvancestheimplementationstrategiesidentifiedin 4. theHousingChapteroftheComprehensivePlanbyestablishingarchitectural/design guidelines for new multi-family dwelling units. CityPlannerMeaganBeekmanstatedStaffrecommendsapprovalofPlanningCase12- 014toaddSections1305.04Subd70and1325.045,andtoamendSections1320.05and 1325.06Subd1.JoftheZoningCodepertainingtoMulti-familyDwellingUnitsinthe City,aspresentedintheSeptember5,2012,reporttothePlanningCommission.Ifthe PlanningCommissionmakesarecommendationthisplanningcasewillbeonthe September 24, 2012 City Council meeting agenda. CommissionerStodolaaskedforclarificationwhetherseniorhousingwouldfallunder thezoningchangeswhilenursinghomesandassistedlivingwouldnot.CityPlanner Meagan Beekman confirmed she was correct. CommissionerZimmermanaskedifthiswouldapplytonewconstructionandCity PlannerMeaganBeekmanstateditwouldasanynewconstructionwouldneedtoadhere to these standards. ViceChairThompsonaskedaboutthesecurityplan.CityPlannerMeaganBeekman statedtheRamseyCountyDepartmenthasaprogramforsecurityofmulti- familyhousing.TheDepartmentwouldreviewtheconstructionplansand suggestasecurityplanfortheproject.ViceChairThompsonaskedifthe DepartmentcanbecontactedpriortoconstructionforguidanceandCityPlannerMeagan Beekman stated they can. Vice Chair Thompson opened the public hearing at 6:41pm. Mr.RobDavidsonowns1201CountyRoadE(formerHolidayInn)statedheisagainst theproposednewlanguage.Hestatedthenewproposedlanguagewouldpreventthem 4 fromconvertingtheirpropertyintoapartments.HestatedArdenHillsisdoing everythingtheycantopreventtheirpropertyfrombeingdevelopedintoapartments.Mr. Davidsonstatedtheirplanwasdenied.Hestatedtheminimumunitsizeof600SFisin conflictwiththeBuildingCodes.Mr.Davidsonstatedthisisatargetedchangeto preventthemfromdevelopingtheirproperty.Alltheunitswouldbeefficiency apartments.Duetothemoratoriumtheirpropertyisofnousetothem.Mr.Davidson requestedtheCommissionrejecttheminimumunitsize,andtheenclosedparking requirement. Mr.EdVonHoltum,1409IndianOaksTrailstatedhewasamemberoftheEconomic DevelopmentCommission.HestatedwhenMr.Davidsonproposedtheredevelopment projecthestatedtheplannedunitsizeswerenotsmallerthanotherapartmentsavailable. Hestatediftherewasasmallerapartmentdevelopedforyoungerpeople,whoselifestyle wouldfitintosmallerapartmentsizes.HebelievesthisisatargetedplantostopMr. development.HerequestedtheCommissionnotapprovetherevised language. Mr.StuNolan,partnerofRobDavidson.Hestatedhestartedmanaginganddeveloping apartmentsmanyyearsago.Hehasbeeninvolvedinthedevelopingofover10,000 apartments.HehasneverexperiencedanythinglikewhatheisreceivingfromtheCityof ArdenHills.HestatedheisinsultedandcametotheCitywithaproposalandsomeone fromtheCitydecidedtheywereconstructingaTheseapartmentsaremuch saferthanahotel.Theywouldbeoutofbusinessiftheyhadabadreputation.Inorder forsomeonetorentanapartment,acompleteapplicationiscompleted.Itisavery detailedprocessandthoroughchecksarerunoneachapplication.Criminal, Employment,pastrentalchecksaredone.Mr.NolanaskediftheCommissionwould preferahotel.Mr.Nolandoesnothaveaproblemwiththesecurityplan,lightingplan, registrationplan,bicycleparking,windowcoverings.Hestatedtherearesomethingsin theOrdinancethatdomakesense.HesuggestedthisOrdinancemaybetargetingall apartmentdevelopers.TheCityhaddecidedonaunitsizecontrarytotheState mandates.HeisopposedtoUnitMix.Hehasheldfocusgroupsandhadconversations