SUBJECT:2014 Budget Adjustments
Background
DuringtheAugust/Septemberbudgetworksessions,GeneralFundexpenseswere
proposedat$4,269,559.Thiswasanincreaseof$118,698or2.9%.Thisincreasein
expenditureswasfinancedmainlywitha$97,797taxlevyincrease,anincreasein
interest income, and the use of reserves.
Similartothe2013adoptedbudget,$20,000ofreserveswereneededtobalancethe
August/Septemberdraft2014budget.However,sincetheAugust/Septemberbudgetwork
sessions,thepolicebudgethasdecreasedbyapproximately$15,000andanumberof
otherminoradjustmentsweremadesothat,atthistime,theuseofreservestobalancethe
2014budget is no longer necessary.
Ontheotherhand,boththeAugust/SeptemberandthecurrentNovemberdraft2014
budgetsdonotincludeanyexpenditurefortheCityscontributiontoNYFS.This
contributionisabout$15,000in2014andthisamount,orsomeofit,mayneedtobe
included in the 2014 budget.
AsdiscussedwiththeCityCouncilatthespecialbudgetworksessionlastTuesday,
havingthe$500,000TCAAPloan(fromthePIRFund)andtheKimley-Hornexpenses
fortheplanningandtransportationstudiesincludedwithintheGeneralFundisgoodfrom
apublicinformationortransparencypointofview,butitalsomakesyear-to-year
comparisonsof the budget totals very difficult.
Oneofthebudgetitemsthathasremainedconstantsincethebudgetdiscussionsthispast
summer is the proposed 2014 tax levy increaseof $97,797.
Organizational Change
HavingallTCAAPrevenuesandexpenseslocatedwithintheGeneralFundwasreviewed
inmyNovember12memoandwasdiscussedattheNovember12Councilwork
thth
session.HavingalltherevenuesandexpensesintheGeneralFundwasachangefromthe
August/Septemberdraftbudget.ThischangecanbefurtherdiscussedattheNovember
18 work session as desired by the Council.

OneadditionalorganizationalorstructuralchangethatIamrecommendingtotheCity
CouncilisrelatedtotheTransfersbudgetcategory.Currently,andintherecentpast,the
Counciltransfers$200,000fromtheGeneralFundtothePIRFundforprojects.In
additiontoPMPtypeprojects,thePIRFundincludesannualexpendituresof$145,000to
$150,000forstreetcracksealing/sealcoatingand$50,000fortrailrehabilitation.From
myperspective,thetransferof$200,000fromtheGeneralFundtothePIRFund
essentiallygoes to pay for these two maintenance expenditures.
Itisappropriatefromapublicinformationortransparencypointofviewtohavethese
twoexpendituresintheGeneralFundsothatitiseasytoseewhatthecityisspendingin
totalonstreetandtrailmaintenanceactivities.HavingthesetwoexpensesinthePIR
Fundandnotwiththerestofthestreetsandtrailsoperationexpenses,whicharealready
intheGeneralFund,issomewhatconfusing.Accordingly,itisrecommendedthatthese
twostreetandtrailmaintenanceexpensesbemovedfromthePIRFundtotheGeneral
Fundandthatthe$200,000transferout(tothePIRFund)beremovedfromtheGeneral
Fund budget.
Thisrecommendedorganizationalchangedoesnotimpactthetotalamountinthedraft
budgets;itjustdeletesatransferoutandmovesanoperatingmaintenanceexpenseinto
the General Fund from the PIR Fund.
TheCouncilcanstilluseareductionintransfersasawaytoreducethetaxlevy
amount,butnow(assumingmyrecommendationisaccepted)thetransfersreduction
will actually be a cut in the General Fund street and/or trail maintenance expenditures.

