A RESOLUTION APPROVING AGREEMENT WITH
COUNTY OF FtAMSEY FOR LAW ENFORCEMENT
SERVICES FOR THE YEAR 1980
WHEREAS, pursuant to Resolution No. 77-75, adopted on
December 27, 1977, the City Council of the City of Arden Hills
authorized the transfer of its police department functions to
the Ramsey County Sheriff's office and approved an Agreement for
law enforcement services for the calendar year 1978, and
WHEREAS, the City of Arden Hills is desirous of contract-
ing again with the County of Ramsey to have said County, by and
through its Sheriff's Department, continue to perform such law
enforcement functions for, and within the boundaries of, the City
of Arden Hills during the calendar year 1980, and
WAEREAS, the County of Ramsey has submitted to the City
of Arden Hills a document entitled "Agreement--Law Enforcement
Services" for the calendar year 1980 which is identical in all
respects to the original Agreement between the City of Arden Hills
and the County of Ramsey with the exception that:
l. Paragraph 7 has been amended to clarify
that the County will be reimbursed for
actual costs; Exhibit A represents
estimated costs.
2. A provision relating to the transfer of
personal property by the City to the
County was deleted, and
�EREAS, trze City Council of the Cit1 of Arden Hills
feels that such provision relating to the transfer of items of
personal property be added to the form of document submitted

to the City by the County and that there likewise be added to
such provision a statement to the effect that such items of
personal property would be returned to the City upon termination
of its contractual relationship with the County concerning law
enforcement services.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Arden Hills
City Council that the "Agreement--Law Enforcement Services", a copy
of which is attached hereto and made a part hereof as Exhibit "A",
is hereby adopted and approved provided the following provision is
added thereto as a new Paragraph No. 14:
"14. The Municipality has transferred to the Ramsey
County Sheriff pursuant to Paragraph No. 11 of the
original Agree�ent between the parties, dated
January 3, 1978, the goods and items which are listed
in Exhibit "B" attached hereto and made a part hereof.
Such goods and items are to remain with the Ramsey
County Sheriff and to be utilized thereby so long
as the Municipality and Ramsey County have a contractual
arrangement whe.reunder Ramsey County i5 to provide
law enforcement services for the Municipality and are
to be returned to the Municipality upon termination
of such arrangement."
BE IT FURTHER RESOLVED, that the Mayor and Clerk-Administrator
are hereby authorized and directed to execute said Agreement on behalf
of the City and to take all steps necessary to effectuate said
Agreement.
BE IT FURTHER RESOLVED, that the Clerk-Administrator of the
City is hereby authorized and directed to forward a certified copy
of this Resolution and the executed original and copy of the Agreement
with the above-referenced provision added thereto, to the appropriate
officials of the County of Ramsey.

LAW EnFORCE*iEhT SERVICES
THIS AGREE*tENT, made and entered into this,%�9 �dav of�,
1�6, by and between the COUNTY OF RA?�iSEY, hereinafter referred to as the
"Countv' and the CITY OF ARDEid HILLS, hereinafter referred to as the
"'iunicipalitv".

i,�iEREAS, the parties to this Agreement are desirous of contractino
for the nerformance by the County of the hereinafter described law enforcement
functions for, and within the boundaries of, t?�e P?unicipality through the
Ramsev County Sheriff; and
TY�1-IEP.EAS, the Countv of Ramsey is agreeable to renderinQ such
services on the tertas and conditions hereinafter set forth; and
�af?EP.UAS, such contracts ase authorized and nrovided for bv the
provisions of xiinnesota Statutes 1957, Sec. 471.59 and Sec. 436.05, and
Laws 1959, Chapter 372.
°70k*, TF��REFORE, pursuant to the terms of the aforesaid statutes,
it is agreed as follows:
1. The County agrees, throu�h the Sheriff of the Countv of
Ramsey, to provide patrol and police protection toithin the cornorate
limits of 'tunicipalitv to the extent and in the manner hereinafter set forth.
Except as othenaise hereinafter specifically set forth, such
services shall only encompass duties and functions of the tyne coming
within the jurisdiction of and custonarily rendered by the Gheriff of the
County of Ramsey under the statutes.