withmanypeopleincludingthecolleges.Heaskedwhatitmeansthatcommonareas needtobeapprovedbytheCity.HehasprojectsgoinginmanyCitiesandnoneofthem haveanyrequirementsastowhatisinsidethebuilding.Theyareproposingamulti- milliondollarprojectinEdinaandthereisnothingconcerningtheinsideofthebuilding. Commonareaswouldbeconstructedtofittheprofileofthetenants.Mr.Nolanstatedthe parkingareashouldbedeterminedbythenumberofbedroomsinthebuildingwhich determinesthenumberofparkingspaces.Generally1parkingspaceperbedroomisthe norm.Thedeveloperisnormallyrequiredtohavesomeadditionalparkingonsite.The undergroundorattachedparkingbeaddedtohisexistingbuilding.Mr.Nolan askedthattheportionspertainingtounitsize,unitmix,andparkingberemovedfromthe proposed zoning code. Vice Chair Thompson closed the public hearing at 7:06pm. ViceChairThompsonaskedCityPlannerMeaganBeekmanabouttheStateBuilding Codecomment.Ms.BeekmanstatedtheCityAttorneyreviewedtheletterfromMr. DavidsonandhispositionwasthattheStateBuildingCodestatesaminimumof220sf andaCitycannothaveastandardlessthantheStateBuildingCodebutcanhaveahigher standard. CommissionerHolewaaskedhowtheCitycameupwith600sfminimumunitsize.City 5 PlannerMeaganBeekmanstatedstafflookedatotherCities(14inthemetroarea).The rangefoundfrom450650sfminimumunitsize.CommissionerHolewastatedheis notsureheiscomfortablewith600sf.Hefeelstherearemanyefficiencieslessthan600 sf and they are suitable for those looking to rent an efficiency apartment. CommissionerStodolaaskedwhenthelastapartmentwasbuilt.CityPlannerMeagan BeekmanstatedthelastapartmentwasbuiltintheShestatedthemoratorium processisallowedintheState.CommissionerStodolaaskedifreviewofthisCodeat thistimeisatypical.CityPlannerMeaganBeekmanstatedgenerallythesurrounding communitiesaresurveyedandtheLeagueofMinnesotaCitiesiscontactedforinput.On occasion the scope is broadened nation-wide. ViceChairThompsonstatedwhenthisfirstcameuptheCommissiondidnotknow where to start. CommissionerHolewaaskedforanexplanationoftheunitmix.CityPlannerMeagan BeekmanstatedPlymouthandLittleCanadawerefoundtohaveadesireforamixofunit typeswithinasinglebuilding.TheCityCouncildirectedstafftoeliminateindependent seniorhousingandincreasetheunitmixto15%.CommissionerHolewastatedheis uncomfortable with the unit size and the unit mix. CommissionerHamesstatedsheisalsouncomfortablewiththisandfeelstheCityis dictatingtodeveloperswhattheycananddo.Theyarewillingtoinvestmoneyin thecommunity.Shestatedtheunitsizeisridiculousanditisnotthecallto determine unit size. She does not support the revised proposal for Code language. CommissionerZimmermanstatedheconcurswithCommissionersHolewaandHames. Hestatedthemitigatingcircumstancesarethisisanexistingbuilding.Hewouldvote against this. CommissionerHamesstatedwhethernewconstructionorre-developmentofa building the City should not determine what is inside the walls. CommissionerStodolastatedshemisunderstoodandthoughttheywerevotingforthe generalCodenotforaspecificproject.CommissionerHamesstatedsheisagainsttelling any business wanting to come into the City their unit size and unit mix. BentBrewstillery CityPlannerMeaganBeekmanreviewedthePlanningCommissionisrequestedto considerapprovalofPlanningCase12-015includingaconditionalusepermit(CUP)for BentBrewstilleryforamicrobreweryandmicrodistilleryat1160RedFoxRoad,aswell