TherequestforaparttimeemployeeintheFinanceDepartmentdidnothavethesupport
ofthemajorityoftheCouncilduringtheNovember12discussion.IftheFinance

CouncilshouldconsiderputtingthefundingbackintothebudgetfortheFinance
DepartmentInternssimilartothelevelofpreviousbudgets.Attachedisamemofromthe
Director of Finance and Administrative Services on this part time employee request.
Public Works and Engineering
TheredidnotseemtobetoomanyCouncilquestionsorconcernsonNovember12

regarding the Engineering Intern.
Community Development and Planning
MostofthestaffinglevelsdiscussiononNovember12centeredontheCommunity
th
DevelopmentIntern.ItseemedliketheCouncilmajoritydidnotsupporttheideaofafull
timeInternposition.TheCouncildiscussionwasmainlyrelatedtoworkloadissuesand
havingtheInternpositionremainparttimeorhavingtheInternpositionreplacedwitha
Planner I position.
IrecommendthattheCouncilreestablishthePlannerIpositionandhireMatthewBachler
tofillthispositionandthattheCommunityDevelopmentInternpositioniseliminated.
Belowaremycommentsinsupportofthisrecommendation.Alsoattachedisamemo
fromCommunityDevelopmentDirectorJillHutmacherregardingtheresponsibilitiesand
work load in Planning and Community Development.
TCAAP
My one word answer in support of the Planner I position is: .
SeeingTCAAPcleanedupandputintoproductiveuseisoneofthepriorities,ifnotthe
toppriority,oftheCity.OversightandmanagingTCAAPactivitiesisrequiringalotof
timeanddirectinvolvementfromtheCommunityDevelopmentDirectorandhasbeen
hernumberoneworkresponsibility.ThetimerequiredfromJillforTCAAPactivities
makesitnecessaryforthePlannerIpositiontobereestablishedsothattherequiredwork
ofthe department can get completed in a timely and professional manner.
RamseyCountyhaspurchasedTCAAPandisintheprocessofhavingthesitecleaned
up.TheCityhashiredKimley-HorntocompletetheplanningstudiesforthesiteandCity
staffhastheresponsibilityforcoordinatingandmakingsuretheCouncilandpublicare
involvedinthisplanningprocesseverystepalongtheway.AJointDevelopment
Authority(JDA)hasbeenestablishedandtheCityandCountystaffsalsoserveasthe
stafffortheJDA.TheCityworkloadforJDAactivitieswillincreaseinthefuture
regardlessiftheCityhiresconsultingfirmstodothereviewofdevelopmentproposalsor
iftheCitystaffdoesthereviewsofthedevelopmentproposalsinhouse.Itshouldbe
notedthatiftheCitydoesthereviewofthedevelopmentproposalsinhouse,theCitywill
bereimbursedfromtheJDAforthetimespentontheseprojects.IanticipatethattheJDA
will start to see some development proposals in 2015.

