Extract of Nlinutes of Meeting of City Council City of Arden Hills Ramsey County, Minnesota August 26, 1985 Pursuant to due call and notice thereof, the City Council of the City of Arden Hills met in regular session at the City Hall on Monday, August 26, 1985, at 7:30 o'clock p.m. The following members were present: Mayor Woodburn and Council members Hicks, Peck, Sather and Hansen (who appeared at about 7:45 o'clock p.m.); and the following were absent: None. Councilman Hicks introduced and moved the adoptiori of the following resolution: RESOLUTION No. 85-38 (Replacing Resolution No. 85-38 Adopted on August 12, 1985) RE50LUTION ORDERING PREPARATION OF PLANS AND SPECIFICATIONS P,ND CONSTRU�TION�F�- — IMPROVEMENT NO. SS-W-P-ST-85-2, EDGEWATER ESTATES WHEREAS, by Resolution No. 85-24 adopted on June 24, 1985, _ _ _ _ _ _ _ __ _ _ the City Council declared the petition of Gerald L. McGuire for Improvement No. SS-W-P-ST-85-2, Edgewater Estates (the "Improve- ment") to be adequate under Chapter 429 of Minnesota Statutes, as amended, and ordered the City Engineer's preparation of a preliminary feasibility report and cost estimate, subject to petitioner's agreement to reimburse the City for such report and � ` estimate if he abandoned his Edgewater Estates development project, and � � WHEREAS, by original Resolution No. 85-38 adopted on August 12, 1985, the City Council accepted the City Engineer's feasibility report and cost estimate and scheduled a public hearing on the Improvement for �eptember 9, 1985 unless prior to that date the City received a letter or agreement signed by one hundred percent (1000) of the owners of properties affected by the makirig of the Improvement, and WHEREAS, on August 26, 1985, the City received a revised petition signed by the owners of one hundred percent (100$) of the properties affected by the Improvement, and WHEREAS, there no longer is a need for a public hearing in regard to the Improvement and the contents of the original Resolution No. 85-38 are now superfluous, NOW, TH�REFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA THAT: ,`' 1. The original Resolution .No. 83-3� be of no j' further force and effect and be replaced by ,, this Resolution No. 85-38; 2. The Clerk-Administrator be authorized and directed to do all things necessary to stop the ublication of the Notice of Hearin on the P g Improvement scheduled for September 9, 1985; 3. The Improvement be constructed and financed, and special assessments be levied therefor, pursuant to Chapter 429 of Minnesota Statutes, as amended; 4. The area proposed to be assessed for the Improvement be the property described in the Notice of Hearing attached to the original . Resolution No. 85-38 as Exhibit "A"; and 5. The City Engineer be authorized and directed to prepare and to submit to the City Council the final plans and specifications for the Improve- ment--subject, however, to the City's first s� receiving from Petitioner Gerald L. McGuire a written agreement whereunder he agrees to reimburse the City for all costs and expenses incurred by it in the preparation of such plans and specifications in the event his Edgewater Estates project, which has necessitated the Improvement, is abandoned and also subject to the City Engineer's delay in the preparation of specifications for the roadway to be called "Parkshore Drive" until the length of that road is determined by the Petitioners McGuire and Winieckis. The motion for the adoption of the foregoing resolution was duly seconded by Couneilman Fiansen and, upon vote being taken thereon, the following voted in favor thereof: All; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Extract of Minutes of Meeting of City Council City of Arden Hills Ramsey County, Minnesota August 12, 1985 Pursuant to due call and notice thereof, the City Council of the City of Arden Hills met in regular session at the City Hall on Monday, August 12, 1985, at 7:30 o'clock p.m. The following members were present: Mayor Woodburn and Council members Sather, Peck, Hansen and Hicks. Councilman Hansen introduced the following resolution and moved its adoption: RESOLUTION No. 85-38 RESOLUTION RECEIVING FEASIBILITY REPORT FOR IMPROVEMENT NO. SS-W-P-ST-85-2, EDGEWATER ESTATE5 AND SCHEDULING PUBLIC HEARING THEREON FOR SEPTEMBER 9, 1985 _-- WHEREAS, by resolution adopted on June 24, 1985 (Resolu- tion No. 85-24), the Council of the City directed the City Engineer to_prepare a preliminary report as to the feasibility of _ _ _ the City's installation of sanitary sewer, water main, bituminous paving, aggregate base, concrete curb and gutter, storm sewer, drainage and appurtenant improvements on a 21.5 acre tract of land lying on the southeasterly shore of Round Lake and immediately west of and adjacent to Old Highway No. 10 in the City, and to include in such report the estimated cost of the proposed improvements and an indication as to whether they should best be made as proposed or in connection with some other improvements, and WHEREAS, such preliminary feasibility report and cost estimate have been submitted to and considered by the Council, , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA THAT; 1. The preliminary feasibility report and cost estimate for Improvement No. SS-W-P-ST-85-2, Edgewater Estates (the "Improvement") be approved in the form submitted and be placed on file in the office of the Clerk-Administrator of the City; 2. The Council meet at the City Hall, 1450 West Highway 96, in the City on September 9, 1985 at � 7:30 o'clock p.m. for the purpose of holding a public hearing on the Improvement under and pursuant to the provisions of Chapter 429 of Minnesota Statutes, as amended, unless the Council shall at or prior to said public hearing receive a petition or agreement signed by one hundred percent (100�) of the owners of properties affected by the construction of the Improvement; 3. The Clerk-Administrator be authorized and directed to cause notice of the time, place and purpose of that meeting to be published twice in the official newspaper, New Brighton Bulletin, which publication shall be a week apart, and the second publication shall not be less than three days before the date of the meeting, which notice shall be substantially in the form attached hereto as Exhibit "A"; and 4. The general nature, estimated cost and area proposed to be assessed for the Improvement be determined to be as stated in the notice appended hereto as Exhibit "A" just as though the same were separately set forth and resolved herein.