as,amendmentstoSections1305.04and1320.05oftheZoningCodetoallowforthe inclusion of microbreweries, micro distilleries and brewpubs as land uses. CityPlannerMeaganBeekmanstatedtheCityhasreceivedaproposalfromBent 2 BrewstillerytoobtainaCUPtoopenabreweryanddistilleryina2,500squarefootbay intheB-4ZoningDistrictat1160RedFoxRoad.BentBrewstillerywouldliketo includeataproomfortheconsumptionofon-salebeerbrewedonsite,aswellasoff-sale sales of growlers and 750 ml bottles. Theapplicantproposesthelargeretailspaceandtaproomwillservethefollowing purposes: Sellbeergrowlers(64-ozbottles)andbombers(22-ozbottles)foroff-premise 1. consumption as allowed by Minnesota law, 2.Sell pints for on-premise consumption in accordance with the Minnesota Pint Law, Sellspiritsforon-premiseconsumption(whenlegal)inaccordancewithMinnesota 3. ApprovalofaConditionalUsePermittoallowamicrobreweryandmicrodistillery 3. with taproom at 1160 Red Fox Road CityPlannerMeaganBeekmanpresentedthelegalbackgroundstatingin2011,theState LegislatureamendedStateLawtoallowtaproomsinmicrobreweriesinMinnesota.This billwascommonlyreferredtoastheandwasfirstproposedbytheownerof SurlyBrewery.Thelawallowsmicrobreweriesthatproducefewerthan250,000barrels ofbeerinayeartohaveataproomwheretheycansellbeerforonsiteconsumption, whichisbrewedonsite.Thelawalsoallowssamplingofbeer,whichisproducedon site. Statelawalsoallowsmicrobrewerieswhichproducefewerthan3,500barrelsofbeera yeartoprovideoff-salesalesof64ounceand750milliliterbottles;however, off-sale sales of beer by the bottle, case or keg is not permitted by State law. Thesaleofonandoffsaleproductsbrewedonsiteisallowedformicrobreweriesbutnot microdistilleries(manufacturersofspirits).DistilleriesareallowedbyStateStatute,but cannotprovideon-sale,off-sale,andsalesoftheirproductsatthelocationinwhichthe spiritsareproduced.Thespiritsmustbedistributedtoanothersiteforonandoffsale sales. MunicipalordinancesmaybemorerestrictivethanStatelawintermsofthesaleof alcohol. City Planner Meagan Beekman reviewed the proposed land use definitions. 3 StaffwasdirectedattheAugust20,2012CityCouncilworksession,toresearch amendingthezoningcodetoallowmicrobreweriesandmicrodistilleriesasconditional usestothemaximumextentallowableunderstatelaw.Theserecommendationswere broughttotheSeptember5,2012planningcommissionworksessionwhereitwas recommendedtostaffthatbrewpubsalsobeincludedasanew,andseparate,landuse frommicrobreweriesandmicrodistilleries.Brewpubsaremicrobreweriesthathavea restaurantcomponentwithon-salesalesofproductsbrewedonsite.Brewpubsalso provide food and can also serve alcoholic products other than those brewed on site. CityPlannerMeaganBeekmancontinuedthePlanningCommissionalsodiscussed allowedprepackagedfoodtobeservedonsitewithinataproom,asopposedtofoodthat ispreparedonsite.Thedistinctionisimportantbecauseestablishmentsthathavefood preparedonsitewouldbeconsideredbrewpubsratherthantaproomsandhavedifferent legal requirements within State Statute. Staffhasprepareddraftamendmentstothezoningcodethatreflectthese recommendations. CityPlannerMeaganBeekmanreviewedcurrentlyArdenHillsZoningCodeallows breweriesanddistilleries,aswellasdistributorsofalcohol,inzoningdistrictsthatallow manufacturing and processing. Thedraftzoningcodeamendmentscreatenewlandusesformicrobreweries,micro distilleriesandbrewpubs.Microbreweryandmicrodistillerylanduseswouldallowthe