REQUEST
Request Summary
WehaveanalyzedresourceneedsinaccomplishingtheFinancedepartmentandAdministrativeServices
workloadandgoals,evaluatedoptionsanddevelopedtherecommendedresourceadditionofaPermanent
Part-TimeAccountingClerk/OfficeSupportpositionandeliminatingtheInternpositionsinbothFinanceand
Administrative Services.
Key Objectives
1.Provideclerical support to Finance staff to input payroll and accounts payable.
2.Provide clerical assistance for finance file maintenance and audit work.
3.Provideclerical support to Finance staff on routine utility billing duties.
4.ProvideclericalsupporttoCityClerkonroutinemaintenanceofhumanresourceandbenefitrecords,
records management, minutes, and agenda preparation.
5.Assist Finance and Administrative Services with special projects.
6.Provide improved internal controls.
7.FreeuptimeforFinanceandCityClerktocompletedutiesthathavebeendelayedordeferreddueto
humanresourceconstraintsincludingimplementingthecapitalprojectmanagement,purchaseorder
systems,EFTvendorpayments,SharePoint(intranet),policyupdates,recordsmanagement,and
information technology projects.
8.Assist senior management staff in responding to workload backlogs.
Additional Staffing Needed to Accomplish Department Mission, Goals and Objectives
Withthenewupgradeoftheaccountingsystem(Springbrook),auditingstandards,GASBstatements,major
capitalprojects,upgradestothebudgetingprocess,andothergoalsandinitiatives,theFinanceand
AdministrativeServicesDepartmentisnotabletoadequatelyaddressitscoremission.Statedsimply,
accomplishingthemissionoftheFinanceandAdministrativeServicesDepartmentwiththecurrentstaffing
levelisnotsustainableusinginternsasthereisnocontinuityasthetrainingperiodaswereplacethem
requirestimeofcurrentstaffanddependingonhowlongwehavethemitalsoimpactswhatprojectswecan
givethemandhowmuchexpertisetheydevelop.Thispreventscurrentstafffrombeingabletoworkon
projectsandCouncilgoals.Meetinglong-rangeplanning,reportingandmonitoringneedsinallareasofthe
divisionsoperationsmeansincreasingtheclericalsupportcapacityoftheFinanceandAdministrative
ServicesDepartment.ExamplesofdutiesandprojectsthatwouldbeassignedtotheAccounting
Clerk/Office Support position continue to include those previously done by interns:
1.Assistinginimprovingourcustomerservicelevelsprimarilybydecreasingtheresponsetimetoanswer
utilitybillingquestionsanddatarequests.Thisincludesreducingourresponsetimeonsimpleinquiries
regardingbudgetpreparationtoimprovingourabilitytotimelyemploycomplexcostanalysesrequiredin
thedevelopmentoftheutilityratesandotherchargesforservicesascurrentstaffwouldhavemoretime
to devote to these activities.
2.AssistwiththepreparationandpublicationoftheCityCouncilagendapacketsandprocesstoavoid
current staff from working long hours or overtime.

state,grantorandotheragencies.Thesereportsincludereimbursementrequestsandotherreports
requiredbytheU.S.DepartmentofJustice,MinnesotaPublicFacilitiesandPollutionControlAgencies,
MinnesotaOfficeoftheStateAuditor,MinnesotaDepartmentofRevenueandotheragenciesand
organizations.
5.Assistingwithclericalsupportintheauditpreparationwhichgivescurrentstaffmoretimetodoanalytical
work.
6.Perform cash management activities such as bank deposits by improving internal controls.
7.Assisting in the publication of the Annual Budget and Capital Improvement Plan (CIP) books.
8.AssistingwiththesetupandmaintenancetheCityIntranetsite(SharePoint)whichtothispointhas
been deferred because of workload constraints.
9.AssistingtheDirectorofFinanceandAdministrativeServicesandtheCityClerkwiththewebsiteand
other IT duties and employee education on software issues.
10.Assumedutieswhichpromoteanimprovedinternalcontrolsystem,facilitatefinancialtransparency,and
contribute to safeguarding of the Citys assets, and the management of City records.

Financial Considerations
Addingapermanentpart-timeAccountingClerk/OfficeSupportpositionintheFinanceandAdministrative
ServicesDepartmentwillcost$26,684in2014.TheGeneralFundimpactwouldbea$70savingsasthis
positionwouldreduceinterncostsintheFinanceandAdministrativeServicesdepartmentandthisposition
isallocatedacrossallfundsasitprovidesgeneralfinancialandclericalsupportasdotheotherpositionsin
theFinanceandAdministrativeServicesdepartment.ThispositioniscurrentlyincludedinthePreliminary
2014 budget.

ContinuetheStatusQuo:TheFinanceandAdministrativeServicesDepartmentwilldothebestitcanto
prioritizeworkloadandrespondtoCityCouncilandcommunityneeds.However,givenstaffingconstraints,
workloadandprojectsthathavealreadybeendeferredordelayed,maintainingthestatusquowilllikely
resultinareductioninFinanceandAdministrativeservicestothecommunityandorganizationfromcurrent
levelsiftheinternsareremovedcompletely,thiswouldalsomeanthattheauditfindingsfortimely
reconciliationswouldmostlikelyreturn,finalbudgetbookswouldlikelybecompletedlateintheyearand
quarterlyfinancialreportingwouldmostlikelybelate.CityCouncilgoalsfordevelopingpoliciesand
proceduresforrecordsmanagement,storingrecordsonlaserfiche,scanningandretentionofhistorical
documentsinthebasement,completingtheoperatingprocedures,formsandpoliciesforhumanresources,
personnelpolicyupdate,andtechnologyusemaycontinuetobedelayed.Wecouldlookatdiscontinuing
ourparticipationintheGFOAawardprogramswhichwouldgivesomerelief,butthebenefitstothepublic
seem to out-weigh the cost and time savings of choosing to not participate in the programs.