The rendition of such service, the standards of performance,
the discipline of officers, and other matters incident to the performance
of such services and the control of personnel so employed, shall be
under the jurisdiction of the County. In event of dispute between the
parties as to the extent of the duties and functions to be rendered
hereunder, or the level or manner of performance of such service, the
determination thereof made by the Sheriff of the Countn shall be final
and conclusive as between the_parties hereto, provided however, that
upon notice bv the *fuaicipality, the parties shall negotiate their
differences in aecordance with the provisions of paragraph 11 hereof.
Services pezformed hereunder shall include but not be limited
to traffic law enforcement including the regular use of radar as a sneed
deterrent, non-traffic ordinance law enforcement, license inspection
and enforcement, and the re�ular patrol of business and residential
areas within the ?°funicipality.
Services shall be provi@ed 24 hours per day and shall be
performed by the number of deputies and other personnel Uudgeted for
in the herein attached Exhibit "A".
2. To facilitate the perforriance of said functions, it is
hereby agreed that the Countp sha12 ieave full cooperation and assistance
from the Municipality, its officers, agents and employees.
3. For the purpose of nerforming said functions, County shall
furnish and supply all necessary labor, supervision, equipment, communication
facilities and dispatching, and supplies necessarq to maintain the level of
service to be rendered hereunder.
4. All Deputy Sheriffs, clerks, dispatchers and alI other
personnel performing duties pursuant to this agreement shall at all times
be considered emplayees�af the Countp for all purposes.

Excent as otherwise provided, the ?4unicinality shall not be called
unon to ass�e any liability for the dii'ect payment of ar�y salaries,
wages, or other cornpensation to any County personnel perPorming services
hereunder for said Municipality, and the County herebv asstunes said liabilities.
_T.kcept as herein otherwise snecified, the b±unicinalit.y shall not be
liable for compensation or indemnit,v to any County employee for injury or
sickness arising out of this employment, and the County hereby agrees to hold
harmless the Dqunicipality against any such claim. -
5. The Municipa.lity, its oFPieers and employees, shall not be deemed
to assume any liability for the intentional or negligent acts of the County
or the County's emplayees performing services pursuant to this Agreement, and
the County shall hold the Tdunicipality, its officers and eaployees harmless
from and shall defend the '�unicipality, its officers and emplo,yees, against
any claim for damages arising fra*� the aerformance of this Agreement.
6. ihis Agreement sha11 commence January 1, 1980 , and shall be in
effect until December 31, 1980 . Either party may terminate this Agreement
upon ninety (90) days written notice to the other party. In this event, the
property listed in the herein attached Exhibit "B" or its Punctional or
general equivalents, shall be returned to the �".un�.cipality. .
7. The 1�'vnicipality agrees to pay the County the actual cost of
performing all services covered by this agreement. Costs shall include
salaries of employees engaged in perfarmin� said services, including a pro
rata oP vacation and sick leave, mileage, uniforms, public employees
retirement contributions, s.+orker's compeasation insurance premi�s, general
overhead, including indirect expenses and supplies, radio unit expense,
health and welfare expense, and police professional liability insurance
uAon which, in addition to the County; the municivality sha1l be a named
insured.

The proposed costs Por calendar year 1980 are as set forth in the
19E0 �dget Estimate, prepared by the County, which is attached hereto
and ma.de a part hereof as Exhibit "A". Costs as used herein shall not
include items of expense attributable to services or facilities normally
provided or available to a11 cities within the County as part of the
County's obligation to enforce 5tate law.
Actual computation of applicable costs hereunder s�a.11 be made by
the Ramsey County Budget and Ij.ccounting ofYice based on information provided
by the Sheriff and payment therefor shall be made by the municinality on the
County's monthly statement.
An estimate of said costs for .198� , and for succeeding years in the
event this agreement is extended, shali be i'urnished by the CountY to the
municipality no less than one month prior to the co�encer�ent of the contract
term. Said estimate shall be made for the limited �urpose of better enabling
the munitipality to estimate its budget. It is understood by the parties to
this agreement that said estimates shall in no way prevent the County from
charging its actual costs.
8. It is vnderstood that prosecutions for violations of ordir_ance
or state statute, together with disposition of all fines collected pursuant
thereto, shall be in accordance with the F.amsey County A"unicipal Court 1�ct,
?�finnesota Statute, Chapter �t88� .
q. The Ramsey County SY►eriff's office sball sub�it to the �
1�unicipality monthly activity reports detailing the activities of the
Sheriff's office within the City. Said reports shall contain at least the
£ollawing information: Piiles patrolled, hours patrolled, number of calls
answered, number of tickets issued.
10. Since the ?":ayor is the Chief Law Enforcement Officer of
the "�4unicipality, either he or his designate shall act as liaison to
the Sheri£f's departnent.
11. It is understood between the Parties hereto that u�on
notice given by either Party, negotiations will be undertaken for t�e
purnose of revising, adding or striking any of the provisions of this
contract which it aopears are in dispute, are unworkable, or are
insufficient as herein set forth; and that such changes, if any, when
agreed to, will be entered by sup�lemental contract, Which shall have
the same ef£ect as though it had been originally a provision of this
Agreement.
12. It is further understood that this Agreement shall take
effect upon being aporoved and er.ecuted by both parties hereto. The
County agrees to notify the 1�unicipality forthwith uroon said approval
bv the 3oard of Commissioners.
13. This �greement shall be e£fective as oP Januar�� Z. 1°8n .