manufactureanddistributionofintoxicatingalcohol,ascurrentlyallowedbyState Statute,intheassignedzoningdistricts.Microbrewerieswouldalsobepermittedtohave aretailcomponent.Alanduseforbrewpubswouldalsobecreatedtodifferentiate microbreweriesthatdonothaveafoodcomponentandbrewpubsthatdohaveafood service component. Applicationsformicrobreweries,microdistilleriesandbrewpubswouldbeapproved throughtheconditionalusepermitprocess.Theapplicationhassubmittedinformation addressing their request for a Zoning Code Amendment and CUP. Healsoplansataproomwherepeoplecanrelaxandhaveabeer.Theon-sale/off-sale licenseisunique.Onlythebeersandspiritsproducedtherecanbesoldthere.Thehours ofoperationwouldbeverydifferentfromthesurroundingbusinessesandwouldmost likelybe410p.m.Thisisaveryhightrafficareaandheishopingtogetbusinessfrom thetrafficthatisalreadythere.Therewouldbenoodors.Mr.BlumestatedtheBlueFox ispossiblyconcernedaboutcompetitionbuthehasspokewithamanagerandtheyare veryinterestedincarryinghislineintheirbar/restaurant.Thisbusinesswouldbea familyownedbusinessthatwouldbringtaxmoniesintotheCity.Hefeelsitwouldbean advantage to the City. The proposed fence would end 12 feet from the front property line on both side lot lines. CommissionerHolewaaskedaboutawatermain.CityPlannerMeaganBeekmanstatedtheCity PublicWorksEngineerhadsuggestedawatermainbeconstructedinapreviousapplication.He feltthewatermainwouldbemoretiedtoasubdivision.CommissionerHolewanotedthetraffic studyshowedanassumed10%reductionintripsbasedonmodeshareand0%reductionbased onpass-bytrips.CityPlannerMeaganBeekmanstatedtheDirectorofPublicWorksissatisfied withthetrafficstudy.CommissionerHolewastatedthetrafficstudyconcludedthattheproposed redevelopment would not have a significant impact on intersection operations in the area. CommissionerThompsonaskedabouttheparkingstallinthefront(28stalls)andifthatwas sufficientparkinglotsfortheretail.SheaskedhowitcomparedtoShannonSquare.City PlannerMeaganBeekmanstatedtheretailwillrequire114parkingstallstotalandthe28stalls locatedinthefrontwouldnotmeetalltheparkingdemandfortheretail.Therewillstillbesome sharedparkingonthesideandintherearofthebuilding.Therewillbearearbuildingaccess withacut-throughthatwouldallowvisitorstoaccesstheretailareasthroughthebackofthe building.CommissionerThompsonstatedshewassurprisedabouttheaccessfromthebackand it seems a narrow area to access the retail. CommissionerZimmermanaskedhowmanytotalparkingspacesarerequired.CityPlanner MeaganBeekmanstated241arerequiredbut284areprovidedintheplan.Commissioner Zimmermanaskedifaparkingrampwasconsidered.CityPlannerMeaganBeekmanstateda parkingrampwouldmaketheprojectcostnotfeasible.Theproposedplanwouldprovidethe securityaspectsofaserviceparkinglotratherthananenclosedparkingramp.Commissioner Zimmermanstatedsomepropertieschargemoreforparkingintherampandthecostmaybe justified by doing that. ChairLarsonstatedsinceitisapre-existingbuildingthereisnottheluxuryofhavingabelow ground parking area. CommissionerScottaskedifthebuildoutwouldbeallatonce.CityPlannerMeaganBeekman stated there would be a single build out and the construction would take one year. 5 CommissionerHolewareferredtotheretailspacelayoutandaskediftheapartmentresidents couldaccesstheretailareawithoutgoingoutside.Itwasnotedtheycouldnot.Commissioner HolewareferredtotheeastaccessandCityPlannerMeaganBeekmannotedsomeadditional