Beingadequatelystaffedallowsustocompletethehavetodoitemswithinareasonable
responsetimeandwithanacceptablelevelofdetailandprofessionalismduringmostweeks.
Withoutanadequatelevelofstaffing,wewillneedtoexaminethehavetodoworkloadand
findwheretaskscanbedelayedorminimallycompleted.Asshownabove,thecurrentinternhas
primaryresponsibilityforseveralhavetodoitemsincludingsomeplanningcases,signage
requestsandpermits,landscapinginspectionsandotherdevelopmentagreementcompliance

Overthepastfewyears,theCityhasbeenfortunatetohavesomeverywell-trainedandhard-

Requested Action
TAT Properties is requesting a review of a proposed PUD Amendment at 1201 County Road E
for a 17,000 square foot retail building to be located at the corner of County Road E and
Lexington Avenue.
Background
In 2012, the City Council approved a PUD for 1201 County Road E to allow the reuse of the
existing building on the property for residential apartments and retail space. Approximately two-
acres of land on the eastern end of the site remain undeveloped (Attachment A). The PUD
Agreement between the City and the property owner states that any future development of this
area would require a separate land use application.
TAT Properties submitted an application for a PUD Amendment on September 9, 2013
(Attachment B). The proposed project includes a 17,000 foot square retail building that would be
leased to Goodwill. No subdivision of the property is planned at this time. Two access drives
were originally proposed: one on Lexington Avenue and the second on County Road E at the
eastern end of the site, which is an existing access point. Ramsey County reviewed the plans for
the project and determined that an access along Lexington Avenue would not be permitted due to
traffic management concerns. Staff subsequently notified TAT Properties that the application
was determined to be incomplete because the proposed site layout was no longer feasible in light
. TAT Properties has since updated their plans to address access to and
circulation on the site (Attachment C).

Staff has communicated with the applicant that a traffic study will also need to be completed
before the case is reviewed by the Planning Commission. Section 1325 of the Zoning Code
requires that a traffic study be done for all projects in the B-2 District that involve significant
modifications to existing sites. Staff has received a proposal from SRF Consulting to complete
the traffic study. At this time, TAT Properties is seeking a bid from another engineering firm for
the traffic study.
Staff has advised the applicant that a traffic study completed by a neutral third party, hired by the
City, is strongly recommended. If the applicant chooses to provide their own traffic study, the
City will require a review by a third party traffic consultant hired by the City. The costs of the
review will be paid by the applicant through an escrow.
The next deadline for the submittal of land use applications is December 2, 2013. The City will
need to receive a complete application along with an escrow for the traffic study or the third
party review by this date for the case to be reviewed by the Planning Commission on January 8,
2014.

Requested Action
Molly Behymer,owner of Creative Cateringcurrently located in the Country Financial building,
is requesting that the City Council review her proposal for aBanquet, Catering and Retail Center
at 1203 County Road E.
Background/Discussion
The proposed use for a banquet, catering and retail center would be located at 1203 County Road
E, also knownas the Carroll’s Furniture property. The applicant is proposing to separate the
buildinginto three sections in order to accommodate the proposed uses. According to the
material provided by the applicant,the upper level (15,000 sq. ft.) wouldbe banquet and meeting
room space, the lower level (15,000 sq. ft.) wouldbe utilized for food production and catering
servicesand thesouthern portion of the building (7,000 sq. ft.) that fronts County Road E would
be constructed into retail bays and leased to thirdparty tenants.The applicant has indicated her
intentto use the banquet hall for events for up to 400 people. Prior topurchasing theproperty
Ms. Behymer would like direction from the Council regarding the proposed use.
The former Carroll’s Furniture property, currently configured as a single tenant building, is
approximately 40,000 square feet on a single tractof landthat is 1.14 acres in size. The property
is located within the B-2 General Business District, wherebanquet facilities (restaurants) and
retail uses are permitted.Catering facilities are classified as “manufacturing & processing” and
are only permittedas an accessoryuse in the B-2 District. Under this classification the banquet
facility would be the principal use and the catering activities would be an accessory use.

Without a functioning banquet facility the catering activities would have to ceaseas the Zoning
Code does not allow accessory uses to operate as principle uses.
Staff has concerns regarding parking and access to the site.The existing parking lot on the
premises hasa total of 35 parking spaces, which is not adequate for the proposed use. Of these
35 parking spaces, 17 spaces are likely to be removed if the City constructs a sidewalk in the
existing easement (see attachment D). Under the Zoning Code,restaurant usesrequire one (1)
parking space for every two seats, retail uses require one (1) parking space for each 150 square
feet of gross retail floor space and catering uses require one (1) space for each employee on a
major shift plus one (1)additional spacefor each vehicle used in connection with the business or
one (1) space for each 1,000 square feet of floor area. Based on the information provided to staff
approximatelyof 262 parking spaces would be requiredfor the proposed use.The applicant is
proposingto mitigate the parking deficiencies by securing shared parkingagreementson
adjacent sites and on other property located in the area. Staff would like to note that the Zoning
Code requires parking to be within 800 feet of the main entrance to the principal building if a
parking agreement is developed.
City staff has discussed the sidewalk constructionand easementalong the southern side of the
property, the possible driveway closure on the west side of the parking lot and the improvement
of the shared drivewayalong the east property line. The applicant has indicated her willingness
to work with the Cityto address these items. In the narrative Ms. Behymerhas stated her intent
to update the buildings appearance and curb appeal along with updating signage, windows, and
lighting.
Planning Commission & City Council Review
Staff has determined that at a minimum a site plan review would be required to address the
increase in parking demand and a variance required in order to waive the requirement for
outdoor seating in the B-2 District. If the applicant decides to pursue a banquet, catering and
retail center at 1203 County Road E additional review would be required by the Planning
Commission and the City Council.

Background
The Arden Hills Comprehensive Plan designates 529 acres of land as
(Attachment C). This land use is defined
manages 19 of the parcels (153 acres) and the Ramsey County Parks and Recreation Department
11 parcels (338 acres) as public parks. The remaining land is owned by several entities, including
the City, Ramsey County, the State of Minnesota, and private property owners/homeowners
associations. Existing land uses on these properties include trails, stormwater easement ponds,
and single family homes.

Currently there are no districts designated for parks or open space areas in the Zoning Code
(Attachment D). Park facilities are integrated into residential or business zoning districts.
Minnesota State law requires that local zoning codes be consistent with adopted comprehensive
plans. Establishing a Parks and Open Space District and a Conservation District would help the
City meet this requirement. Further, the new districts will assist in the implementation of the
es within the Zoning Code.
A draft version of the proposed districts was presented at the May 28, 2013, City Council work
session. The discussion at that meeting focused on the types of uses that should be allowed in the
districts, appropriate special regulations, and how to address privately owned parks. Staff has
attempted to incorporate the issues raised at this meeting into the proposed Ordinance 2013-010
for a Conservation District and Ordinance 2013-011 for a Parks and Open Spaces District. The
Planning Commission reviewed Planning Case 13-004at the October 9, 2013, meeting and
recommended approval of both Ordinances (Attachment F).
Summary of Proposed Ordinance Amendments and Additions
The Parks and Open Space District would be applied to City and County Parks. This district
could also be appropriate for City-owned parcels that are being used as public open space or that
corresponds with the Park Preserve District in the Comprehensive Plan and could only be applied
to the Arden Hills Army Training Site (AHATS).
It should be noted that this case only includes amendments to the Zoning Code. No rezoning of
any property is being proposed at this time. Staff has provided a hypothetical illustration of the
Zoning Map if the new districts were to be applied (Attachment E).
If adopted, Ordinance 2013-010 and Ordinance 2013-011 would amend or add regulations to two
chapters of the Zoning Code:

The Zoning Code provides the following existing definition for a public use:
The use of any lot, parcel of land and any structure or building thereon exclusively for
public purposes by any department or branch of government, federal, state, county or
city, excluding independent school districts, without reference to the ownership of said
lot, parcel of land, building or structure.
Staff is proposing to add a definition to the Zto differentiate
these uses from other types of public uses. Park facilities are listed as a permitted use in the
Parks and Open Space District. All other public uses are allowed as conditional uses.
The use of any lots or parcel of land and any structure or building thereon for public
active and passive recreation purposes by the Arden Hills Parks and Recreation
Department or the Ramsey County Parks and Recreation Department.
No new or revised definitions have been proposed for the Conservation District.
1320 District Provisions
1320.04 Purpose
The District purpose statement is meant to outline the specific reasons for why the City is
adopting a set of land use regulations. Cities are granted considerable leeway in establishing land
use regulations as long as their intent is to address public health, safety, and/or welfare concerns.
The primary purpose of the Parks and Open Space District is to create land use regulations that
support the parks and open space areas managed by Arden Hills or Ramsey County. Setting aside
land for recreational uses addresses public health and welfare concerns through supporting
community health, promoting ecological stewardship, and conserving environmental resources.
The Conservation District would only apply to AHATS, which is owned by the federal
government. Recognizing that portions of the site could be transferred to private parties in the
future, the purpose of the Conservation District is to ensure that any future development on the
property is staged and that a sustainable level of public expenditures for utilities and services is
maintained.
1320.05 Land Use Chart
The land use chart lists the permitted and conditional uses in all zoning districts. If a use is not
listed, it is automatically prohibited.

Given the size of the AHATS property, the City Attorney advised listing utility distribution lines
as a permitted accessory use so that the City can better manage the placement of distribution
lines which may impact future uses or development on the property.
1320.06 District Requirements Chart
The district requirement chart lists the basic requirements for the development of a lot, such as
minimum lot area, setbacks, and lot coverage. No minimum lot area has been set for the Parks
and Open Space District or the Conservation District. The lot coverage and setback requirements
for the new districts reflect the existing requirements for residential districts. Most
City and County owned parks are currently zoned either R-1 (Single Family Residential) or R-2
(Single and Two Family Residential) and are therefore already subject to the district
requirements being proposed for the Parks and Open Space District.
1320.145 Special Requirements for the Parks and Open Space District
Some zoning districts have additional special requirements that need to be met. These
requirements may include standards on development, design, or permitted uses. For the Parks
and Open Space District, two provisions are included in the special requirement section, one on
conditional uses in the district and the other on development standards. The first directs the City
Council to evaluate conditional use permit applications on the compatibility of the proposed use
with the natural features and recreational amenities found on the site, along with the conditional
use permit evaluation criteria established in Section 1355.04 Subd. 3.
The second provision would allow the City to require certain performance standards if in its
review of development plans it concludes that potential impacts on natural features will require
mitigation.

1320.15 Special Requirements for the Conservation District
The special requirements section for the Conservation District includes one provision regarding
permitted uses. It states that in addition to the permitted uses specified in the land use chart, any
facility, building, use, or activity controlled by the Minnesota National Guard or the Army
Reserve on AHATS is permitted. Municipal governments do not have the authority to regulate
land use or development on federally-owned lands. While the City may zone AHATS as it sees
fit, those land use regulations are not enforceable. The purpose of including this provision is to
acknowledge that these land uses will be present on AHATS regardless of the other requirements
for the Conservation District found in the Zoning Code.
Requested Action
Review Ordinance Number 2013-010 for amendments to Section 1320 of the Zoning Code
related to the proposed Conservation District. Review Ordinance Number 2013-011 for
amendments to Section 1305.04 and Section 1320 of the Zoning Code related to the proposed
Parks and Open Space District.