reviewwouldbeneeded.CityPlannerMeaganBeekmanstatedtheaccessmayneedsome further discussion. CommissionerZimmermanaskedaboutthepropertybemarketedtocollegestudentsandif commuterbuseswouldbeutilizedtotransportthestudentstothecolleges.CityPlannerMeagan Beekmanstatedthatisnotsomethingthatispartoftheplan.Commissioner Zimmermanaskediftherewasabusprovidedbythecollegeswouldthathaveanimpactonthe access.CityPlannerMeaganBeekmanstatedashuttlecouldeasilyenterandexitonthenorth side. Mr.RobDavidsonappearedbeforetheCommission.Hestatedtheyworkedhardtoaddressthe requests of the Commission and feels this plan is a win-win proposal. ChairLarsonaskedhowthe4-doorunitwouldwork.Mr.Davidsonstatedtheconstructionofa 3-or4-bedroomunitwouldcombine3or4hotelroomswiththelivingareainthecenter.They are suggesting a movable wall and are attempting to create flexibility depending on the market. CommissionerHamescommentedthisisalsoafamily-friendlyplanthatwouldmeettheneeds of families. CommissionerHolewaaskedaboutthesharedaccesswiththeadjoiningproperty.Mr.Davidson statedtheideaofcombiningthethreedrivewaysisagoodidea;however,theyarebeingaskedto createaturnaroundonthepropertyandfundacombineddrivewaywithnomonetary compensationcomingtotheowner.Mr.DavidsonstatedTATPropertiesmaybeinterestedin sellingtheotherbusinessaportionoftheirproperty.Theeasementisanissuethattheprivate landowners should discuss and resolve. CommissionerHolewaaskedifthereisaloadingdockfortheirplan.Mr.Davidsonstatedthere would not generally be semi-trucks accessing the property. CommissionerHamesaskediftheturnaroundisforemergencyvehicles.CityPlannerMeagan Beekmanstatedtheturnaroundisfortheotherpropertiesandwouldaccommodateasemi-truck. CityPlannerMeaganBeekmannotedcurrentlythereisasharedeasementofwhichthecurrent Holiday Inn property is not part of. CommissionerHamesaskediftheotherpropertiesarecontributingtotheeasementandCity PlannerMeaganBeekmanansweredintheaffirmativeandindicatedfromtheperspective , it would be a shared easement among the property owners. CommissionerScottstatedhebelievesitshouldbeamatterdiscussedbetweentheproperty owners. Commissioner Hames agreed. Itwasnotedthepropertyownerswouldneedtopayfortheportionoftheimprovementstheyare benefittingfrom.CityPlannerMeaganBeekmanstateditisimportantthatitbediscussedatthis time. December 17, 2012, Special Meeting The City Council voted unanimously to approve an amendment to the Arden Village Development Agreement. As part of the request for the amendment Arden Village has converted the 55-unit affordable apartment building into a 60-unit market rate apartment building with 4 affordable units. The conversion necessitated a number of minor interior modifications which included fewer 3 bedroom units and more 1 bedroom units. Additional underground parking was provided, and the footprint was modified slightly. Arden Village is anticipating beginning site work in February. Arden Village was originally approved by the City in March 2010. TheCityCouncilunanimouslyapprovedPlanningCase212-019foraMasterandFinalPUDat 1201CountyRoadEtoallowtheformerHolidayInntoconvertintoanapartmentbuilding.The CityCouncilreducedthenumberofunitsfrom75to74.TheCityCouncilalsorequiredthe developertocompletetheirportionofthewesternsharedaccess.ThePlanningCommission unanimouslyrecommendedapprovalforthisplanningcaseattheNovember28,2012,Special Meeting.