Subd. 2 Conditional Uses. In addition to the evaluation criteria established in Section
1355.04 Subd. 3, applications for conditional uses within the POS District will be
evaluated by the City Council based on the following consideration:
A. The compatibility of the proposed use with the natural features and
recreational amenities of the Parks and Open Space District area.
Subd. 3 Development Standards. If the City determines in its review of site and
building plans for developments within the District that the protection of natural features
requires certain performance standards, the City may require additional development
standards to protect those features.

Community Development Intern Bachler stated in September of 2009, the City Council adopted

Evaluate and amend the land use regulations to achieve the highest possible
development standards, enhance the natural environment, protect public health,
support a vital mix of land uses, and promote flexible approaches to implement
the Comprehensive Plan.
Provide a balanced mix of residential, park, open space, and commercial land
uses.
Chapter 9 Parks and Recreation:
Develop, maintain, and encourage the use of a system of neighborhood parks and
pathways that are safe and engaging.
Protect and maintain access to lakes, marshes, and wooded areas for active and
passive recreation.
Chapter 10 Protected Resources:
Devel
trees, lakes, wetlands, and other unique or significant natural resources.
Community Development Intern Bachler explained that in the Comprehensive Plan, the Future
Land Use Map designates a total of 65 parcels covering
as public parks, which cover 153
acres. Ramsey County Parks and Recreation manages an additional 11 parcels of land totaling
338 acres. The remaining parcels are owned by several entities, including the City, Ramsey
County, the State of Minnesota, and private property owners/homeowners associations. Existing
uses on these lands include trails, municipal utilities, stormwater easement ponds, and single-

family homes.
City. Park Preserve is defined in
scenic areas
categorized as park preserve in the plan, all of which are located on the Arden Hills Army
Training Site (AHATS) on the eastern portion of the former TCAAP property. Currently there
are not districts specifically designated for parks or open space areas within the Zoning Code
(Attachment E). These facilities are integrated into residential or business-oriented zoning
districts as permitted or conditional uses. Minnesota State law mandates that local zoning codes
are consistent with adopted comprehensive plans. Establishing a Parks and Open Space District
and a Conservation District would help the City meet this requirement. Further, the new districts
land use
objectives within the Zoning Code.
Community Development Intern Bachler commented staff has prepared a draft of Ordinance
Number 2013-009 for a Parks and Open Spaces (POS) District and Ordinance Number 2013-010
for a Conservation (CD) District. Preliminary versions of the drafts were presented at the April 3,
2013, Planning Commission regular meeting, the April 15, 2013, Parks, Trails, and Recreation
Committee meeting, and the May 28, 2013, City Council work session. The discussion at each
meeting focused on what types of uses should be allowed in the districts, special regulations that
should be adopted, and how to address privately owned parks and open spaces (Attachments G,
H, and I). Staff has attempted to incorporate the concerns raised at these meetings into the current
drafts of the ordinances. The proposed POS district would reflect the goals for the Parks and
Open Space District identified in the Comprehensive Plan and could be applied to City and
County Parks in Arden Hills. Additionally, this district could be appropriate for City-owned
parcels that are either being used as public open space or that might be incorporated into the
Preserve District in the Comprehensive Plan, and in its current draft could only be applied to the
Arden Hills Army Training Site. It should be noted that no rezoning of any property is being
proposed at this time. Staff has provided a hypothetical illustration of the Zoning Map if the new
districts were to be applied. If adopted, Ordinance Number 2013-009 and Ordinance Number
2013-010 would amend or add regulations to two chapters of the Zoning Code:

1305.04 Definitions
Community Development Intern Bachler explained staff is proposing to add a definition to the
that the uses specifically associated with City and County-owned parks should be distinguished
from the broader category of public uses. The Zoning Code provides the following definition for
public use:
The use of any lot, parcel of land and any structure or building thereon exclusively for
public purposes by any department or branch of government, federal, state, county or
city, excluding independent school districts, without reference to the ownership of said
lot, parcel of land, building or structure.

No new or revised definitions have been proposed for the Conservation District.
1320 District Provisions
1320.04 Purpose
The District purpose statement is meant to outline the specific reasons for why the City is
adopting a particular set of land use regulations. Cities are granted considerable leeway in
establishing land use regulations as long as there is a clear intent in the regulations to address
public health, safety, and/or welfare concerns.
The primary purpose of the Parks and Open Space District is to create land use regulations that
support and are specific to the parks and open spaces managed by Arden Hills or Ramsey
County. Setting aside land for active and passive recreational uses addresses public health and
welfare concerns through supporting community health, promoting ecological stewardship, and
conserving environmental resources.
The Conservation District would apply only to AHATS, which is owned by the federal
government. Recognizing that portions of the site could be transferred to private entities in the
future, the purpose of creating the Conservation District is to ensure that any future development
on the property is staged and that a sustainable level of public expenditures for utilities and
services is maintained.

listed, it is automatically prohibited. In the Parks and Open Space District, permitted uses would
include park facilities and utility distribution lines. Conditional uses in this district would include

utility distribution lines would be the only permitted use. Conditional uses in the district would
include public uses, utility transmission and antenna, dish, or tower uses.

consideration:
1. The City Council approved the Arden Hills 2030 Comprehensive Plan on September 28,
2009.
2. The proposed Parks and Open Space District is in substantial conformance with the Parks
and Open Space District defined in the Arden Hills 2030 Comprehensive Plan and Future
Land Use Map.
3. The proposed Conservation District is in substantial conformance with the Parks Preserve
District defined in the Arden Hills 2030 Comprehensive Plan and Future Land Use Map.
4. The proposed Parks and Open Space District and Conservation District would work
toward implementing goals and recommended policies in the Arden Hills 2030
Comprehensive Plan.
5. The proposed Parks and Open Space District and Conservation District would work
toward bringing the City in compliance with Minnesota State law, which mandates that
local zoning codes are consistent with adopted comprehensive plans.
Community Development Intern Bachler recommends approval of Ordinance Number 2013-009
in Planning Case 13-004 for amendments to 1305.04 and Section 1320 of the Zoning Code
related to the proposed Parks and Open Space District as presented in the October 9, 2013
planning case report.
Community Development Intern Bachler recommends approval of Ordinance Number 2013-010
in Planning Case 13-004 for amendments to Section 1320 of the Zoning Code related to the
Conservation District as presented in the October 9, 2013 planning case report. If the Planning
Commission would like to make changes to the ordinances, those changes can be included with a
motion to approve. If the Planning Commission makes a recommendation on this planning case,
it will likely go before the City Council at their October 28, 2013 regular meeting.

Commissioner Holewa requested further information on the differences between a conditional
use permit and a conditional accessory use permit.
Community Development Intern Bachler indicated a conditional accessory use was seen as an
accessory to the principle use on the property. He further reviewed the conditional accessory
uses throughout the City.

Commissioner Holewa moved and Commissioner Zimmerman seconded a motion to
recommend of Ordinance Number 2013-009 for amendments to Section 1305.04 and
Section 1320 of the Zoning Code related to the proposed Parks and Open Space District as
presented in the October 9, 2013, report to the Planning Commission. The motion carried
unanimously (6-0).

SUBJECT: Cancellation of the December 30, 2013, City Council Meeting
Background
In prior years, the City Council has cancelled the second regular meeting in December if there
are no items requiring timely action by the Council. At this time, all necessary items for
discussion and Council action have been placed on the agendas for the December 9, 2013,
meeting or the December 16, 2013, work session.
This year, the last Monday in December falls on December 30, 2013.
Council Action Requested
Staff would like the Council to discuss the proposed cancellation of the December 30, 2013,
regular City Council meeting. If the Council is in favor of cancelling the December 30, 2013,
City Council meeting, staff will bring this topic to the November 25, 2013, Council meeting as a
Consent Item for Council approval.
